A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING
RESOLUTION NO. 2006-924 EXTENDING THE PERIOD
OF TIME WAIVING ANY AND ALL CITY BUILDING
PERMIT FEES FOR PROPERTY OWNERS FOR
EMERGENCY REPAIRS DUE TO HURRICANE WILMA,
AND FOR GENERATORS FOR PROPERTY OWNERS OF
FACILITIES USED BY THE PUBLIC, FOR AN
ADDITIONAL THREE-MONTH PERIOD, EFFECTIVE
THROUGH OCTOBER 31, 2006; RATIFYING ANY AND
ALL WAIVERS GRANTED; AUTHORIZING THE CITY
MANAGER TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on November 17, 2005, the City Commission adopted Resolution No.
2005-850 waiving building pel1uit fees for property owners for emergency repairs due to
Hurricane Wilma for a six-month period ending on April 26, 2006, not including fees associated
with any other entity, such as the County or State; and
WHEREAS, due to the overwhelming amount of destruction and debris caused by
Hurricane Wilma statewide, many residents were unable to get their repairs done during this
amnesty time period, and as such, on May 18, 2006 the City Commission adopted Resolution
No. 2006-924 granting another three-month period through July 26, 2006, waiving building
permit fees for emergency repairs due to Hurricane Wilma, and for generators for property
owners of facilities used by the public; and
WHEREAS, many residents are unable to get their repairs done during this extended
amnesty time period, and therefore, the City Manager has granted another three-month period
through October 31, 2006, to waive the building permit fees for emergency repairs due to
Hurricane Wilma and for generators for property owners of facilities used by the public, not
including fees associated with any other cntity, such as the County or State,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Extension to Waiver of Building Permit Fees. The City Commission hereby
amends Resolution No. 2006-924, extending the waiver of any and all City building permit fees
and costs for property owners for emergency repairs due to Hurricane Wilma for an additional
three-month period effective through October 31, 2006, However, property owners shall be
responsible for any and all permit fees and costs associated with any other government entity,
such as the State or County.
Section 2. Exteusion to Waiver of Permit Fees for a Generator. The City Commission hereby
amends Resolution No. 2006-924, extending the waiver of any and all City building permit fees

for generators for property owners of facilities used by the public for an additional three-month
period, effective through October 31, 2006. However, property owners shall be responsible for
any and all permit fees and costs associated with any other government entity, such as the State
or County.
Section 3, Ratifying Waivers Granted. The City Commission hereby ratifies any waiver
granted by the City Manager or Designee subsequent to the expiration of the waiver granted
under Resolution No, 2005-850 and Resolution No. 2006-924,
Section 4. Authority of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 5,
Effective Datc. This Resolution shall become effective upon adoption.

Amend Resolution No. 2006-924 for an Extension of Time to Waive Permit
Fees
RECOMMENDA TION:
It is requested that the City Commission adopt the Resolution.
REASONS:
In the wake of Hurricane Wilma the City Commission adopted Resolution No. 2005-850 which
waived the City Building Permit fees for property owners for any Hurricane related repairs for a
six-month period, which ended on April 26, 2006. Because many residents were unable to get
their repairs done during the amnesty time period, the City Commission adopted Resolution No.
2006-924, which extended the deadline through July 26, 2006 and included the waiver of permit
fees for the installation of backup generators for property owners of facilities used by the public.
However, as we still have some permit applications outstanding due to the vast amount of
destruction caused by last year's hurricane season, staff is requesting an amendment to
Resolution No. 2006-924 to extend the waiver period through October 31,2006.
ADDITIONAL INFORMATION:
The intent of Resolutions No. 2005-850 and No. 2006-924 were to provide relief to Hurricane
Wilma victims for the damages incurred by the storm as well as to waive building permit fees for
generators for property owners of facilities used by the public. However, we have encountered
several unforeseen issues with regards to the above matter, which has caused delays by
contractors and engineers to give Condominium Associations and residents the required
permitting paperwork for the needed repairs. Therefore, staff feels that an extension period is
necessary to allow residents to obtain the required information for permitting.
