HomeMy WebLinkAboutReso 2005-789 RESOLUTION NO. 2005-1e9 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CREATION OF A BLUE - RIBBON COMMITTEE FOR THE RECOMMENDATION OF CANDIDATES FOR THE POSITION OF CITY ATTORNEY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Attorney has tendered her resignation and has agreed to assist in finding a successor for her position. WHEREAS, the City Attorney, City Manager, and the Mayor have discussed the matter. The Mayor is recommending a process to be authorized by this Commission. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Creation of Blue-Ribbon Search Committee. The City Commission hereby authorizes the appointment of a blue - ribbon search committee to recommend candidates for the position of City Attorney to consist of three City Attorneys, the City Manager, and two business persons from the community, to be recommended jointly by the City Manager, City Attorney, and the Mayor. Section 2. Ratify Names of Committee Members. That the recommended names of the proposed committee members be formally ratified by the City Commission. Section 3. Effective Date. Anticipated Hiring Range: $5,385/Bi-wkly -- $6,923/Bi-wkly, DOQ DEFINITION: The City Attorney serves as chief legal advisor to the Mayor, City Commission, and City Manager and is responsible for the legal affairs of the City; directs, prosecutes and defends all litigation to which the City is a party; drafts and implements ordinances or resolutions; provides legal advice and direction on contract law, labor and employee relations, intergovernmental/interagency and private industry relations, and land use development; and directs Office of the City Attorney staff and outside counsel. In consultation with elected officials and chief administrative officer, the City Attorney determines and carries out legal strategies to further the mission and goals of the City. EDUCATION & EXPERIENCE MINIMUM QUALIFICATIONS The ideal candidate will have the following knowledge, skills, and abilities: Requires J.D.I L.L.B. Ten (10) or more years practicing law strongly desired. Must be a member in good standing with the Florida State Bar. A Florida License is required and certification in local government law is desired. Strong knowledge of law relating to municipalities required. Prosecution knowledge and experience in search and seizure issues, forfeiture and police matters required. Litigation, real estate transactional work, and experience in land use and zoning is required. Ability to represent the interest of one party in working with other stakeholders and opposing parties required. Ability to develop productive relationships with elected officials, staff, commissions, multi-government entities, private companies, news media and utilities desired. Dannheisser,City Attorney DATE: April 14, 2005 RE: Creation of a Blue-Ribbon Committee to Search for a City Attorney Recommendation: It is recommended that the City Commission approve the attached Resolution. Reasons: The law does not dictate that a search be conducted in any particular way except to abide by the Sunshine Laws. If a search firm is not retained, then it is good custom and practice that the City create a blue-ribbon selection committee usually composed of the manager and other qualified City Attorneys (hereinafter referred to as the `Committee".) After consultation with the Mayor and City Manager, the following process is recommended to you: The Mayor is suggesting that the selection committee be composed of three City Attorneys, the City Manager, and a business person from the community. The City Manager and I, in consultation with the Mayor, will select the most qualified members. This will involved not only the best qualification but also availability (and willingness) to work within our time frame. The Mayor has also requested that I be available for consultation which I will. The process will then be that an advertisement for the position be placed and/or posted. (This has already been created by Tom and I and a copy of that advertisement is attached for convenient reference.) Second, all qualified applicants will submit their resumes to the HR Department. The resumes will be reviewed and the applicants that meet the minimal qualifications will be passed along by our Human Resources Director to Committee. Qualified applicants will then be reviewed and interviewed by the Committee. The Committee will decide their own process but ultimately will select and rank the most qualified applicants to be recommended to the City Commission. The Honorable City Commission April 7, 2005 Page 2 Finally, the recommended applicants will then be interviewed by you as a whole and also individually,one on one, so you can make a final decision. Once the Committee is constituted, I will be able to give you a more accurate time frame for this process but it is anticipated that it should be concluded by mid-summer. LMD:jb
