HomeMy WebLinkAboutReso 2003-570 RESOLUTION NO. 2003 - .5 '7 () A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING AN AGREEMENT A WARDING BID NO. 03-04-01 TO INTERNATIONAL SIGN AND DESIGN CORP., FOR ENTRANCE SIGNAGE FOR THE CITY OF SUNNY ISLES BEACH, IN AN AMOUNT OF SEVENTY-SEVEN THOUSAND, FIFTY-THREE DOLLARS ($77,053.00), ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach desires to install entrance signage at the three entrances to the City; and WHEREAS, the City publicly advertised Invitation to Bid No. 03-04-01 for entrance signage, and sent out bid packages to nine (9) potential bidders; and WHEREAS, the City received the following five (5) responsive bids: Interstate Sign Crafters" Inc. $ 75,900.00 Acolite Claude United Sign Co., Inc. $120,656.00 Don Bell Signs, LLC $ 95,000.00 International Sign and Design Corp. $ 77,053.00 Graphic Systems, Inc. $154,968.37 WHEREAS, the City determined that International Sign and Design Corp., was the lowest most responsive, responsible bidder with a sealed bid of Seventy-Seven Thousand Fifty- Three Dollars ($77,053.00); and WHEREAS, the City wishes to enter into an Agreement, attached hereto as Exhibit "A", with International Sign and Design Corp., in an amount of $77,053.00, for the construction and installation of entrance signage. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, THAT: Section 1. Incorporation of Recitals. The recitals set forth in this resolution are incorporated herein by reference as if fully set forth herein. Section 2. Award of Bid. The City Corimussion hereby awards Bid No. 03-04-01 for the construction and installation of entrance signage for the three entrances into the City, to International Sign and Design Corp. Section 3. Approval of Agreement. The Agreement by and between the City of Sunny Isles Beach and International Sign and Design Corp., for construction and installation of entrance R2003- International Sign & Design Corp. BA #03-04-01 Page 1 of 2 signage, in an amount of $77,053.00, attached hereto as Exhibit "A", be and the same, is hereby approved. Section 4. Authorization of Mayor. The Mayor IS hereby authorized to execute said Agreement. Section 5. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate the terms of this Agreement. Section 6. Effective Date. This Resolution will become effective upon adoption. BA #03-04-01 Page 2 of 2 " \ " CITY OF SUNNY ISLES BEACH ENTRANCE SIGNAGE CONTRACTOR AGREEMENT CONTRACT NO. 03-0401-07 HIS CONTRACTOR AGREEMENT made and entered into this / 7 ~ay of 2003, by and between the CITY OF SUNNY ISLES BEACH, FLORIDA, a munlclp corporation of the State of Florida, (hereinafter referred as to "City") and INTERNATIONAL SIGN AND DESIGN CORP., a Florida corporation, authorized to do business in the State of Florida, (hereinafter referred to as "Contractor"), whose Federal I.D.# is SS'~){3:s'1 q . WHEREAS, International Sign and Design Corp., is a qualified, Florida contracting firm experienced in the design and installation of commercial/industrial signs; and WHEREAS, by Resolution No. 2003-51Q, the City qualified Contractor as the lowest responsible bidder to City Bid No. 03-04-01 for entranceway signage to the City of Sunny Isles Beach; and WHEREAS, the City wishes to employ Contractor to design and install the entrance way sign to the City as more specifically described in Exhibit "A," attached hereto and made a part hereof; and, WHEREAS, the Contractor is qualified, willing and able to provide the desired services on the terms and conditions set forth herein; NOW THERFORE, in consideration of the premises and the mutual covenants herein named, the parties hereto agree as set forth below: 1. RECITALS. The Recitals set forth above are hereby incorporated into this Agreement and made a part of hereof for reference. 2. SERVICES TO BE PERFORMED. Contractor shall perform the following services: a. Specialized assistance in the design and installation of the entranceway sign for the City of Sunny Isles Beach, as well as those services more particularly described in Exhibit "A" attached hereto and made a part hereof. b. Contractor will prepare and present oral/written reports as needed or as requested on a periodic basis while engaged in special projects. Contractor shall provide, on a monthly basis, to the City Manager, a detailed narrative report delineating all services provided by the Contractor in the previous month. The Contractor shall also provide quarterly, written reports, detailing all of the Contractor's activities in the previous quarter and the results of the Contractor's efforts. Each report required herein will be submitted to the attention of the City Manager. c. The total price for these serv~ is Seventy-seven Thousand, Fifty-three and No/I00 Dollars ($77,053.00), payable: ~ monthly 0 as invoiced. TERM. Subject to the provisions relating to the termination of this Agreement as set forth in Paragraph 10 hereunder, the term of this Agreement shall be from July 20, 2003 to December 20, 2003, and shall begin within ten (10) days after notification to proceed. Any change in fee, terms or conditions shall be accomplished by written amendment to this contract. 