A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, CONFIRMING THE
DECLARATION OF LOCAL EMERGENCY AS IMPOSED BY THE
CITY MANAGER DUE TO HURRICANE FRANCES, AND
CONFIRMING THE TERMINATION OF THE STATE OF A LOCAL
EMERGENCY; AUTHORIZING THE CITY MANAGER TO DO ALL
THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on Thursday, September 2,2004, the Mayor of Miami-Dade County issued
a mandatory evacuation order due to the approaching storm, Hurricane Frances; and
WHEREAS, the City of Sunny Isles Beach faced dangerous conditions of sufficient
severity and magnitude to warrant coordinated local government action to prevent or alleviate the
damage, loss, hardship or suffering threatened or caused thereby; and
WHEREAS, Hurricane Frances caused a condition of extreme peril of life and property
necessitating the proclamation of the existence of an emergency and in accordance with
Ordinance No. 2002-163 of the Code of Sunny Isles Beach, the City Manager declared a local
emergency due to Hurricane Frances; and
WHEREAS, on Monday, September 6,2004, the Mayor of Miami-Dade County lifted
the evacuation order, and the City Manager of Sunny Isles Beach terminated the State of a Local
Emergency.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Confirmation of the Declaration of a Local Emergency, The Declaration of a
Local Emergency imposed by the City Manager, attached hereto as Exhibit "A", is hereby
confirmed by the City Commission of the City of Sunny Isles Beach, Florida, on September 2,
2004.
Section 2, Confirmation of the Termination of the State of Local Emergency, The City
Commission hereby confirms the termination of the State of Local Emergency on September 6,
2004, attached hereto as Exhibit "B", provided however this confirmation of termination shall not
be construed as a limitation on the City Manager's authority to declare a state of emergency at
any date subsequent to this resolution.
Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate the terms of this resolution.
Section 4.
Effective Date. This Resolution will become effective upon adoption.
PASSED AND ADOPTED this 9th day of September, 2004.

R2004- Confirmation of Declaration of a Local Emergency 2
DECLARATION OF A LOCAL EMERGENCY
CITY OF SUNNY ISLES BEACH, FLORIDA
WHEREAS, in accordance with Ordinance 2002-163 of the Code of The City of Sunny
Isles Beach, the City Manager of Sunny Isles Beach does hereby find that:
1. Due to Hurricane Frances, the Mayor of Miami-Dade County has issued a
mandatory evacuation order, and the City of Sunny Isles Beach is facing dangerous conditions of
sufficient severity and magnitude to warrant coordinated local government action to prevent or
alleviate the damage, loss, hardship or suffering threatened or caused thereby;
2. Due to Hurricane Frances, a condition of extreme peril of life and property
necessitates the proclamation of the existence of an emergency;
NOW, THEREFORE, IT IS HEREBY RESOLVED that an emergency now exists
throughout the City of Sunny Isles Beach;
IT IS FURTHER RESOLVED that during the existence of said emergency the powers,
functions, and duties of the Director of Emergency Management of the City of Sunny Isles Beach
be those prescribed by State law and the ordinances, resolutions, and approved plans of the City
of Sunny Isles Beach in order to mitigate the effects of said emergency.

TERMINATION OF A LOCAL EMERGENCY
CITY OF SUNNY ISLES BEACH, FLORIDA
WHEREAS, in accordance with Ordinance 2002-163, the City Manager of Sunny
Isles Beach does hereby find that:
Due to the passing of Hurricane Frances and the rescinding of the Evacuation
Order by the County Mayor on Monday, September 6th, 2004, the City of Sunny Isles
Beach is no longer facing dangerous conditions of sufficient severity and magnitude to
warrant coordinated local government action to prevent or alleviate the damage, loss,
hardship or suffering threatened or caused thereby;
NOW, THEREFORE, IT IS HEREBY RESOLVED that the State of Local
Emergency declared by the City Manager on Thursday, September 2nd, 2004 is
terminated as of Monday, September 6th, 2004.
