HomeMy WebLinkAboutReso 2003-566 RESOLUTION NO. 2003 - 5'" A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, PURSUANT TO SECTION 5.1 OF THE MUNICIPAL CHARTER, CALLING FOR A GENERAL ELECTION TO BE HELD ON TUESDAY, SEPTEMBER 9, 2003, FOR THE PURPOSE OF SUBMITTING TO THE ELECTORATE OF THE CITY OF SUNNY ISLES BEACH THE NAMES OF ALL QUALIFIED CANDIDATES FOR ELECTION TO THE POSITION OF CITY COMMISSIONER, SEAT 01 (NORTHERN RESIDENTIAL AREA); PROVIDING FOR CITY COMMISSION DESIGNA TION OF TWO REGISTERED VOTERS WHO SHALL SERVE WITH THE CITY CLERK AS THE CANVASSING BOARD FOR SAID GENERAL ELECTION; PROVIDING FOR CONDUCTING THE ELECTION, POLLING PLACES, FORM OF BALLOT, VOTER REGISTRATION, NOTICE OF ELECTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 5.1 of the Municipal Charter of the City of Sunny Isles Beach, provides: "A general election shall be held in each odd-numbered year, on the second Tuesday following the first Monday in September; and WHEREAS, City Ordinances Number 99-65,2001-124, and 2003-170, provide for the City Commission to designate two registered voters who shal~ serve with the City Clerk as the Canvassing Board. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Calling A General Election In accordance with the Municipal Charter of the City of Sunny Isles Beach, Florida, and the general laws of the State of Florida, a General Election is hereby called and directed to be held in the City of Sunny Isles Beach, Florida, from 7:00 a.m. to 7:00 p.m. on Tuesday, September 9, 2003, for the purpose of submitting to the electorate the names of all qualified candidates for election to the position of City Commissioner, Seat 01 (northern residential area). Section 2. Designation Of Two Registered Voters To Serve On The Canvassing Board The City Commission of the City of Sunny Isles Beach hereby designates two registered voters, m~NU~L A I\} f. , and, :IR\I I)\)6 ~ 'Ah'\o1O'b, to serve with the City Clerk as the City of Sunny Isles Beach's Canvassing Board for the September 9, 2003, General Election. Section 3. Conducting the Election The City Clerk is authorized to utilize the services of the Miami-Dade County Supervisor of Elections and his staff of officials for assistance in the conduct of said General Election. The Miami-Dade County Election Officials shall furnish the official returns for each precinct to the R2003- Calling General Election Page 1 of 3 City Clerk of the City of Sunny Isles Beach as soon as the ballots from all precincts have been tabulated, and the City of Sunny Isles Beach Canvassing Board's certification of the duly accepted results of said elections shall be accepted by the City Commission. Section 4. Polling Places That said polling places in the City of Sunny Isles Beach for said Special Election shall be as established by the proper and appropriate Miami-Dade County Supervisor of Elections and his staff of officials. All electors shall vote at the polling places and the voting precincts in which the OFFICIAL REGISTRATION BOOKS show that the said electors reside. A list of the voting precincts and the polling places therein (subject to change by the Miami-Dade County Supervisor of Elections, in accordance with the laws of Florida) is attached hereto as Exhibit "A". Section 5. Form of Ballot The ballot for said General Election shall be printed in compliance with State law as prepared by the Miami-Dade County Supervisor of Elections, and approved by the City Clerk as the Supervisor of Elections. Section 6. Voter Registration Registration of persons desiring to vote in said General Election shall be in accordance with the general laws of the State of Florida governing voter registration. Qualified persons may obtain registration forms to vote at the Office of the City Clerk, City Hall, Suite 250, 17070 Collins Avenue, Sunny Isles Beach, Florida, 33160, Monday through Friday, except legal holidays, between the hours of 9:00 a.m. and 5:00 p.m., and at such other voter registration centers and during such times as may be provided by the Miami-Dade County Supervisor of Elections. Each person desiring to become a registered voter shall be responsible for properly filling out the registration form and returning it to the Miami-Dade County Elections Office. All completed registration forms must be received by the Miami-Dade County Elections Office and clocked in no later than Monday, August 11, 2003, at 5:00 p.m., for the General Election, in order for a person to vote in said election. All questions concerning voter registration should be directed to the Miami-Dade County Elections Office, 111 NW 1st Street, Floor 19, Miami, Florida, 33130; mailing address: P.O. Box 012241, Miami, Florida 33101; telephone: (305) 375-5553. Section 7. Notice of Elections That not less than thirty days notice of said General Election shall be given by publication in a newspaper of general circulation in Sunny Isles Beach, Miami-Dade County, Florida. Such publication shall be made at least once each week for four consecutive weeks preceding said Election. Section 8. Effective Date. This resolution shall become effective upon adoption. Hines c &. ^'� Acting City Clerk Date: July 17, 2003 Re: RESOLUTION CALLING A GENERAL ELECTION, AND RUN-OFF ELECTION, IF NECESSARY, AND DESIGNATING TWO REGISTERED VOTERS TO SERVE ON THE CANVASSING BOARD FOR THOSE ELECTIONS RECOMMENDATION: It is recommended that the City Commission adopt the attached resolution. REASONS: It is requested that the City Commission designate "two registered voters" who shall serve with the City Clerk as the Canvassing Board for the upcoming General Election. It is recommended that the City Commission adopt the attached resolution which provides for a General Election on September 9, 2003, and if necessary, a run-off election on October 14, 2003. This resolution complies with the requirements of conducting a General Election, and if necessary, a run-off election, pursuant to City Ordinances Numbers 99-65, 2001-124, and 2003- 170, the City Commission must designate two registered voters to serve on the Canvassing Board of these specific elections. The registered voters who would serve on the Canvassing Board should be willing to remain neutral during the upcoming campaign process. ADDITIONAL INFORMATION: Please note that the qualifying period for official candidates ends at 4:00 p.m. on Thursday, July 17, 2003. Accordingly the Resolution may need to be amended to reflect any uncontested races. Agenda Item Date