4. COMPENSATION. Payment to Contractor for all charges and tasks under this Agreement shall be in accordance with this Agreement and the schedule of charges reflected in Exhibit "A", which fee shall be disbursed on a monthly basis and under the following conditions: a. Disbursements. There are no reimbursable expenses associated with this contract. b. Payment Schedule. Invoices received from the Contractor pursuant to this Agreement will be reviewed by the initiating City Department. If services have been rendered in conformity with the Agreement, the invoice will be sent to the Finance Department for payment. Invoices must reference the contract number assigned hereto. Invoices will be paid in accordance with the State of Florida Prompt Payment Act. c. Availability of Funds. The City's performance and obligation to pay under this Agreement is contingent upon an annual appropriation for its purpose by the City Commission. d. Final Invoice. In order for both parties herein to close their books and records, the Contractor will clearly state "final invoice" on the Contractor's final/last billing to the City. This certifies that all services have been properly performed and all charges and costs have been invoiced to the City. Since this account will thereupon be closed, any and other additional charges, if not properly included on this final invoice are waived by the Contractor. Contractor shall make no other charges to the City for supplies, labor, taxes, licenses, permits, overhead or any other expenses or costs unless any such expense or cost is incurred by Contractor with the prior written approval of the City. If the City disputes any charges on the invoices, it may make payment of the uncontested amounts and withhold payment on the contested amounts until they are resolved by agreement with Contractor. Contractor shall not pledge the City's credit or make it a guarantor of payment or surety for any contract, debt, obligation, judgment, lien, or any form of indebtedness. The Contractor further warrants and represents that it has no obligation or indebtedness that would impair its ability to fulfill the terms of this Agreement. 5. UNDISCLOSED CONDITIONS. In the event that undisclosed conditions are discovered during the performance of this Agreement, the City shall have the right to cancel this Agreement upon thirty (30) days written notice to Contractor. INDEPENDENT CONTRACTOR RELATIONSHIP. The Contractor is an independent Contractor and shall be treated as such for all purposes. Nothing contained in this agreement or any action of the parties shall be construed to constitute or to render the Contractor an employee, partner, agent, shareholder, officer or in any other capacity other than as an independent Contractor other than those obligations which have been or shall have been undertaken by the City, Contractor shall be responsible for any and all of its own expenses in performing its duties as contemplated under this agreement. The City shall not be responsible for any expense incurred by the Contractor. The City shall have no duty to withhold any Federal income taxes or pay Social Security services and that such obligations shall be that of the Contractor, other than those set forth in this agreement. Contractor shall furnish its own transportation, office and other supplies as it determines necessary in carrying out its duties under this agreement. 7. INSURANCE. Contractor shall, at its sole cost and expense, during the period of any work being performed under this Agreement, procure and maintain the following minimum insurance coverage to protect the City and Contractor against all loss, claims, damage and liabilities caused by Contractor, its agents, sub-Contractors or employees, as indicated below: )(' Comprehensive General liability insurance -- including broad form contractual liability coverage for all operations, including, but not limited to, contractual, products, and completed operations, personal injury and property damage liability with limits of One Million Dollars ($1,000,000) combined single limit occurrence. ;i( Workmen's Compensation, with no less than $100,000 for Employer's Liability. Said coverage shall include a waiver of subrogation in favor of the City, its agents, employees and officials. [J Errors and Omission -- Contractor shall carry a minimum of $500,000 coverage for errors and omissions. )( Business Automobile Liability which shall include coverage for all owned, non- owned and hired vehicles for limits of not less than $500,000 per occurrence, Combined Single Limit or its equivalent. Insurance required of the Contractor shall be primary to, and not contribute with, any insurance or self-insurance maintained by the City. Such insurance shall not diminish Contractor's indemnification and obligations hereunder. The insurance policy(ies) shall be issued by companies authorized to do business under the