A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CITY
MANAGER TO PREPARE PLANS AND SPECIFICATIONS SHOWING
THE IMPROVEMENT, LOCATION AND ESTIMATE OF COSTS FOR
CERTAIN CAPITAL IMPROVEMENTS RELATED TO A SPECIAL
ASSESSMENT FOR ATLANTIC AVENUE, COMMONLY KNOWN AS
ATLANTIC ISLE RESIDENTIAL AREA; AUTHORIZING THE CITY
MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE
TERMS OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City Commission of Sunny Isles Beach has received a petition from a
majority of property owners who reside on Atlantic Avenue, commonly known as Atlantic Isle
residential area, requesting certain public improvements: sanitary sewer installation, drainage and
roadway improvements; and
WHEREAS, it appears that part of the cost of the above referenced public improvement
shall be defrayed by Special Assessment; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Authoritv of Citv Manager, The City Commission hereby gives the City Manager
the authority to prepare plans and specifications showing the improvements, location, and an
estimate of cost thereof, including maps and plans of the work for the Atlantic Isle residential
area, The City Manager is hereby authorized to do all things necessary to effectuate the terms of
this Resolution, Upon completion of this work, the matter will be presented to the City
Commission, who will then schedule a public hearing on this matter,
Section 2,
Effective Date. This Resolution will become effective upon adoption,
PASSED AND ADOPTED this 14th day of December 2006.

Petition
A petition was submitted to the City providing a majority of the residents in the Atlantic Isles
subdivision approving infrastructure improvements consisting of sanitary sewer installation,
pavement restoration, resurfacing and drainage.
We have reviewed the petition and confirmed that all the signatures are of the property owners in
the subdivision. There are 61 assessable parcels on the island, 35 of property owners (57%) have
signed the petition giving their consent to do the above infrastructure improvements through a
special assessment.

RE: Adoption of Special Assessment Resolution
As preliminary preparation for a discussion relating to a proposed special assessment for the
Atlantic Isle residential area, this memorandum discusses the steps that the City must follow in
order to impose a special assessment for sewer improvements in the Atlantic Isle area,
Step 1- Hirinl!: ora Consultant
The City must retain a consultant to prepare a special assessment report. This report will assist
the City Commission in determining: (1) whether the properties assessed derive a special benefit;
and (2) whether the apportionment is fair and reasonable, For your convenience, I have attached
a special assessment report prepared by Tischler & Associates for Landscaping Improvement
Project for Collins Avenue. The report was prepared in 2001. The City Commission did not
pursue this project.
Step 2- Adoption of a Resolution
The City is required to adopt a resolution to declare the special assessment. Section 170,03,
Florida Statutes, The resolution must contain the following: (1) the nature of the proposed
improvements and the location of the sewer improvement; (2) the total estimated cost of the
improvement (includes the cost of construction or reconstruction, cost of labor and materials,
etc.); (3) the part of the project to be paid by special assessment and the general improvement
fund of the City; (4) the manner in which the assessments are to be paid; and (5) the lands upon
which the special assessment shall be levied,

Step 3- Plans/Specifications
Before adoption of the resolution mentioned above, the City must have an assessment plat
showing the area to be assessed, with plans and specifications, and the estimate cost of the
proposed improvement. Section 170.04, Florida Statutes.
Step 4- Newspaper Notice
After the adoption of the resolution, the City must publish said resolution in the metro section of
the Miami Herald. The resolution must be published once a week for a period of 2 weeks in the
metro section, Section 170.05, Florida Statutes,
Step 5- Preliminarv Assessment Roll
After the adoption of the resolution, the City must prepare a preliminary assessment roll in
accordance with the method of assessment established in the resolution. The assessment roll
must show the lots and land assessed and the amount of the assessment against each lot or parcel
of land. Section 170.06, Florida Statutes. If installment payments are provided, the assessment
roll must show the number of annual installments in which the assessment is divided.
Step 6- Notice to the Propertv OwnerslPublic Hearine
Upon the completion of preliminary assessment roll, the City is required to set by resolution the
date and time at which the affected property owners or interested persons may appear before the
City Commission to discuss the special assessment. 30 days notice must be provided to the
affected property owners before the hearing. The notice must be mailed by certified mail to the
property owners addresses as provided by the County Property Appraiser Office, Notice of the
hearing must also be published in the metro section of the Miami Herald and the Daily Business
Review at least a week a part, Section 170,07, Florida Statutes.

