A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING THE RELEASE OF A
DECLARATION OF USE FOR PROPERTY LOCATED AT 17315
COLLINS AVENUE, ATTACHED HERETO AS EXHIBIT "A";
PROVIDING THE MAYOR WITH THE AUTHORITY TO EXECUTE
THE RELEASE AND AUTHORIZING THE CITY MANAGER TO DO
ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, a request has been made for the release of a Declaration of Use, imposed
upon the property situated at 17315 Collins Avenue, a/k/a Blue Seas Beach Club; and
WHEREAS, the Declaration of Use was recorded in Official Record Book 13351 at
Pages 160-167 in the official records of Miami-Dade County as part of a prior zoning approval;
and
WHEREAS, staff has reviewed the request and has no objection to the request.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Release of Declaration. The City Commission hereby releases the Declaration of
Use imposed upon the property situated at 17315 Collins Avenue, a/k/a Blue Seas Beach Club,
which was recorded in the Official Records Book 13351 at Pages 160-167 in the official records
of Miami-Dade County, which is no longer in operation.
Section 2. Authority of Mayor. The City Commission hereby gives the Mayor the authority
to execute the release of the Declaration of Use and authorizing the City Manager to do all things
necessary to effectuate this Resolution.
Section 3.
Effective Date. This Resolution shall become effective upon adoption.

RELEASE OF PRIOR DECLARATION OF USE
This Release of Prior Declaration of Use ("Release") is made as of this JOin day of
September, 2003, by Blue Seas Associates, a Florida general partnership ("Blue Seas") with an
address of 18305 Biscayne Boulevard, Suite 402, A ventura, Florida 33160, and the City of
Sunny Isles Beach, a Florida municipal corporation ("City"), with an address of 17070 Collins
Avenue, Suite 250, Sunny Isles Beach, FL 33160.
WIT N E SSE T H:
WHEREAS, in consideration of the issuance of a building permit on the property located
at 17315 Collins Avenue, Sunny Isles Beach, Miami-Dade County, Florida, legally described on
Exhibit "A" ("Property"), the County requested a Declaration of Use pertaining to the former
BLUE SEAS BEACH CLUB; and
WHEREAS, a predecessor in interest of the Property previously submitted to Miami-
Dade County a Declaration of Use recorded in Official Records Book 13351 at Page 160 of the
Public Records of Miami-Dade County ("Declaration"); and
WHEREAS, the above-referenced Declaration placed certain limitations on the use and

WHEREAS, paragraph 8 of the Declaration provides in pertinent part that the
"Declaration shall not be modified or revoked without prior approval of Metropolitan Dade
County after public hearing;" and
WHEREAS, the City incorporated in 1997 and the City Commission is the successor in
interest to the Metropolitan Dade County Board of County Commissioners by virtue of the City's
incorporation; and
WHEREAS, the predecessor owner of the Property filed a public hearing application
with a site plan for uses different from those set forth in the original Declaration; and
WHEREAS, on February 22,2001, the City Commission adopted Resolution No. 01-Z-
59 approving, among other requests, the new site plan and certain other non-use variances; and
WHEREAS, as part of the above resolution, the City Commission incorporated as
Condition 1 (c) that the use be established and maintained in accordance with the approved plans;
and
WHEREAS, the resolution also required that the Property be utilized as an
apartment/hotel; and
WHEREAS, on August 28, 2003, the City Commission adopted Resolution No. 2003-
583 (Exhibit B) specifically approving the release of the Declaration.
NOW THEREFORE, in consideration of the foregoing premises, the Declaration of Use
recorded in Official Records Book 13351 at Page 160 of the Public Records of Miami-Dade
County is moot as it relates to the Property, and is hereby released.

Re: Release of Declaration of Use
RECOMMENDATION
The attached Resolution is presented to the City Commission for consideration
REASONS
The City Commission approved under Resolution 01-Z-59 an apartment hotel on the property.
The owners of the property known as the Blue Seas Beach Club is requesting this Commission to
release a Declaration of Use approved by Miami Dade County relating to the prior apartment hotel
use. The owners have submitted a new Declaration of Use and granting of Easements in
connection with the City approved plans. The property is no longer operational under the Miami
Dade County approval;in fact the building has been demolished. Therefore, there is no detrimental
effect to a release at this time in order to clear their title of the declaration that were part of prior
zoning hearings.