laws of the State of Florida and acceptable to the City. Before any work under this Agreement is performed, and at any time upon request, Contractor shall furnish to the City certificates of insurance evidencing the minimum required coverage and shall be appropriately endorsed for contractual liability, with the City named as additional insured. All policies shall contain a waiver of subrogation endorsement. All insurance policies and certificates of insurance shall provide that the policies may not be canceled or altered without thirty (30) days prior written notice to the City. The City reserves the right from time to time to change the insurance coverage and limits of liability required to be maintained by Contractor hereunder. Contractor shall also require and ensure that each of its sub-contractors providing services hereunder (if any) procures and maintains, until the completion of the services, insurance, of the types and to the limits specified herein. ANY EXCEPTIONS TO THE INSURANCE REQUIREMENTS IN THIS SECTION MUST BE APPROVED IN WRITING BY THE CITY. 8. OWNERSHIP OF DOCUMENTS AND EQUIPMENT. All documents prepared by the Contractor pursuant to this agreement and related services to this agreement are intended and represented for the ownership of the City only. Any other use by Contractor or other parties shall be approved in writing by the City. Contractor shall deliver to the City for approval and acceptance, and before being eligible for final payment or any amounts due, all documents and materials prepared by, and for, the City under this Agreement. All oral and written information not in the public domain or not previously known, and all information and data obtained, developed or supplied by the City, or at its expense, will be kept confidential by the Contractor and will not be disclosed to any other party, directly or indirectly, without the City's prior written consent, unless required by a lawful order. All drawings, maps, sketches, programs, data base, reports and other data developed or purchased under this Agreement for, or at the City's expense, shall be and remain the City's property and may be reproduced and reused at the discretion of the City. The City and Contractor shall comply with the provisions of Chapter 119, Florida Statutes (Public Records Law). All covenants, agreements, representations and warranties made herein, or otherwise made in writing by any party pursuant hereto, including, but not limited to, any representations made herein relating to disclosure or ownership of documents, shall survive the execution and delivery ofthis Agreement and the consummation ofthe transactions contemplated hereby. 9. INDEMNIFICATION. Contractor agrees to indemnify and hold harmless, the City, its officers, agents, and employees from, and against any and all claims, actions, liabilities, losses and expenses including, but not limited to, attorney's fees for personal, economic or bodily injury, wrongful death, loss of or damage to property, at law or in equity, which may arise or may be alleged to have risen from the negligent acts, errors, omissions or other wrongful conduct of the Contractor, agents or other personal entity acting under Contractor's control in connection with the Contractor's performance of services pursuant to that agreement and to that extent the Contractor shall pay such claims and losses and shall pay all such costs and judgments which may issue from any lawsuit arising from such claims and losses including wrongful termination 4 International Sign & Design Contract Attorney/ Agreements/ch City of Sunny Isles Beach 17070 Collins A venue, Suite 250, Sunny Isles Beach, Florida 33160 (305) 947-0606 phone (305) 949-3113 Fax or allegations of discrimination or harassment, and shall pay all costs and attorneys' fees expended by the City in defense of such claims and losses including appeals. The parties agree that ten percent (10%) of the total compensation is a specific consideration from the City to the Contractor for this indemnity. 10. TERMINATION. a. If, through any cause within the reasonable control the Contractor shall fail to fulfill in a timely manner or otherwise violate any of the covenants, agreements or stipulations material to this agreement, the City shall have the right to terminate the services then remaining to be performed. Prior to the exercise of its option to terminate for cause, the City shall notify the Contractor of its violation of the particular terms of the agreement and grant Contractor ten, (10) days to cure such default. If the default remains uncured after ten (10) days the City may terminate this agreement. 1. In the event of termination, all finished and unfinished documents, data and other work product prepared by Contractor (and sub- Contractor( s]) shall be delivered to the City and the City shall compensate the Contractor for all services satisfactorily performed prior to the date of termination, as provided in Paragraph 4 herein. 