Special Assessment Report
City of Sunny Isles Beach, Florida
Special assessments are burdens imposed on property by local governments for funding
particular services, systems and facilities. They confer a special benefit to the burdened
property and are reasonably and fairly apportioned. In contrast, a tax confers a general,
community-wide benefit. Special assessments do not impact a local government's millage
rate or require that its adoption be put to a referendum vote.
LEGAL GUIDELINES
According to Chapter 170 of the Florida Statutes, the City has authority to provide the Collins
Avenue streetscape improvements and collect a special assessment from the benefited
property. Special assessments shall be levied on benefited property at a rate based on the
special benefit accruini~ to the property from the planned improvements. The improvements
must provide a benefit that is different in type or degree from benefits provided to the
community as a whole.
There are two important legal guidelines that will ensure the City of Sunny Isles Beach has
established a valid special assessment. First, the City should establish that the planned
improvements provide a special benefit to the assessed property. Second, the assessment
on benefited property should be reasonably and fairly apportioned.
The first guideline may be satisfied by showing that the planned streetscape improvements
will add to the market value of the property along Collins Avenue. Landscaping, attractive
street lighting and signilge, street furniture and pedestrian safety improvements will clearly
make Collins Avenue a more desirable business location and a more livable environment for
both msidents and sea:50nal visitors. Streetscape improvements along Collins Avenue will
provide added use and enjoyment of this focal pOint for the community. The replacement of
oVerhEJad lines with new underground utilities will also provide special benefit to abutting
properties through mOrt3 reliable electric, telephone and cable TV service. The project is
consistent with the Comprehensive Plan. It promotes public safety by removing the danger
of downed power lines i'rom heavily traveled Collins Avenue, especially during hurricane
evacuations. The streetscape improvements will also promote economic development
within the City.
Because apportionment must bear a reasonable and fair relation to the special benefits that
accrUE', TA will discuss the strengths and weaknesses of various assessment methodologies
to help the City of Sunny Isles Beach in the decision making process. The City may also
partiCipate to the extentthat some improvements may more fairly benefit the entire City.
For example, the provisfon of underground utilities clearly provides a direct or special benefit
to the property owners served by the utilities. If the City narrowly defined the benefit area to
properties directly connected to the underground utilities, then the property owners in the
speciai assessment area would pay approximately 43% of the total cost of streetscape
improvements. As explained further in the next section, this percentage is base solely on
the cost of providing un,jerground utilities.

ESTI/\I1ATED COST OF IMPROVEMENTS
In May 2000, the City of Sunny Isles Beach received a Streetscaoe Master Plan prepared by
Berml~lIo, Ajamil & Partners, Inc., with Jackson Ahlstedt, P.E. and Tom Graboski Associates,
Inc. An extensive study of Collins Avenue provided the opinion of probable costs shown
below.

The major cost component is for the replacement of overhead utility lines with underground
infrastructure. In addition to the aesthetic improvement, new underground utilities will have
a longer useful life and they are less likely to be damaged by South Florida's frequent
tropical storms. The eE;timated cost of under ground utilities is $350 per linear foot and the
entire length of Collins Avenue, within the City of Sunny Isles Beach, is approximately 2.3
miles.
Given the approximate capital cost of $10 million for planned streetscape improvements, it
is likely that the City of Sunny Isles Beach will debt finance the project and pledge annual
revenue from a special assessment to make debt service payments. The table below
indicates a possible amortization schedule that assumes annual payments over ten years at
an intl~rest rate offive percent. Annual revenue from the special assessment would have to
generate approximately $1,306,100 to cover anticipated debt service payments.

