A RESOLUTION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA,
APPROVINGAMENDMENTNO.2TOCONTRACTBYANDBETWEEN
THE CITY OF SUNNY ISLES BEACH AND SPILLIS CANDELA &
PARTNERS, INC., FOR ADDITIONAL ARCHITECTURAL SERVICES
WITH RESPECT TO THE NEW GOVERNMENT CENTER FACILITY
LOCA TED AT 18070 COLLINS A VENUE, IN THE AMOUNT OF ONE
HUNDRED NINETY -ONE THOUSAND, NINE HUNDRED TWO DOLLARS
($191,902.00), A TT ACHED HERETO AS EXHIBIT "A"; PROVIDING FOR
EXECUTION BY THE MAYOR; AUTHORIZING THE CITY MANAGER
TO DO ALL THINGS NECESSARY TO EFFECTUA TE SAID
AMENDMENT; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, by Resolution No. 2002-413, dated January 17, 2002, the City Commission
approved an agreement between the City and Spillis Candela and Partners, Inc., for architectural
services with respect to the new Government Center facility located at 18050-18070 Collins Avenue,
and approved Amendment No.1 for Threshold Inspector and design of a grease trap system for Tony
Roma's Restaurant via Resolution No. 2003-539; and
WHEREAS, pursuant to Article 4, Section 4.13, the City requests additional architectural
services for the new Government Center Facility, which is not included in the basic services under
the Agreement; and
WHEREAS, Spillis Candela & Partners, Inc., have provided the City with a proposal, for the
additional architectural services described above, in the amount of $191,902.00, bringing the total
contract amount to $818,262.00, as set forth in Exhibit "A", attached hereto; and
WHEREAS, the City, being satisfied with the performance and quality of workmanship of
Spillis Candela & Partners, Inc., wishes to contract with Spillis Candela & Partners, Inc., to perform
this additional work.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Amendment No.2 to Contract: Amendment No.2 to Contract by and
between the City of Sunny Isles Beach and Spillis Candela & Partners, Inc., for additional
architectural services to be performed for the new Government Center facility located at 18070
Collins Avenue, on the terms and conditions as more fully set forth as Exhibit "A", hereto, be, and
the same is, hereby approved.

Section 2. Execution by Mayor: The Mayor is hereby authorized to execute the Agreement
between the City and Spillis Candela, for architectural services.
Section 3. Authorization of City Manager: The City Manager is hereby authorized to do all
things necessary to effectuate the terms of the Contract.
Section 4.
Effective Date. This Resolution shall become effective upon adoption.

AMENDMENT NO.2
TO CONTRACT BY AND BETWEEN
THE CITY OF SUNNY ISLES BEACH AND SPILLIS CANDELA & PARTNERS, INC.
DATED February 19, 2004
WHEREAS, SpilUs Candela & Partners, Inc., were hired by the City as Architect-Engineer to plan,
design, and provide construction administration for the new City Hall as identified by the contract
referenced above, which contract was approved by Resolution No. 2002-413; and
WHEREAS, pursuant to Article 4, Section 4.13, the City requests additional services as City Hall
Threshold Inspector and also the design of a grease trap system for the Tony Roma's Restaurant, not
heretofore included in the Basic Services under this contract; and
WHEREAS, Spillis Candela & Partners, Inc., have provided the City with a proposal, dated October 14,
2003, for the additional services described above, in the total amount of ONE HlJ"r-iDRED AND
NINETY-ONE THOUSAND NINE HUNDRED AND TWO DOLLARS, ($191,902.00); and
WHEREAS, the City, being satisfied with the performance and quality of workmanship of Spillis
Candela & Partners, Inc., wishes to contract with Spillis Candela & Partners, Inc., to perform this
additional work;
NOW THEREFORE, in accordance with the terms of Article 4 and Consultant's proposals in the total
amount of $191,902.00, and the City hereby amends the contract as follows:
1. The original contract amount is hereby increased by One Hundred and Ninety-One
Thousand Nine Hundred Two and No/lOO Dollars to Eight Hundred Eighteen Thousand
Two Hundred Sixty Two and No/I00 Dollars ($818,262.00).
2. All other terms and conditions of the contract remain the same.

