RESOLUTION NO. 2004-.kBS
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AUTHORIZING THE TRANSFER OF
DEVELOPMENT RIGHTS ("TDRS") FROM 17200 COLLINS A VENUE
(THE "CASINO PROPERTY" ) IN THE AMOUNT OF 3.75 F.A.R. (566,737
SQUARE FEET) AND 80 DWELLING UNITS PER ACRE (277 DWELLING
UNITS) TO THE TDR BANK TO COMPLY WITH THE REQUIREMENTS
OF RESOLUTION NO. 2004-681; DIRECTING THE PLANNING AND
ZONING ADMINISTRATOR OR DESIGNEE TO TRANSFER THE TDRS IN
ACCORDANCE WITH RESOLUTION NO. 2004-681; PROVIDING THE
CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS
NECESSARY TO EFFECTUATE THIS RESOLUTION; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, 17200 Collins A venue, Ltd. has conveyed approximately 3.46 acres of real
property located at 17200 Collins A venue (the "Casino Property"), Sunny Isles Beach, Florida to the
City, and
WHEREAS, the City has agreed to transfer in accordance with its Land Development
Regulations a certain amount of TDRs to the account established in the TDR Bank for 17200 Collins
Avenue, Ltd.; and
WHEREAS, the City Commission wishes to comply with the requirements of Resolution
No. 2004-681.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Authorizine the Transfer. The City Commission hereby authorizes the transfer of
the development rights from 17200 Collins A veIllle (the "Casino Property") in the amount of 3.75
EA.R. (566,737 Square Feet) and 80 dwelling units per acre (277 Dwelling Units) to the TDR Bank
to comply with the requirements of Resolution No. 2004-681.
Section 2. Direction of the Plannine and Zonine Administrator. The Planning and Zoning
Administrator or designee is hereby directed to transfer the development rights from the Casino
Property to the TDR Bank.
Section 3. Authoritv of the City Manaeer. The City Manager is hereby authorized to do all
things necessary to effectuate this resolution.
Section 4.
Effective Date. This Resolution shall be effective upon adoption.