DELINEATION OF BENEFIT AREA
An important step in thr3 special assessment process is delineating the geographic area that
will benefit from plannEid improvements. While conceptually easy to understand, the actual
identification of speCific land parcels will require careful attention to detail and consistent
applic;~tion of criteria for determining whether or not properties are included. For example,
there are residential developments in the City of Sunny Isles Beach that have direct access
to Collins Avenue, but tile land parcel(s) are located on a separate Island. City officials will
have t:l make policy deGlsions on whether to include certain classes of land parcels in the
special assessment are,a.
The City may establish l;riteria that range from a narrow to a broad delineation of the benefit
area. A narrow delineation of the benefit area may be achieved by limiting the special
assesliment to properth3s that will be directly connected to the underground utility lines.
Given the magnitude of the planned improvements, property owners paying the special
assessment will want to maximize the number of parcels in the benefit area. Because the
planned improvements will enhance the welfare of the entire community, it may be possible
to show that all properties within the City of Sunny Isles Beach will benefit from some
aspects of the streetscClpe improvements and thus should share in the cost allocation.

POTENTIAL SPECIAIL ASSESSMENT FOR SELECTED PROPERTIES
To as!;ist the City in the! evaluation of possible cost allocation methods, which are discussed
in the next section. TA and City staff selected six prototypical properties to represent classes
of land parcels along Collins Avenue. As part of the analysis of cost allocation methods, TA
will es,timate the potential special assessment for each prototype under each allocation
alternative. The six prtltotypes and representative parcels are discussed below. There are
three oceanfront prototypes, located on the east side of Collins and three commercial
prototypes on the west side of Collins Avenue.
1. New Oceanfront Condo -> The Millennium Condominium (18671 Collins Avenue)
2. "Old" Oceanfront Motel-> Driftwood Motel (17121 Collins Avenue)
3. Vacant Oceanfront Property -> Oceania Beach (proposed at 16151 Collins Avenue)
4. Mixed Use Business Center - The R.K. Shopping Center (17100 Collins Avenue) is a
larger community scale development that is located within the Sunny Isles Beach
Town Center.
5. Restaurant -> Tony Romas (18070 Collins Avenue)
6. Neighborhood Business Center -> Handy Mart neighborhood scale shopping center
(16204-28 Collins Avenue).
Each prototype has characteristics that will be used to determine the potential special
assessment under each alternative. The factors that will be used in the cost allocation
alternatives are summarized in the following table.

POSSIBLE COST ALLOCATION METHODS
To evaluate cost allocation methods TA has assumed the City will borrow funds to complete
the e~;timated $10 million in streetscape improvements along Collins Avenue. If the debt for
this project is retired over ten years, we have roughly estimated the annual debt service
payment to be approximately $1.3 million.
The d'3termination of special benefit is not limited to the present use of the property, but
may include a special benefit to a reasonable future use. The first three cost allocation
methods are based on current conditions (Le., road frontage, parcel size and land value).
The last two alternativEls are based on the development potential of the property under the
City's Comprehensive Plan.
Road Footage
The City of Sunny Isles Beach is approximately 2.5 miles in length, or 13,200 linear feet.
BecaLlse properties on both sides of Collins Avenue will help pay for the streetscape
improvements, the totelllength of road frontage is 26.400 feet. Ifthe $1.3 million annual
debt service payment is allocated equally to the entire length of road frontage, the average
cost is $49 per foot. Over the ten-year life of the special assessment, the six prototype
properties would annually pay the amounts shown below under the road frontage
alternative.

The Miami-Dade County Property Appraiser has data on the lot size of all land parcels within
the City of Sunny Isles fleach. Because lot size is based on the width and depth of a land
parcel, it may provide a better indication of potential benefit from the planned streetscape
improvements. The table below indicates the cost allocation based on parcel size for each
prototype.

