HomeMy WebLinkAboutReso 2006-977 RESOLUTION NO. 2006-.9..J 7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, URGING THE STATE LEGISLATURE TO CHANGE STATE LAW SO AS TO PRECLUDE CELLULAR TELEPHONE USAGE BY MOTOR VEHICLE DRIVERS WHILE LOCATED IN A SCHOOL ZONE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Sunny Isles Beach is deeply saddened by recent new reports of the death of a minor child that was crossing the street within a school zone due to a driver's negligence and cellular phone usage while operating a motor vehicle; and WHEREAS, the City Commission are concerned with the health, safety, and welfare of minors crossing the street in school crossing areas; and WHEREAS, it would promote the health, safety and welfare of all residents, and in particular would protect the youth of the state if the state were to preclude the use of cellular telephones by persons operating motor vehicles while located in a school zone; and WHEREAS, the City Commission urges the State Legislature to amend or modifY state law so as to preclude the use of cellular telephones by persons operating a motor vehicle while located within a school zone. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. reference. Incomoration of Recitals. The above whereas clauses are incorporated by Section 2. Request of the City Commission. The City Commission of the City of Sunny Isles Beach hereby requests that the State Legislature modifY or amend existing laws so as to prohibit the use of cellular telephones by persons operating motor vehicles while located in a school zone. Section 3. Direction to City Clerk. The City Clerk is hereby directed to transmit a certified copy of this Resolution to the City's State Representatives and to the State Legislature, and an executed copy to the Mayor of Miami-Dade County, each member of the Miami-Dade Board of County Commissioners, as well as each municipal clerk in Miami-Dade County for the purpose of distributing copies to members of their respective governing councils in order to seek support for the proposed change in State law. John Szerlag, City Ma~ September 21,2006 Resolution Urging the State Legislature to Change State Law so as to Preclude Cellular Telephone Usage by Motor Vehicle Drivers in a School Zone RECOMMENDATION: It is recommended that the City Commission adopt the attached Resolution urging the State Legislature to change State law to preclude cellular telephone use by motor vehicle drivers while in a school zone. REASONS: The City is deeply saddened by recent news of another death of a minor child that was crossing the street within a school zone due to a driver's negligence and cellular phone usage while operating a motor vehicle. We will soon have a K-8 school in Sunny Isles Beach and this would ensure the health, safety and welfare of all residents, in particular our youth. The City is therefore joining other Florida municipalities in urging the State Legislature to amend or modify State law so as to preclude the use of cellular telephone by persons operating a motor vehicle while located within a school zone.