11. Notwithstanding the foregoing, the Contractor shall not be relieved of liability to the City for damages sustained by it by virtue of a breach of the agreement by Contractor and the City may reasonably withhold payments to Contractor for the purposes of set-off until such time as the exact amount of damages due the City from the Contractor is determined. 111. After receipt of a Termination Notice and except as otherwise directed by the City, the Contractor shall: 1. Stop work on the date and to the extent specified. 2. Terminate and settle all orders and subcontracts relating to the performance of the terminated work. 3. Transfer all work in process, completed work and other materials related to the terminated work to the City. 4. Continue and complete all parts of that work that have not been terminated. b. Termination for Convenience of City. Termination for Insolvency. The City also reserves the right to terminate the remaining services to be performed in the event the Contractor is placed either in voluntary or involuntary bankruptcy or makes any assignment for the benefit of creditors. 11. ASSIGNMENTS. TRANSFERS. SUBCONTRACTING. The Contractor shall not subcontract, assign or transfer any work under this agreement without the prior written consent of the City. Should the Contractor subcontract any services under this agreement, it shall be done with continued liability for the Contractor. The Contractor shall remain responsible for services, responsibilities and liabilities of any person or entity acting under Contractor. 12. TIME OF COMPLETION. The services to be rendered by the Contractor shall be commenced upon execution of this contract and shall be completed within the time specified in this Agreement. A reasonable extension of time shall be granted in the event the work of the Contractor is delayed or prevented by the City or by circumstances beyond the reasonable control of the Contractor including weather conditions of acts of God which render the performance of the Contractor's duty impracticable. 13. AUTHORITY TO PRACTICE. Contractor hereby represents and warrants that it has and will continue to maintain all licenses and approvals required to conduct its business and that it will at all times conduct its business activities in a reputable manner. Proof of such licenses and approvals shall be submitted to the City prior to commencement of work under this Agreement. 14. MODIFICATIONS OF WORK. The City reserves the right to make changes in the work, including alterations, reductions or additions thereto. Upon receipt of the City's notification of a contemplated change, the Contractor shall (1) if requested by the City, provide an estimate for the increase or decrease in cost due to the contemplated change, (2) notify the City of any estimated change in completion date, and (3) advise the City in writing if the contemplated change shall affect the Contractor's ability to meet the completion dates or schedules of this Agreement. 15. COORDINATION OF SERVICES. The City's representative/liaison during the performance of this Agreement shall be Christopher J. Russo, City Manager, telephone number 305/947-0606. Contractor shall not respond to requests for services under this Agreement unless the request is received directly from Christopher J. Russo, or designated personnel. Any requests received from other City departments/divisions shall be referred to the City Manager's Department representative designated above. Services performed without authorization by Christopher J. Russo, City Manager, shall be considered unauthorized and shall not be compensated/paid by the City. 16. ARBITRATION. It is the intention of the parties that whenever possible, if a dispute or controversy arises hereunder then such dispute or controversy shall be settled by arbitration in accordance with the procedures, rules and regulations of the American Arbitration Association. 6 International Sign & Design Contract Attomey/ Agreementslch .. . Arbitration shall be held in Miami-Dade County, Florida. The non-prevailing party shall pay all costs of arbitration and attorneys' fees incurred by the parties or, if neither party prevails on the whole, each party shall be responsible for a portion of the costs of arbitration and their respective attorneys' fees as may be determined by the court on confirmation. 17. CONFIDENTIAL INFORMATION. The Contractor shall not, either during the term of this Agreement or any time for a period of ten (10) years subsequent to that date upon which the Contractor shall leave the employment of the City for any reason whatsoever, disclose to any person or entity, other than in the discharge of the duties of the Contractor under this Agreement, any information which the City designates in writing as "confidential." As a violation by the Contractor of the provisions of this Section could cause irreparable injury to the City and there is no adequate remedy at law for such violation, the City' shall have the right, in addition to any other remedies available to it at law or in equity, to enjoin the Contractor in a court of equity for violating such provisions. 