A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING THE RELEASE OF
DECLARATION OF RESTRICTION FOR THE DESERT INN BEACH
CLUB, ATTACHED HERETO AS EXHIBIT "A"; PROVIDING THE
CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS
NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, a request has been made for the release of two declaration of restrictions
imposed upon the Desert Inn Beach Club situated at 17201 Collins Avenue; and
WHEREAS, the Desert Inn Beach Club is no longer operating as an apartment hotel; and
WHEREAS, the Declaration of Restrictions were recorded in the official records of
Miami-Dade as part of a prior zoning approval issued by Miami-Dade; and
WHEREAS, staff has reviewed the request and has no objection to the request.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Release of Agreements. The City Commission hereby releases the declaration of
restrictions imposed upon the Desert Inn Beach Club, which are recorded in the Official Records
Book 13310 at Page 756.
Section 2. Authority of City Manager .The City Commission hereby gives the City Manager
the authority to do all things necessary to effectuate this Resolution,
Section 3.
Effective Date, This Resolution shall become effective upon adoption,

DECLARATION OF USE
July 2, 1986
The following is a Declaration of Use, pursuant to Dade County
OrdinBnce 84-46 Bnd regulations Bdopted pursuant thereto. pertaining to
the' Desert Inn BeBch Club, locBted at 17201 Collins Avenue, North
MiBmi Beach, Dade County, FloridB, being more particularly described
in Exhibit "At! attached hereto:
1. The motel use shall continue to be maintained on the subdivided
property complete with front desk, executive offices and recrestional
Breas all of which Bre common to and necessary for motel operation.
2. A register, signed by guests who occupy units within the motel,
showing the date of arrivBI Bnd departure of guests in each room through-
out the yeat, shall be maintained at all times and made available for
inspection by the Director of Building and Zoning Department, Metropolitan
Dade County, at any time.
3. The rental of all units in the motel will be handled by an entity
who shBII collect all applicable taxes including sales and resort taxes
applicable to hotel and motel room r~ntals. On-site management will
.provide and supervise room service, maid service, and daily linen service
for all rooms that request it. Room rates will be reasonable to the
market.
4. All units in the hotel or motel shall be offered for rent to the
public.at all reasonable times except when occupied by the owner or
lessee.
.5. Not more than 5% of the units in the hotel or mo!:el shall be
occupied by the owner or any other person for more than 6 months in any
one year Bnd any units permitted to be occupied for more tharr~months in
Bny one year shall be specificBlly identified. Occupancy for more than 6
months ShBIl not be allowed in Bny other unit.

6. Rental rates shall be posted as required by Florida Statutes.
7. Each buyer shall be required to ~xecute a statement at the time
of contract acknowledging notice of the Declaration of Use and agreeing to
comply therewith. The Declaration shall advise that the Code of
the property for other than motel use.
Metropolitan Dade County. Florida, provides penalties for utilization of
8. This Declaration shall not be modified or revoked without prior
approval of Metropolitan Dade County after public hearing. Upon any
violation of the Declaration. the Director of Building and Zoning
Department, Metropolitan Dade County. may take ~forcement action,
including the revocation Of any approvals or permits.

Re: Release of Declaration of Restrictions relating to the prior apartment hotel use on the
Desert Inn Hotel and Beach Club property.
RECOMMENDATION
The attached resolution is presented to the City Commission for consideration
REASONS
The owners of the property known as the Desert Inn Hotel and Beach Club are requesting this
Commission to release the Declaration of Restrictions approved by Miami Dade County relating to
the prior apartment hotel use on the property. The property is no longer operational under the
Miami Dade County approval; in fact the building is demolished. Therefore, there is no detrimental
effect to a release at this time in order for the owner to clear title on the property. The new
development will require the property owners to submit a new Declaration of Use and the granting
of beach access and landscape easements in connection with the new approved plans.
