HomeMy WebLinkAboutReso 2006-976 RESOLUTION NO. 2006-n", A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE PURCHASE OF TWENTY-ONE THOUSAND EIGHT HUNDRED (21,800) PLANTS FROM THE SCHOOL BOARD OF MIAMI- DADE COUNTY, FLORIDA, TO BE PLACED AT THE RETENTION PONDS ON SUNNY ISLES BOULEVARD, IN A TOTAL AMOUNT NOT TO EXCEED THIRTY-EIGHT THOUSAND ONE HUNDRED FIFTY DOLLARS ($38,150.00), ATTACHED HERETO AS COMPOSITE EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENTS; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THESE AGREEMENTS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach is desirous of maintaining the beauty of the City through enhanced landscaping improvements; and WHEREAS, the City has two (2) retention ponds for water runoff on Surmy Isles Boulevard that are in need of landscaping as Sunny Isles Boulevard is the City's main entranceway; and WHEREAS, the retention ponds are located on the east and west side of the FPL substation and can be landscaped with salt and flood tolerant plants; and WHEREAS, the School Board of Miami-Dade County, Florida, has plants available for purchase through its Agriculture System's student projects; and WHEREAS, the City wishes to purchase Twenty-One Thousand Eight Hundred (21,800) fully rooted Lemon Bacopa plants from the School Board; and WHEREAS, the School Board can accommodate the City's purchase request through the agricultural programs of two schools - W. H. Turner Technical High School and South Dade Senior High School; and WHEREAS, the School Board has submitted two purchase agreements for the purchase of said plants at $1.75 per plant, for a total amount not to exceed Thirty-Eight Thousand One Hundred Fifty Dollars ($38,150.00), as quoted on the proposals attached hereto as composite Exhibit "A", NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: R2006- Plant Purchase From School Board For Retention AreasPage 1 of2 Section 1. Approval of Purchase.. The City Commission hereby authorizes the purchase of Twenty-One Thousand Eight Hundred (21,800) plants from The School Board of Miami-Dade County, Florida, in a total amount not to exceed Thirty-Eight Thousand One Hundred Fifty Dollars ($38,150.00), as quoted on the proposals attached hereto as composite Exhibit "A". Section 2, Authorization of the City Manager. The City Manager is hereby authorized to do all things necessary to effectuate the terms ofthese Agreements. Section 3. Effective Date. INDEMNIFICATION Subject to the limitations of Florida Statute 768.28, the School Board of Miami-Dade County, Florida. hereinafter referred to as the School Board, agrees to indemnify and hold ha1ll11ess the Organization from and against any and all claims, suits, actions, damages, or causes of action arising out of the negligent acts ofthe School Board arising out of or in connection with the provisions of this agreement. The Organization agrees to indemnify, hold hannless and defend the School Board from and against any and all claims, suits, actions, damages. or causes of acti,on arising out of the negligent acts of the Organization arising out of or in connection with the provisions of this agreement. If the Organization i.s a state agency or subdivision as defined in section 768.28, Florida Statutes, nothing herein shall be construed to extend the Organization's liability beyond that provided in seeti,on 768,28, Florida Statutes. INSURANCE Prior to commencing the services under this agreement, the Organization shall obtain and maintain without interruption Commercial General Liability Insurance with limits of no less than $300,000 per occurrence. If the Organization provides transportation services of students under this agreement, the Organization shall obtain and maintain without interruption Automobile Liability Insurance with limits of no less than $300,000 combined single limit. "The School Board of Miami-Dade County, Florida" shall be shown as additional insured with regard to the liability insurance. John Szerlag, City Manager FROM: DATE: RE: Jorge Vera, Assistant City Manager r September 21, 2006 Approve a Resolution to Purchase Plants to Landscape the Two (2) Retention Ponds Located on Sunny Isles Boulevard RECOMMENDATION: It is requested that the City Commission adopt the Resolution. REASONS: Currently there are two retention ponds located on Sunny Isles Boulevard at the east and west side of the FPL substation that are in need of landscaping as the Boulevard is the main entranceway into the City. These ponds are used for water runoff, however we can still landscape them with salt and flood tolerant plants. The School Board of Miami-Dade County has plants available for purchase through its Agriculture System's student projects. The School Board has forwarded two purchase agreements to the City for 21,800 fully rooted Lemon Bacopa plants, at $1.75 per plant, for a total amount of $38,150.00. It is estimated that it will take approximately three (3) months to grow the plants before they can be delivered to the City.
