RESOLUTION NO. 2003- SS-D
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING THE RELEASE OF A
DECLARATION OF USE FOR THE TANGIERS MOTEL, ATTACHED
HERETO AS EXHIBIT "A"; PROVIDING THE MAYOR TO EXECUTE
THE RELEASE AND AUTHORIZING THE CITY MANAGER TO DO
ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, a request has been made for the release of a Declaration of Use imposed
upon the Tangiers Motel situated at 18695 Collins Avenue, a/kIa 18683 Collins Avenue; and
WHEREAS, the Declaration of Use was recorded in the official records of Miami-Dade
as part of a prior zoning approval issued by Miami-Dade; and
WHEREAS, staff has reviewed the request and has no objection to the request.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Release of Declaration. The City Commission hereby releases the Declaration of
Use imposed upon the Tangiers Motel, which was recorded in the Official Records Book 13083
at Page 423-425, provided the Tangiers Motel is no longer in operation.
Section 2. Authority of Mayor. The City Commission hereby gives the Mayor the authority
to execute the release of the Declaration of Use and authorizing the City Manager to do all things
necessary to effectuate this Resolution.
Section 3.
Effective Date. This Resolution shall become effective upon adoption.

Re: Release of Declaration of Restrictions
RECOMMENDATION
The attached Resolution is presented to the City Commission for consideration
REASONS
The City Commission approved under Resolution99-Z-39 an apartment hotel on the property. The
owners of the property known as the Tangiers Motel is requesting this Commission to release a
Declaration of Restrictions approved by Miami Dade County relating to the prior apartment hotel
use. The owners will submit a new Declaration of Use and granting of Easements in connection
with the City approved plans. The property is no longer operational under the Miami Dade County
approval; in fact the building has been demolished. Therefore, there is no detrimental effect to a
release at this time in order to clear their tide of the declaration that were part of prior zoning
hearings.
