HomeMy WebLinkAboutReso 2003-595 RESOLUTION NO. 2003- 595 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A CONSIGNMENT AGREEMENT BETWEEN THE CITY OF SUNNY ISLES BEACH AND A TLANTIC BUS LEASING, INC., TO DISPOSE OF SHUTTLE BUS NO. 9910, A 22-PASSENGER EURO-LITE LEGACY SHUTTLE BUS, WITH THE CONDITION THAT ATLANTIC BUS SALES WILL PURCHASE THE BUS AFTER 150 DAYS IF NO OTHER OFFER IS MADE; AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION: PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach desires to dispose of Shuttle Bus No. 9910; and WHEREAS, Atlantic Bus Leasing, Inc., has submitted a Consignment Agreement to dispose of the bus on the condition that if no other offer is made after 150 days, then Atlantic Bus Leasing, Inc., will purchase the bus; and WHEREAS, the City of Sunny Isles Beach wishes to enter into the Consignment Agreement with Atlantic Bus Leasing, Inc. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Consignment Agreement. The City Commission hereby approves the Consignment Agreement between the City and Atlantic Bus Leasing, Inc., to dispose of Shuttle Bus No. 9910, on the condition that Atlantic Bus Leasing, Inc., will purchase the bus if no offer is made after 150 days. Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said Agreement. Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate the terms of this resolution. Section 4. Effective Date. This Resolution is effective upon adoption. Sale of Unit. Consignee agrees to pay 10% of profit above cost of vehicle to Consignor at time of sale of said above-mentioned unit to a customer of the Consignee. Consignor agrees to execute and transfer title to Consignee at time of sale. 3. Loss or Damage to Unit. The Consignor shall be responsible for all loss and expense resulting from fire, storm, theft, damage or destruction of the consigned unit while on the property of the Consignee and while on test drive for demonstration purposes. The Consignor shall be required to maintain fire, theft, property and personal negligence insurance on the unit until the consigned unit is sold by the Consignee to one of 1ts customers. The Consignee shall not be responsible for personal articles left in or on the consigned unit. The Consignor shall indemnify the Consignee against any loss or damage to the unit of the Consisnor. Consignor hereby authorizes Consignee, or customers of the Consignee, the right to drive said umt for purposes of demonstration. ,.. 4. Benefit. This Agreement shall be binding 'upon and inure to the benefit of the parties hereto and their respective successors and assigns. 5. Term. (305)947-2150 Building Department Richard DannBrown-Marina,isser, � ryAttorney or seta (305)947-5107 Fax C Clerk MEMORANDUM To: The Honorable City Commission From: Susan Simpson,Cultural&Human Services Directo ' Date: September 18,2003 Re: APPROVAL OF THE PURCHASE OF NEW SHUTTLE BUS RECOMMENDATION: It is recommended that the City Commission adopt the attached resolution approving the purchase of a new shuttle bus to replace shuttle bus # 9910,in the amount of Seventy Three Thousand, Three Hundred Twenty Eight Dollars ($73,328.00) from Atlantic Bus Sales,under State of Florida Government Contract No. FVPP-02-CA-3. REASONS: The City provides free community shuttle service to residents and visitors six days per week with 2 buses operating simultaneously. At present,the city owns 3 shuttle buses, one of which is antiquated and parts are hard to find requiring special made parts. As a result,it is out of service more often than not. Staff recommends the purchase of a new shuttle bus,designed to our specifications. This will ensure reliable service to our residents and a more enjoyable experience for Cultural Event participants. The proposed bus will seat 22 passengers plus 2 wheelchairs. It is equipped with a wheelchair lift to meet ADA regulations. ADDITIONAL INFORMATION: The city's allotment of the recently passed Miami-Dade County Transportation Surtax will fund the purchase of the bus. The city has received the first allotment of these funds in the amount of$151, 248.00 for the months of January through May.