18. NOTICES. All notices and communications hereunder shall be in writing and shall be deemed given when sent postage prepaid by registered or certified mail, return receipt requested and, if intended for City to Christopher J. Russo, City Manager, with a copy to Lynn M. Dannheisser, City Attorney, City of Sunny Isles Beach, 17070 Collins Avenue, Suite 250, Sunny Isles Beach, Florida 33160, and, if intended for Contractor, shall be addressed to International Sign and Design Corp., 10831 Canal Street, Largo, Florida 33777, Attention: Thomas J. Kitchell. Telephone 727/541-5573; Fax 727/544-7745. 19. GOVERNING LAW. The validity of this Agreement and the interpretation and performance of all of its terms shall be construed and enforced in accordance with the laws of the State of Florida, without regard to principles of conflict of laws thereof. The location of any action or proceeding commenced under or pursuant to this Agreement shall be in Miami-Dade County, in the State of Florida. 20. AUDIT. The Contractor shall make available to the City or its representative all required financial records associated with the Agreement for a period of three (3) years. 21. NON-DISCRIMINATION. The Contractor agrees to comply with all local and state civil rights ordinances and with Title VI of the Civil Rights Act of 1984 as amended, Title VIII ofthe Civil Rights Act of 1968 as amended, Title I of the Housing and Community Development Act of 1974 as amended, Section 504 of the Rehabilitation Act of 1973, the Americans with Disabilities Act of 1990, the Age Discrimination Act of 1975, Executive Order 11063, and with Executive Order 11248 as amended by Executive Orders 11375 and 12086. The Contractor will not discriminate against any employee or applicant for employment because of race, color, creed, religion, ancestry, national origin, sex, disability or other handicap, age, marital/family status, or status with regard to public assistance. The Contractor will take affirmative action to insure that all employment practices are free from such discrimination. The Contractor agrees to post in conspicuous places, available to employees and applicants for employment, notices to be provided by the City setting forth the provisions of this non-discrimination clause. The Contractor agrees to comply with any Federal regulations issued pursuant to compliance with Section 504 of the Rehabilitation Act of 1973 (29 V.S.C. 708), which prohibits discrimination against the handicapped in any Federally assisted program. 22. CONFLICT OF INTEREST. The Contractor agrees to adhere to and be governed by the Miami-Dade County Conflict of Interest Ordinance Section 2-11.1, as amended; and by Sunny Isles Beach Ordinance No. 99-82, which are incorporated by reference herein as iffully set forth herein, in connection with the Agreement conditions hereunder. Contractor covenants that it presently has no interest and shall not acquire any interest, direct or indirectly that should conflict in any manner or degree with the performance of the services. 23. CONFLICTING PROVISIONS. The terms and conditions in this agreement supersede any other conflicting provisions that are contained in any other document. 24. MISCELLANEOUS. a. The rights granted to Contractor hereunder are nonexclusive, and the City reserves the right to enter into agreements with other persons or firms to perform services including those provided hereunder. b. Contractor and its employees shall promptly observe and comply with applicable provisions of all published federal, state and local laws, rules and regulations which govern or apply to the services rendered by Contractor hereunder, or to the wages paid by Contractor to its employees. c. Contractor shall obtain and keep in force during the term of this Agreement all necessary licenses, registrations, certificates, permits and other authorizations as are required by law in order for Contractor to render the service(s) required hereunder. d. Contractor shall not use the name or official seal of the City in any promotional material without the prior written consent of the City. e. Except as expressly provided for in this Agreement, Contractor is not authorized to act as the City's Agent hereunder and shall have no authority, expressed or implied, to act for or bind the City hereunder, either in Contractor's relations with sub-Contractors, or in any other manner whatsoever. 25. ENTIRE AGREEMENT. This Agreement and Attachment Exhibit "A," which is expressly incorporated herein by reference, shall constitute the entire agreement between the parties with respect to the subject matter hereof, and it shall supersede all previous and 8 International Sign & Design Contract Attorney/ Agreernentslch City of Sunny Isles Beach 17070 Collins Avenue, Suite 250, Sunny Isles Beach, Florida 33160 (305) 947-0606 phone (305) 949-3113 Fax contemporaneous oral and written negotiations, commitments, agreements and understanding relating hereto. This Agreement may be executed in multiple identical counterparts, each of which shall be deemed an original for all purposes. 