Because it is unrealistic to speculate on future property values, TA will use current land
value~; for this alternative. If the cost allocation were based on the value of improvements,
the vacant and underutilized properties along Collins Avenue would pay an unreasonably low
speciell assessment. A\'1:er the planned streetscape improvements are completed, the
vacant and underutilized properties could receive a windfall due to the anticipated increase
in vallie of their properly. Therefore, the value of current buildings should not be used as a
cost ai/ocation method. The table below indicates the cost allocation for each prototype
under the land value alternative.

NEXT STEPS
If the City decides to proceed with the streetscape improvements, the next step is to prepare
a resolution stating:
1. The nature of the proposed improvements (Le., general description of improvements
and their locatioll)
2. The total estimated cost of the improvement
3. The part of the project expense to be paid by special assessment and the general
improvement fund of the municipality
4. The lands upon which the special assessment shall be levied.
Chapter 170.03 of the Florida Statutes provides that In describing said lands, it shall be
sufficient to describe ttlem as "all lots and lands adjoining and contiguous, or bounding and
abutting upon such improvements, or specially benefited thereby, and further designated by
the assessment plat hereinafter provided for." At the time the resolution is adopted the City
must have an assessment plat showing the area to be assessed. After adoption, the
resolution has to be published in the newspaper.
After approval of the special assessment resolution, the City must prepare a preliminary
asseSllment roll in acceordance with the agreed upon method of assessment. The
assesllment roll shall show the lots and land assessed and the amount of the assessment
agains,t each lot or parcel of land and the number of annual instaliments, if applicable.
Once the assessment mil is prepare, the governing bOdy of the City must fix a time and place
at whil:h the owners of 'the property to be assessed, or any other persons interested therein,
may appear and be heclrd as to the propriety and advisability of making such improvements,
the costs thereof and ttle amount to be assessed against each property. Each property
owner must receive written notice of the meeting 30 days in advance. The notices may be
mailed to the property c1wners addresses as provided by the County Property Appraiser.
Additional legal notices must appear in the newspaper.

After three meetings with Atlantic A venue Residents to discuss the Special Assessment Project
consisting of sanitary sewer installation, pavement restoration and drainage improvements,
things are moving along nicely. As indicated in the attached petition analysis (attachment 1), we
now have a majority of Property owners in favor of the project. Please know that Property
owners in favor of the Special Assessment Project based their decision primarily on the
information contained in the attached revised power point presentation (attachment 2). And the
difference between the enclosed presentation and the previous one is that I'm now
recommending a 25 year schedule of payments for the Special Assessment Project where earlier
it was a 20 year schedule.
In accordance with attached memorandum from the City Attorney (attachment 3), Tischler and
Associates will review the Special Assessment Proposal I advanced to the Atlantic Isle Residents
for reason of determining whether the properties assessed derive a special benefit; and whether
the apportionment is fair and reasonable. Specifically, the consultant will look at the benefits of a
sanitary sewer system compared to septic fields, and the benefits of enhanced roadway/drainage
improvements. In terms of proration, I'm proposing a 50/50 split between the City and residents
for sanitary sewer installation and roadway improvements, with the City paying 100% of
drainage improvements.
The next step in the Special Assessment approval process is to have detailed plans and
specifications. To this end, staff and I will be sending out and reviewing requests for
qualifications so that we can then select an Engineering Firm to develop plans and specs for this
project. Our objective is to select an Engineering Firm by March 2007; have plans and

specifications ready by June; permitting to be completed by September, and construction to
begin in December.
The total estimated cost for the Special Assessment Project components are $2,674,000. And
funding sources are proposed as follows:
$ 750,000 TDR Funds (4.10)
1,009,000 General Fund Loan (25 years, for Special Assessment portion)
915.000 General Fund Reserves
$ 2,674,000 Total Funding Sources
We anticipate scheduling a Public Hearing authorizing the Special Assessment Project by the
June 2007 City Commission Meeting.
