Home My WebLink AboutReso 2006-936 RESOLUTION NO. 2006 - 9 3 ~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING AN ADDENDUM TO THE PARKS/MEDIANS/RIGHTS-OF- WAY LANDSCAPE MAINTENANCE SERVICES AGREEMENT (BASE AGREEMENT) WITH LUKE'S LANDSCAPING, INC., IN AN AMOUNT NOT TO EXCEED FORTY-FIVE THOUSAND DOLLARS ($45,000.00), ATTACHED HERETO AS EXHIBIT "A", FOR ADDITIONAL SEASONAL PLANTINGS IN THE MEDIANS, CITY ENTRYW A YS, AND SAMSON OCEANFRONT PARK; AUTHORIZING THE MA YOR TO EXECUTE SAID ADDENDUM; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach is desirous of continuing its beautification program by incorporating seasonal plantings in the medians, City entryways, and Samson Oceanfront Park; and WHEREAS, on November 13,2001, the City Commission adopted Resolution No. 2001- 390 awarding Sunny Isles Beach Bid No. 01-09-01 to and entering into an agreement with Luke's Landscaping, Inc. ("Luke's"), for landscaping and maintenance of the City's parks, medians, and rights-of-way; and WHEREAS, the City is pleased with Luke's performance and wishes to continue its professional relationship with Luke's to maintain, advise, and assist with the City's landscaping and beautification; and WHEREAS, the City now wants to amend the Parks/Medians/Rights-of- Way Landscape Maintenance Services Agreement (Base Agreement) to include additional seasonal planting areas to be maintained; and WHEREAS, Luke's has submitted a proposal for the additional services, in an amount not to exceed Forty-Five Thousand Dollars, attached hereto as Exhibit "A"; WHEREAS, the additional professional services shall be in accordance with the terms and conditions of the Parks/Medians/Rights-of- Way Landscape Maintenance Services Agreement (Base Agreement) with Luke's, dated November 13,2001. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Amendment of Agreement. The Addendum to the Parks/Medians/Rights-of- Way Landscape Maintenance Services Agreement (Base Agreement) with Luke's Landscaping, Inc., for additional seasonal plantings in the medians, City entryways, R2006- Luke's Landscaping Amendment Page I 01'2 and Samson Oceanfront Park, in an amount not to exceed Forty-Five Thousand Dollars ($45,000.00), attached hereto as Exhibit "A", be and the same, is hereby approved. Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said Addendum. Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate the terms of this Resolution. Section 4. Effective Date. This Resolution will become effective upon adoption. THIS ADDENDUM, EXECUTED THIS \~ DAY OF :::IUA€.- , 2006, shall be an integral part of the Parks/Medians/Rights-of- Way Landscape Maintenance Services Agreement, between the City of Sunny Isles Beach and Luke's Landscaping Inc., dated November 13, 200 I. In the event that any terms or conditions contained herein conflict with the basic agreement, the terms and conditions of this addendum shall prevail.
