A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING AN
ADDENDUM TO THE AGREEMENT WITH B.K. MARINE
CONSTRUCTION, INC., FOR SEAWALL REPLACEMENT
AND RESTORATION FOR THE 183RD STREET SEAWALL,
ATLANTIC AVENUE SEAWALL RESTORATION, AND
ATLANTIC AVENUE BRIDGE REVETMENT
RESTORATION, IN AN AMOUNT OF FORTY-TWO
THOUSAND TWO HUNDRED FORTY-FIVE DOLLARS
($42,245.00), ATTACHED HERETO AS EXHIBIT "A";
AUTHORIZING THE MAYOR TO EXECUTE SAID
AGREEMENT; AUTHORIZING THE CITY MANAGER TO
DO ALL THINGS NECESSARY TO EFFECTUATE THE
TERMS OF THE AGREEMENT; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City issued Bid No. 04-01-01 for seawall replacement and restoration for
183 rd Street seawall replacement, Atlantic Avenue Seawall Restoration, and Atlantic A venue Bridge
Revetment Restoration; and
WHEREAS, B.K. Marine Construction, Inc., a qualified General Contractor, was the sole
respondent to said Bid; and
WHEREAS, on April 15, 2004, the City awarded said bid to B.K. Marine Construction, Inc.,
entering into an agreement for seawall replacements and bridge revetment restoration services; and
WHEREAS, upon commencement of the seawall repairs the contractor discovered that the
reasons for the collapsing was due to storm water; and
WHEREAS, B.K. Marine has submitted a proposal to fix this problem by correcting the
existing exfiltration drainage system, in the amount of Forty-two Thousand Two Hundred Forty-Five
Dollars, attached hereto as Exhibit "A".
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Addendum. The Addendum to the Agreement by and between the City
of Sunny Isles Beach and B.K. Marine Construction, Inc. for seawall replacements and bridge
revetment restoration services, in the amount of Forty-Two Thousand Two Hundred Forty-Five
Dollars ($42,245.00), attached hereto as Exhibit "A", be, and the same, is hereby approved.
Section 2.
Authorization of Mayor. The Mayor is hereby authorized to execute said Agreement.

Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate the terms of the Agreement.
Section 4.
Effective Date. This Resolution will become effective upon adoption.
PASSED AND ADOPTED this 10th day of March 2005.

ADDENDUM TO B.K. MARINE CONSTRUCTION. INC. AGREEMENT
THIS ADDENDUM, EXECUTED THIS ~ -z.. -vc.... DAY OF A ~ R \ L ,2005,
by and between B.K. Marine Construction, Inc., a Florida corporation ("Contractor"), and the City of
Sunny Isles Beach, a Florida municipal corporation ("Owner") shall be an integral part of the service
agreement. In the event that any terms or conditions contained herein conflict with the basic agreement,
the terms and conditions of this addendum shall prevail.
1. AMENDED PRICE. The amended price for these services is FORTY-TWO THOUSAND,
TWO HUNDRED FORTY-FIVE DOLLARS, AND 01/100 DOLLARS ($42,245.00), payable
as invoiced.
2. OTHER SERVICES TO BE PERFORMED The Contractor agrees to correct existing
infiltration drainage system according to plans.
IN WITNESS WHEREOF, the parties hereto have executed this document as of the date mentioned
above.
