HomeMy WebLinkAboutReso 2006-904 RESOLUTION NO. 2006-.M A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE PAYMENT OF ELEVEN THOUSAND DOLLARS ($11,000.00) TO TOWBOA TU.S. NORTH MIAMI/ACTION MARINE TOWING & SALVAGE, INC., FOR REMOV AL AND DISPOSAL OF A DISABLED VESSEL IN THE WATERWAY; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach ("City") desires to remove and dispose of a forty-three foot (43') disabled vessel in the waterway between Oceania IV and the Atlantic Isles residential area for the benefit and welfare of its citizens, visitors, and employees; and WHEREAS, TowBoatU.S. NOlih Miami/Action Marine Towing & Salvage, Inc., has agreed to do this service and has submitted a quote of Eleven Thousand Dollars ($11,000.00) as a flat rate to remove and dispose of the disabled vessel; and WHEREAS, the City desires to have TowBoatU.S. North Miami/Action Marine Towing & Salvage, Inc. to proceed with the removal and disposal of said vessel. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Authorization of Payment. The City Commission hereby authorizes the payment of Eleven Thousand Dollars ($11,000.00) as a flat rate to TowBoatU.S. NOlih Miami/Action Marine Towing & Salvage, Inc., for removal and disposal of a 43-foot disabled vessel in the waterway. Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Effective Date. A crane and a barge will be used to load the vessel onto the barge and then the vessel will be transported on the barge to a location and placed in dumpsters for disposal. The area will be protected from pollutants with our standby oil spill response team and vessels. The scope of work will include all personnel, labor and equipment to safely remove and dispose of the vessel; and any and all debris and pollutants. The cost of the aforementioned services will be billed at a total of$11,000. Payment is due upon completion of project. Upon official notice to proceed with the removal and disposal of the vessel the work will commence to begin five days from receipt of the official notice. Solera, Code Enforcement and Licensing Director March 16,2006 Resolution for Boat Removal RECOMMENDATION: It is recommended that the City Commission approve the attached Resolution relating to the acquisition of funds for the removal of a disabled vessel located in the waterway between Oceania IV and the Atlantic Isles residential area. REASON (5): The Code Enforcement and Licensing Department in an effort to protect the health and welfare of residents is requesting the approval of the commission, for funds in the amount of $11,000.00. These funds will be used to pay Tow BoatUS of North Miami, for services related to the removal of a vessel located in the public waterway adjacent to Oceania IV (see attached estimate and pictures). This vessel has remained in the current location since Hurricane Wilma, and the owner of the vessel has been notified via certified mail, but has not corrected the issue. The Department requested proposals from the above mentioned company as well as from Liberty Maritime, Inc. and US Actions. Two companies responded and the estimates are attached. This resolution and work that will be performed by Tow BoatUS of North Miami will remedy the nuisance and eliminate the impact to the adjacent property owners.
