A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES
BEACH, FLORIDA, AMENDING RESOLUTION 2002-501 PROVIDING FOR THE
VACATION OF AN ALLEY RUNNING NORTH AND SOUTH FROM 185 STREET TO
191 STREET AS MORE FULLY DESCRIBED IN EXHIBIT "A"; PROVIDING FOR
THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City obtained jurisdiction over an alley designated as a utility easement
more specifically described in Exhibit "A" hereto pursuant to an Interlocal Agreement dated
November 4, 1997 by and between the City and Miami-Dade County; and
WHEREAS, pursuant to its home rule authority under Chapter 166, Florida Statutes and
the aforesaid Interlocal Agreement, the City has the authority to vacate, alter or discontinue any
public road over which it has jurisdiction; and
WHEREAS, the City Commission has determined that the alley described in Exhibit
"A" herein presently not used by the citizens or the City as a public right-of-way and the City is
proposing to vacate the alley; and
WHEREAS, the abutting property owners have agreed to honor all utility easements that
burden the alley prior to its abandonment by the City; and
WHEREAS, the City Commission has determined that the vacation of the alley will not
have an adverse impact on the citizens of the City of Sunny Isles Beach; and the vacation is in
the best interest ofthe public; and
WHEREAS, the City Commission has determined that the alley i s not being used by
abutting property owners for ingress and egress to their property.
WHEREAS, the City Commission, by Resolution 2002-501 adopted on December 10,
2002 attempted to vacate said alley with a map of the property to be vacated attached thereto as
but failed to attach a specific iegal description; and
WHEREAS, the City now wishes to attach such a legal description;

NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are true and correct and are incorporated
herein by reference as if they fully set forth herein,
Section 2, Conditions Required For Vacation and Granting of Easement. The City
Commission of the City of Sunny Isles Beach hereby agrees to vacate the aforementioned alley
mOTe specifically described in Exhibit "A" hereto on the following terms and conditions:
(1) The property owners agree to provide the City and utility companies with a perpetual
easement to use the alley for a public purpose; and
(2) The abutting property owners, in consideration of this Resolution and simultaneous
agreement, hereby agrees to defend and hold harmless the City of Sunny Isles Beach from any
all liability arising out of any incident or occurrence relating to the use of the vacated and
granting of easement of that portion; and
(3) The no structure shall be constructed on the alley, except for aluminum sheds and
non-structural slabs shall be permitted.
(4) In the event any structures exist within the easement area said structure should meet
the requirements set under the City's Land Development Regulations,
Section 3, Authoritv of Citv Attornev and Citv Manager The City Attorney and City
Manager are hereby authorized to do all things necessary to effectuate the vacation and the
reversion of the alley as described herein,

Section.4 Repealer The City Commission hereby repeals Resolution 2002-501 passed
and adopted on December 12th, 2002.
Section 5
Effective Date
This Resolution shall become effective upon adoption.

south from 185 h Street to 191 Street. That resolution had a map attached to it but no legal
description. We have now secured this legal description and wish to ministerially amend the
earlier resolution by including the same as Exhibit "A ".
