A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING AMENDMENT NO.5
TO AGREEMENT BY AND BETWEEN THE CITY OF SUNNY ISLES
BEACH AND VILA & SON LANDSCAPING CORP., FOR ADDITIONAL
LANDSCAPING AND IRRIGATION SERVICES FOR COLLINS
A VENUE, IN AN AMOUNT OF ONE HUNDRED TWO THOUSAND,
SEVEN HUNDRED THIRTY-SEVEN DOLLARS ($102,737.00),
ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR
TO EXECUTE SAID AMENDMENT; AUTHORIZING THE CITY
MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE
TERMS OF AMENDMENT NO.5; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, by Resolution No. 2002-442, dated May 14, 2002, the City Commission
approved an agreement between the City and Vila & Son Landscaping Corp., for landscape
improvements for State Road A-I-A (Collins Avenue); and
WHEREAS, pursuant to Paragraph 2 - Additional Services, of the Base Contract, the
City requests additional landscaping and irrigation services for Collins Avenue, for which the
City has received a Proposal dated February 16, 2004, in the amount of $102,737.00; and
WHEREAS, the City is satisfied with the performance and quality of workmanship of
Vila & Son Landscaping Corp., to perform this additional work via Amendment No.5 to Vila's
landscaping contract.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Amendment No.5 to Agreement. Amendment No.5 to Agreement
by and between the City of Sunny Isles Beach and Vila & Son Landscaping Corp., for
landscaping and irrigation services for Collins Avenue, in an amount of $102,737.00, attached
hereto as Exhibit "A", be and the same, is hereby approved.
Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said
Amendment to Agreement.
Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate the terms of Amendment No.5 to Agreement.
Section 4.
Effective Date. This Resolution will become effective upon adoption.
PASSED AND ADOPTED this 18th day of March, 2004.

AMENDMENT NO.5
TO LANDSCAPING CONTRACT BY AND BETWEEN
CITY OF SUNNY ISLES BEACH AND VILA & SON LANDSCAPING CORP.
DATED MAY 29, 2002 (BASE CONTRACT)
FOR ADDITIONAL LANDSCAPING & IMPROVEMENTS
FOR COLLINS AVENUE
WHEREAS, the Vila & Son Landscaping Corp. was hired by the City to perform landscaping
and improvements under the referenced contract for landscaping and irrigation of Collins
A venue and other sites within the City as approved by Resolution No. 2002-442; and
WHEREAS, pursuant to Paragraph 2 - Additional Services, of the Base Contract, the City
requests additional landscaping services for Collins A venue, for which the City has received a
Proposal dated February 16,2004, in the amount of $102,737.00; and
WHEREAS, the City, being satisfied with the performance and quality of workmanship of Vila
& Son, wishes to contract with Vila & Son Landscaping Corp., to perform this additional work
via this Amendment No.5 to Vila's landscaping contract referenced above;
NOW THEREFORE, in accordance with Vila and Sons proposal, dated, February 16, 2004 and
attached hereto as Exhibit "A," in the amount of $102,737.00, the City hereby amends Vila &
Son Landscaping contract as follows:
I. Additional landscaping and irrigation service to be performed at Collins A venue, as
more particularly described in the attached Exhibit "A." Payments to be made upon
completion
2. The total price for this project only is One Hundred Two Thousand, Seven
Hundred Thirty-Seven and 0/100 Dollars ($102,737).
3. The Base Contract dated May 29, 2002 is hereby extended to end of completion of
this project.
4. All other terms and conditions of the Base Contract remain the same.
