A RESOLUTION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA,
APPROVING AMENDMENT NO.3 TO CONTRACT BY AND BETWEEN
THE CITY OF SUNNY ISLES BEACH AND SPILLIS CANDELA &
PARTNERS, INC., FOR ADDITIONAL ARCHITECTURAL AND
CONSTRUCTION ADMINISTRATION AND THRESHOLD INSPECTOR
SERVICES WITH RESPECT TO THE NEW GOVERNMENT CENTER
FACILITY LOCATED AT 18070 COLLINS AVENUE, IN THE AMOUNT OF
ONE HUNDRED FIFTY-NINE THOUSAND FIVE HUNDRED THIRTY
DOLLARS AND NINETEEN CENTS ($159,530.19), ATTACHED HERETO
AS EXHIBIT "A"; PROVIDING FOR EXECUTION BY THE MAYOR;
AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY
TO EFFECTUATE SAID AMENDMENT; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, by Resolution No. 2002-413, dated January 17, 2002, the City Commission
approved an agreement between the City and Spillis Candela and Partners, Inc., for architectural
services with respect to the new Government Center facility located at 18050-18070 Collins Avenue,
and approved Amendment No.1 for Threshold Inspector and design of a grease trap system for Tony
Roma's Restaurant via Resolution No. 2003-539 and in February 19,2004, and approved
Amendment 2 under Resolution No. 2004-642 for additional architectural services; and
WHEREAS, pursuant to Article 4, Section 4.13 of the agreement between the City and
Spillis Candela and Partners, Inc., the City requests additional architectural, construction
administration and threshold inspection services for the new Government Center Facility, which is
not included in the basic services provision on the Agreement; and
WHEREAS, Spillis Candela & Partners, Inc., have provided the City with a proposal, for the
additional architectural services described above, in the amount of $159,530.19, bringing the total
contract amount to $977,792.19, as set forth in Exhibit "A", attached hereto; and
WHEREAS, the City, being satisfied with the performance and quality of workmanship of
Spillis Candela & Partners, Inc., wishes to contract with Spillis Candela & Partners, Inc., to perform
this additional work.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section1. Approval of Amendment No.3 to Contract: Amendment No.3 to Contract by and
between the City of Sunny Isles Beach and Spillis Candela & Partners, Inc., for additional
architectural, construction administration and threshold inspection services to be performed for the

For new Government Center
new Government Center facility located at 18070 Collins Avenue, on the terms and conditions as
more fully set forth as Exhibit "A", hereto, be, and the same is, hereby approved.
Section 2. Execution by Mayor: The Mayor is hereby authorized to execute the Agreement
between the City and Spillis Candela, for architectural services.
Section 3. Authorization of City Manager: The City Manager is hereby authorized to do all
things necessary to effectuate the terms of the Contract.
Section 4.
Effective Date. This Resolution shall become effective upon adoption.

ADDENDUM NO.3 TO SPILLIS. CANDELLA & PARTNERS INC. CONTRACT
THIS ADDENDUM, EXECUTED THIS \ ~~ DAY OF --.N o{emb~ , 2004,
shall be an integral part of the service agreement. In the event that any terms or conditions contained
herein conflict with the basic agreement, the terms and conditions of this addendum shall prevail.
1. The amended price for these services is ONE HUNDRED FIFTY-NINE THOUSAND FIVE
HUNDRED THIRTY DOLLARS, AND 19/100 DOLLARS ($159,530.19), payable as invoiced
and reflected in Exhibit "A".
IN WITNESS WHEREOF, the parties hereto have executed this document as of the date mentioned
above.

MEMORANDUM

Re: Additional Architectural,Threshold Services
RECOMMENDATION
It is recommended that the City Commission considers the attached resolution authorizing an amendment
to the contact between the City of Sunny Isles Beach and Spillis Candela & Partners, Inc. with respect to
the new Government Center facility located at 18070 Collins Avenue.
REASONS
The City of Sunny Isles Beach entered into a contract with the architectural firm of Spillis Candela &
Partners, Inc. for the design of the proposed City Hall building as well as the Tony Roma's restaurant,
however the scope of the contract for the City Hall changed substantially from the originally
contemplated contract scope. Due to the complexity and the coordination with the Tony Romas
architects, Spillis Candela & Partners spent more time for the construction administration services on the
Tony Romas that they had originally estimated. Therefore, the construction administration amount
allocated for the City Hall project was reduced drastically. Additionally, due to the complexity of the
design for the City Hall, the threshold inspector that was performing the structural inspections has been
on the job doing more inspections than originally estimated.
Spillis Candela & Partners has submitted to the City the amount of the invoices currently owed by the
City for the construction administration and the threshold inspector services. Additionally, they have
submitted the anticipated cost for the remainder of the project.