26. AMENDMENT. Any modification of this Agreement shall be effective only if in writing and signed by the parties to this Agreement. No waiyer of any provision of this Agreement shall be valid or enforceable unless such waiver is in writin~ and signed by the Party granting such waiver. The CONTRACTOR shall be responsible for the quality of all materials and workmanship of any fIrm or individual who acts as a sub-contractor. All work under this contract shall be performed by skilled craftsmen under supervision of trained foremen, experienced in the trade or craft required to accomplish the Work and produce products of high quality. The CONTRACTOR shall guarantee all materials and workmanship for two years after date of acceptance of Work by CITY and CONSULTANT. 2. Written dimensions on drawings shall have precedence over scaled dimensions. CONTRACTOR shall field verify and be responsible for all dimensions and conditions shown by these drawings. Shop details must be approved by CONSULTANT prior to fabrication 3. CONSULT ANT shall be notified by CONTRACTOR of any discrepancies in drawings, in-fIeld dimensions or conditions and/or changes required in construction details. 4. Maintenance and Operating Manuals: Submit for CITY'S documentation. Furnish complete manuals describing the materials, devices and procedures to be followed in operating, cleaning and maintaining the Work. General: Provide custom manufactured sign assemblies and components completely fabricated and finished at factory before delivery to site. Construct to accurate detail and dimensions as shown and as reviewed on shop drawings. Fit and assemble the Work at the shop to the greatest extent possible, and mark the components as required to facilitate assembly during installati~n. Exposed fasteners on finished faces will 'not be allowed, unless specifically indicated. Waviness and oil canning of surfaces is not acceptable. Minimum material thickness is to be 0.2S inches unless otherwise noted or accepted by CONSULTANT. B. Lettering: Letterfonnshaving rounded positive and negative comers, nicked, cut, or ragged edges are not acceptable. Align letter forms to maintain a baseline parallel to the sign format. Maintain margins as indicated on Drawings. C. Seams and Joints: Weldedjoints shall be ground filled and fmished flush and smooth with adjacent Work. Such seams shall be invisible after fmal finish has been applied. Spot welded joints shall not be visible on exterior of signs or bus shelters after final finish has been applied. No gaps, light leaks, waves, or oil canning will be permitted in Work. D. Metal Signs: Fabricate exposed surfaces uniformly flat and smooth, without distortion, pitting, or other blemishes. Fonn exposed metal edges to a smooth radius. Grind exposed welds and rough areas to make flush with adjacent smooth surfaces. 1. Welding: Make welds continuous. Comply with American Welding Society, Aluminum Association, and Copper Development Association standards for the type of metal. Provide the alloy and type required for strength, workability, compatibility and color match after grinding smooth and finishing the fabricated product. 2. Fasteners: Provide tamper-proof bolts, nuts, screws, washers, anchors, and 02841-6 / l other devices required to complete the Work. Use same basic metal alloy as the metal fastened, and finished to match color and texture. Use stainless steel 300 series alloy where joining dissimilar materials and weather seal. Use exposed fasteners only where indicated. Perform drilling and tapping at shop. Provide adhesive sealant, and other necessary materials as specified by CONSULTANT. 3. Dissimilar Materials: Where metal surfaces will be in contact with dissimilar materials, coat the surfaces with epoxy paint or provide other means of dielectric separation as recommended by manufacturer to prevent galvanic corrosion, separate all ferrous and non-ferrous metals with non-conductive gaskets, provid~ stainless steel fasteners to secure ferrous to non-ferrous metals. Apply a bituminous coating to all metal surfaces that come in contact to any earth work, fill, etc. to resist corrosion. E. Hardware: Provide all incidental hardware necessary for the proper functioning of signs. External, hardware shall conform to the external appearance of the sign and be tamper-proof. 2.04 SHOP APPliCATION OF SIGN A. Powdercoat and/or Linear Polyurethane Finishes: Clean the surfaces as required for proper adhesion of coatings. Use 3M Co. "Scotch Brite" pads with cleanser and water, andlor chemically treat as recommeBded by paint manufacturer to remove deleterious film or residue. 1. Primer: Provide in strict accordance with paint manufacturer's recommendations as required for proper adhesion and application of finish. 2. Powdercoat and/or Linear Polyurethane Paint: Provide pre-treatment and primer in accordance with manufacturer's recommendation. 