RESOLUTION NO. 2005 - <641'3
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, RATIFYING THE "DECLARATION
OF A LOCAL EMERGENCY" IMPOSED BY THE INTERIM CITY
MANAGER ON OCTOBER 23, 2005 AND THE "TERMINATION OF A
LOCAL EMERGENCY" ISSUED ON NOVEMBER 1, 2005 DUE TO
HURRICANE WILMA; AUTHORIZING THE CITY MANAGER TO DO
ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach faced dangerous conditions of sufficient
severity and magnitude to warrant coordinated local government action to prevent or alleviate the
damage, loss, hardship or suffering threatened or caused thereby; and
WHEREAS, the Mayor of Miami-Dade County declared a State of Emergency for all of
Miami-Dade County due to the threat of impending Hurricane Wilma; and
WHEREAS, Hurricane Wilma caused a condition of extreme peril of life and property
necessitating the proclamation of the existence of an emergency and in accordance with
Ordinance No. 2002-163 of the City of Sunny Isles Beach, the Interim City Manager declared a
local emergency due to Hurricane Wilma; and
WHEREAS, the Mayor of Miami-Dade County has since lifted the State of Emergency
for Miami-Dade County; and
WHEREAS, the emergency dangers and threats of Hurricane Wilma have passed the \
Interim City Manager of the City of Sunny Isles Beach has terminated the State of a Local
Emergency.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Confirmation of Declaration of a Local Emergency. The City Commission of the
City of Sunny Isles Beach hereby ratifies the "Declaration of a Local Emergency" imposed by the
City Manager on October 23,2005, attached hereto as Exhibit "A".
Section 2. Confirmation of Termination of the State of Local Emergency. The City
Commission of the City of Sunny Isles Beach hereby ratifies the "Termination of a Local
Emergency" issued by the City Manager on November 1, 2005, attached hereto as Exhibit "B",
provided however this confirmation of termination shall not be construed as a limitation on the
City Manager's authority to declare a state of emergency at any date subsequent to this
resolution.
Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate the terms of this resolution.

Effective Date. This Resolution will become effective upon adoption.

DECLARATION OF A LOCAL EMERGENCY
CITY OF SUNNY ISLES BEACH, FLORIDA
WHEREAS, in accordance with Ordinance 2002-163 of the Code of The City of Sunny Isles Beach, the
Acting City Manager of Sunny Isles Beach does hereby find that:
I. Due to Hurricane Wilma, the City of Sunny Isles Beach is facing dangerous conditions of
sufficient severity and magnitude to warrant coordinated local government action to prevent or alleviate the damage,
loss, hardship or suffering threatened or caused thereby;
2. Due to Hurricane Wilma, a condition of extreme peril of life and property necessitates the
proclamation of the existence of an emergency;
NOW, THEREFORE, IT IS HEREBY RESOLVED that an emergency now exists throughout the City of
Sunny Isles Beach;
IT IS FURTHER RESOLVED that during the existence of said emergency the powers, functions, and
duties of the Director of Emergency Management of the City of Sunny Isles Beach be those prescribed by State law
and the ordinances, resolutions, and approved plans of the City of Sunny Isles Beach in order to mitigate the effects
of said emergency.

WHEREAS, in accordance with Ordinance 2002-163, the Acting City Manager of
Sunny Isles Beach does hereby find that:
Due to the passing of Hurricane Wilma, the City of Sunny Isles Beach is no longer
facing dangerous conditions of sufficient severity and magnitude to warrant coordinated
local government action to prevent or alleviate the damage, loss, hardship or suffering
threatened or caused thereby;
NOW, THEREFORE, IT IS HEREBY RESOLVED that the State of Local
