("LUKES"'), FOR AN OVERHEAD IRRIGATION SYSTEM FOR MEDIANS ALONG COLLINS AVENUE, IN AN AMOUNT OF FIFTY-ONE THOUSAND THREE HUNDRED NINETY-NINE DOLLARS AND FIFTY- NINE CENTS ($51,399.59), ATTACHED HERETO AS EXHIBIT "A", IN ACCORDANCE WITH RESOLUTIONS NO. 2003-556 AND 2001-390; AUTHORIZING THE MAYOR TO EXECUTE SAID AMENDMENT TO AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach is desirous of maintaining the landscaping of the medians along Collins Avenue; and WHEREAS, the City wishes to install overhead irrigation of the additional flowered bull noses located at the end of each median along Collins A venue to keep the plants washed for proper growth; and WHEREAS, the City adopted Resolution No, 2003-556 authorizing an agreement with Lukes' Landscaping, Inc" for landscaping maintenance and Resolution No, 2001-390 awarding Lukes' a six-year agreement to landscape and maintain the parks, medians and rights-of-way; and WHEREAS, Lukes' Landscaping, Inc" are under contract with the City and will provide overhead irrigation along the medians on Collins Avenue at a cost of Fifty-One Thousand Three Hundred Ninety-Nine Dollars and Fifty-Nine Cents ($51,399,59), attached hereto as Exhibit "A", NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1, Approval of Amendment to Agreement. The Amendment to the Agreement with Lukes' Landscaping, Inc" in accordance with Resolutions No, 2003-556 and No, 2001-390, for overhead irrigation of the additional flowered bull noses located at the end of each median along Collins Avenue, in an amount of$51,399,59, attached hereto as Exhibit "A", be and the same, is hereby approved, Section 2, Authorization of City Manager. CONSULTANT AGREEMENT DATED NOVEMBER 13, 2001 .---------e0NTR.A:eT-N0;;-e060i;;002 THIS AMENDMENT is made and entered into this ,q4ll day of O!..~ 2006, by and between the CITY OF SUNNY ISLES BEACH, FLORIDA, a municipal corporation of the State of Florida, (hereinafter referred as to "City") and LUKE'S LANDSCAPING, INC., a Florida corporation, (hereinafter referred to as "Contractor"), WHEREAS, pursuant to Bid No, 01-09-01, the City Commission adopted Resolution No, 2001-390 and awarded a Maintenance Service contract to Lukes' Landscaping on November 13,2001 ("Master Agreement"); and WHEREAS, on July 19, 2003 the City adopted Resolution No. 2003-556 renewing the Master Agreement and amending said contract to include additional areas to be maintained under the same terms and conditions; and WHEREAS, on July 20, 2006, the City extended the Master Agreement through November 13, 2007 and amended said contract to modify the payment terms pursuant to Resolution No, 2006-950; and WHEREAS, the City of Sunny Isles Beach is desirous of maintaining the landscaping of the medians along Collins A venue; and WHEREAS, the City wishes to install overhead irrigation of the additional flowered bull noses located at the end of each median along Collins A venue to keep the plants washed for proper growth as described more fully in Attachment "A", attached hereto and made a part hereof. WHEREAS, the required work will cost the City an additional Fifty-One Thousand Three Hundred Ninety-Nine Dollars and Fifty-Nine Cents ($51,399,59), NOW THEREFORE, in consideration of the premises and the mutual covenants herein stated, the parties hereto agree as set forth below: 1. AMENDMENT. Paragraph 3 of the Master Agreement, entitled "Payment for Vendor's Services", shall be amended as follows: The total cost for the overhead irrigation of the additional flowered bull noses located at the end of each median along Collins A venue shall not exceed $51,399,59 2. REMAINING TERMS. All other terms and provisions of the Master Agreement dated November 13, 2001 shall remain in full force and effect. This installation will be provided by Luke's Landscaping, Irrigation Division, 3000 N 28th Terrace, Hollywood, FL. REASONS: The current method of irrigating plants in the Collins Avenue medians is weep pipe. This is satisfactory for bushes but not for a flower bed. Overhead irrigation will not only cover the entire bed, it will keep the plants themselves washed which is necessary for proper growth. As the flowers are replaced with Impatiens in October the irrigation will be installed. OTHER INFORMATION: Funds for this project are available under budget code 10-539-5348.
