RESOLUTION NO. 2005-'1 ~
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, CORRECTING SCRIVENER'S
ERRORS ON LEGAL DESCRIPTION FOR RESOLUTIONS NO.'S
2005-754, 2005-755, AND 2005-756, ATTACHED HERETO AS
EXHIBIT "A"; AUTHORIZING THE CITY MANAGER AND CITY
ATTORNEY TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on January 13, 2005 the City Commission adopted Resolution No. 2005-
754, accepting the conveyance of approximately 2.417 acres of real property owned by Porto
Bellagio Partners, LLC, Resolution No. 2005-755 authorizing the Transfer of Development
Rights, and Resolution No. 2005-756 approving the release of a Unity Title imposed upon the
property situated at 17100 North Bay Road, aIkIa Porto Bellagio; and
WHEREAS, Exhibit "A" in Resolutions 2005-754 and 2005-755, and Exhibit "1" in
Resolution No. 2005-756 contained scrivener's errors in the legal description.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Correction of Scrivener's Errors. The City Commission hereby accepts the
corrected Exhibit "A" and directs the City Clerk to replace the exhibits in Resolutions No.'s
2005-754,2005-755, and 2005-756 with corrected Exhibit "A".
Section 2. Authority of City Manager and City Attorney. The City Commission hereby
authorizes the City Manager and City Attorney to do all things necessary to effectuate this
Resolution.
Section 3.
Effective Date. This Resolution shall become effective upon adoption.
PASSED AND ADOPTED this 10th day of March, 2005.

Re: Resolution Correcting Scrivener's Errors on Legal Description
RECOMMENDATION:
It is recommended that the City Commission adopt the attached Resolution.
REASONS:
On January 13, 2005 the City Commission adopted Resolution No. 2005-754, accepting the
conveyance of approximately 2.417 acres of real property owned by Porto Bellagio Partners,
LLC; Resolution No. 2005-755 authorizing the Transfer of Development Rights; and Resolution
No. 2005-756 approving the release of a Unity Title imposed upon the property situated at 17100
North Bay Road, a/k/a Porto Bellagio. Exhibit "A" in Resolutions 2005-754 and 2005-755, and
Exhibit "1" in Resolution No. 2005-756 contained scrivener's errors in the legal description, and
this Resolution corrects that.
