A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE PURCHASE OF TWO (2) NEW COMMUNITY SHUTTLE BUSES FROM ATLANTIC BUS SALES, IN A TOTAL AMOUNT OF ONE HUNDRED FIFTY -NINE THOUSAND THREE HUNDRED EIGHTY DOLLARS ($159,380.00), PIGGY-BACKING BROWARD COUNTY MASS TRANSIT CONTRACT BID NO. C8-04- 173-FFj AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach ("City") desires to replace and upgrade two (2) of the existing shuttle buses for the benefit and welfare of its citizens, visitors, and employees; and WHEREAS, the City wishes to purchase two (2) shuttle buses from Atlantic Bus Sales, piggy-backing Broward County Mass Transit Contract Bid No. C8-04-1 73-FF; and WHEREAS, Atlantic Bus Sales has agreed to extend said pricing, terms, and conditions to the City and has submitted a quote of $79,690.00 for each bus, for a total purchase amount of One Hundred Fifty-Nine Thousand Three Hundred Eighty Dollars ($159,380.00); and WHEREAS, funding for the purchase of these two (2) buses will be provided by the Miami-Dade County People's TranspOliation Plan 1i% Surtax. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Authorization of Purchase. The City Commission hereby authorizes the purchase of two (2) shuttle buses from Atlantic Bus Sales, in a total amount of One Hundred Fifty-Nine Thousand Tlu'ee Hundred Eighty Dollars ($159,380.00), piggy-backing Broward County Mass Transit Contract Bid No. C8-04- I 73-FF, with a June 1, 2006 delivery date and that the color of the buses will be submitted in 30-days. Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Effective Date. (e) CANCELLATION FOR CONVENIENCE: The County reserves the right. at its option. to cancel this contracl for any or no cause, lor County convenience. by giving thirty (30) days prior written notice to the vendor/ contractor, at the end 01 which time this contract will automatically expire without the necessity of any fur- ther action. ASSIGNMENT, SUBCONTRACT: Contractor shall not transfer, convey, pledge. subcontract or assign the perior- mance required by Ihis bid without the prior written consent of the Purchasing Director. The County is particularly interested in the type of recycled material used (such as paper, plastic, glass, metal, etc.); and the percent- age of recyded material contained in the product. The Commision changed the delivery date to June 1, 2006 and added a stipulation that the color of the buses will be submitted in 30 days. Attached are the two (2) original agreements, which need to be executed by Atlantic Bus Sales, and a copy of the approving resolution. Please have the vendor sign the agreements and return one executed, original agreement to my attention.