Re: Additional AlE Fees Based on Increased Schedule, Increased Construction Cost and
Construction Administration Services Beyond Contractual Scope.
Dear Chris,
Thank you again for the opportunity to meet with Jorge Vera and Calvin, Giordano and Associates on
October 9th, in order to resolve the issue of additional professional fees and extended construction
administration efforts. As requested by Dennis Giordano during our meeting, following is a detailed
description of the reasons why the drawing schedule was lengthened beyond our contract scope, the
City-requested architectural elements and materials that resulted in the increased construction cost and the
sequences that will require our construction administration services to extend beyond the frequency and
duration of our contractual limits.
Spillis Candela DMJM is requesting additional professional fees for the Tony Roma's and City Hall
project. These fees, primarily incurred during the construction documents drawing effort, were the result of
numerous delays / revisions by Romacorp and City-requested enhanced site amenities, building amenities
and architectural materials for the City Hall and parking structure.The construction cost for the City Hall
and garage increased from approximately S10,000,000 to the GMP amount of approximately SI5,000,000
due to the addition of those amenities and materials. Following is a more detailed description of those
additions and changes to the original contractual scope:
Project Phasing:
· The Spillis Candela DMJM contract stipulated that the design and document preparation for Tony
Roma's and the City Hall were to be prepared concurrently. Combining the two projects was the
most efficient and cost effective way for the architectural and engineering team to produce the
drawings required for permit. Because of the need by Romacorp and the City to reduce to a
minimum the "downtime" of the restaurant, phasing required the Tony Roma's be completed and
occupied prior to the start of the City Hall construction. This required phasing, forced the drawing
effort for the two projects to be consecutive rather than concurrent and therefore creating a
significantly longer and more costly drawing schedule for SCDMIM. In addition, securing design
approval from Romacorp was long-delayed by their internal changes in consultants and even after
approval, was subject to their own reversals because this was a new prototype within the chain.
These events transfonned a simple 8-week drawing effort by SCDMJM, into a more than 24-week
drawing effort that impacted us financially.
Increased City Hall Square Footage:
..
· The gross building area for the City Hall increased from our contract scope of 45,000 sf to 60,000
sf in the approved design (a 33% growth in area) due to the program requirementsand space needs
desired by the City.
Open vs. Closed Parking Garage:
· The City requested that the parking structure be enclosed rather than open, resulting in increased
cost for the structure, architectural wall materials and mechanical ventilation.This change was
requested in order to visually hide the cars from view and better integrate the parking structure
with the City Hall building. This change occurred late in the design effort requiring Spillis
Candela DMJM to significantly modify the existing drawings and provide additional engineering
efforts in order to mechanically ventilate the garage. These additional services were never
invoiced to the City.
Building Amenities:
· Civic amenities such as the Council fountain, street paving, enhanced landscaping and enhanced
exterior lighting were requested by the City to be maintained in the approved design. These are
amenities that are traditionally associated with Civic Buildings and are commensurate with the
quality of the adjacent new Collins Avenue developments being designed and constructed in
Sunny Isles today. Value engineering efforts between the client. contractor and architect
established the potential cost savings for these items, but the City's decision was to increase the
construction budget and maintain these elements in the design.
Durable Architectural Materials - Life Cyc:Ie Cost Benefits:
· Enhanced and more durable building materials were requested by the City to be maintained in the
approved design; these included architectural precast concrete rather than stucco for the main
building envelope, granite panels rather than metal panel or stucco for the elevator / stair tower
and glass mosaic tile rather than stucco for the Council Chamber exterior. Although requiring a
greater up front cost, these materials will provide greater durability with lower maintenance costs
over the life of the building.Value engineering efforts between the client. contractor and architect
established the potential cost savings for these items but because of the issues mentioned above,
the City decided to increase the construction budget and maintain these elements in the design.
Our professional services contract, article 9 established the fee for architectural and engineering services.
The table below reflects the contract amounts, the amounts actually spent. the contract multiplier and the
overage incurred by SpiIIis Candela DMJM because of the above-described issues. The amount spent in
excess of our contract fee to prepare architectural and engineering documents (Schematic and Construction
Documents) for the City Hall and Tony Roma project is $191,902.