3. Powdercoat and/or Clear Linear polyurethane Finish: Provide pre- treatment, primer, and gloss finish coatings in accordance with manufacturer's r<<ommendations. Apply I.S. to 2.0 mils (0.0375 to 0.050 mm) dry film thickness. Apply in 2.0 mils (0.050) dry film thickness as recommended by manufacturer. 2.05 APPUCA nON OF GRAPIDCS '~ 02841-7 A. Acid-etched graphics and typography: Acid-etched typography and graphic imagery must be at least 1116" deep, with clean, crisp, sharp edges; ragged or soft (polished out) edges will be rejected. Acid baths used for etching should be fresh and used in an environment and temperature that will provide the highest quality etched images. Silk screened images and typography: Provide photo processed screening, arranged to furnish sharp and solid images without edge build-up or bleeding of the coating. Pattern cut screens may be used for non-repeat copy, provided that final image copy is equal to photo screen quality. Provide only weather resistant coating materials, compatible with the intended substrates. C. Vinyl Die-Cut and Pattem-Cut Graphics: Use pressure sensitive,non-yellowing, non-peeling and weather resistant vinyl adhesive letters or images die cut from Scotchca1 or ScotchLite as manufactured by 3M Company, applied in proper manner with 3M application tape as specified. Use approved fonts and equipment as specified. 2.06 APPLICATION OF SIGN ELElvIENTS A Preparation: Surfaces to receive the sign elements shall be clean, dry, and otherwise made ready for the application of materials. Accurately measure and layout the required marking configurations as indicated on drawings. B. Sign Graphics: Provide letters, numerals, symbols and other graphics inarkings, using fmish materials shown. Apply the graphics neatly, uniformly proportioned and spaced, and accurate within the dimensions indicated. Prepare the substrate surfaces and apply finish materials in aceordance with manufacturer's instructions. PART 3 -EXECUTION 3.01 PRE-INSTALLATION A. Verification of Conditions: Examine the areas to receive the Work and the conditions under which the Work would be performed. CONTRACTOR shall notify CONSULTANT of all conditions detrimental to the proper and timely completion of the Work. B. Pre-Installation Meeting: A pre-installation meeting will be held with CONSULTANT and CONTRACTOR to mutpally agree on all installation details, 02841-8 / l . \ placement, access, etc. 3.02 INSTALLATION OF SIGNS A. General: Complete installation shall be in accordance with manufacturer's printed instructions and accepted shop drawings, to produce Work: complying with the Contract Documents. The CONTRACTOR will be responsible for daily clean-up of their areas of Work. B. Erection of Signs: Set and attach the Work accurately in locatio~ alignment and elevation, plumb, level and true, as measured from established reference points and from other Work already in place. Fit components accurately together to from tight joints and secure connections. Coordinate with other trades as necessary, if applicable. 3.03 ADJUSTING Neatly repair minor blemishes or marring on finished surfaces so that repairs are imperceptible. ,Completely replace components having permanent non-removable scratches, stains, or other defacement. 3.04 CLEANING Upon completion of the Work, remove unused materials, debris, containers and equipment from the project site. Remove protective coverings and clean the exposed surfaces of the work to remove dirt, stains and other substances, by methods as recommended by manufacturer. 3.05 PROTECTION Protect the Wark during the construction period so that it will be without any indication of use or damage. Leave the Work clean and free from defects at time of CONSULTANT'S acceptance. 3.06 FINAL WALK-THROUGH AND PUNCHLIST A final walk-through will be held with CONSULT ANT to review the finished installation. CONSUL T ANT will prepare a punchlist of all items requiring modification. REASONS In February 2002 the City of Sunny Isles Beach commissioned O'Leary Design Associates, P.A. ("O'Leary") for professional services associated with signage and graphic design, inclusive of bid preparation. O'Leary prepared and the City issued RFP No. 03-04-01 Entranceway Signage in April 2003. Five responses were received and reviewed by a committee. The proposal from International Sign and Design Corp. was deemed the lowest most responsive, responsible bidder. (The committee deemed the lowest priced bid as non-responsive as they attached terms and conditions other than those stipulated in the bid form). As such, staff recommends the Entranceway Signage Bid be awarded to International Sign and Design Corp., and that we enter into the agreement for services attached hereto as Exhibit "A", in the amount of Seventy-Seven Thousand Fifty-Three Dollars ($77,053.00). ADDITIONAL INFORMATION Entranceway signage will convey to residents and visitors, especially, that they are entering the City of Sunny Isles Beach and make a positive statement and assist with our efforts to identify the City and foster community pride.
