HomeMy WebLinkAboutReso 2006-916 RESOLUTION NO. 2006- .5J,J!e A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING AN AGREEMENT WITH BLACK BEAR SYSTEMS, INC. FOR MODIFICATION OF THE PTWIN32V2 SOFTWARE PROGRAM IN THE BUILDING DEPARTMENT AND THE TRAINING OF STAFF, IN AN AMOUNT NOT TO EXCEED TWELVE THOUSAND DOLLARS ($12,000.00), ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Sunny Isles Beach Building Departmcnt is desirous of using the PTWin32v2 computer software program, as it can integrate and track and report on planning, building, zoning, licensing, and code enforcement rccords; and WHEREAS, thc City is in need of a contractor to make specific modifications to the PTWin32v2 software program in the Building Dcpartment and to train staff on the program; and WHEREAS, Black Bcar Systems, Inc. ("Black Bear") is the manufacturer of the PTWin32v2 system; and WHEREAS, Black Bear is thc only vendor authorized to makc modifications to the program code; and WHEREAS, staff contacted Black Bear with the proposed modifications request, which they have agreed to make; and WHEREAS, Black Bear has submitted a proposal for professional serviccs, in an amount not to exceed Twelve Thousand Dollars ($12,000.00), attachcd hereto as Exhibit "A"; and WHEREAS, the Information Technology Department has rcviewed the proposal from Black Bear and has determincd it to be fair, reasonable, and customary; and WHEREAS, the City wishes to cnter into an agreement with Black Bear for the modification of the PTWin32v2 system and the training of staff. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section I. Approval of Agreemcnt. The Agreement with Black Bear, Inc. for the modification of the PTWin32v2 software program in the Building Department and the training of R2006. Section 2. Authorization of Mavor. The Mayor is hereby authorized to execute said Agreement. Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate the terms of the Agreement. Section 4. Effective Date. Hines, CMC, City Clerk MEMORANDUM File Priscilla Walker, CMC, Deputy City Cler~?~ January 25,2007 Clarification on Black Bear Agreement Approved Via Resolution No. 2006-916 This is to document the reason the above agreement is not signed by the vendor. The above agenda item was approved by the City Commission on May 18, 2006. It contained a resolution, the standard city contract, and exhibits provided by the vendor. Upon Commission approval, the contract was transmitted to the vendor for execution. At that time the vendor advised that they would only sign their contract (the exhibits) and not the City's contract. The City Attorney agreed to this, but requested the vendor make several minor changes to their contract. The City and the vendor are (currently) still in negotiations. - As such, the standard city contract will not be signed by the vendor, but remains part of the record. Enclosed are three (3) original agreements for signature and witnessing by Black Bear Systems, Inc. Upon completion, please return the originals to my attention. John Szerlag, City Manager 'f Derrick Arias, Information Technology Director May 18, 2006 Agreement with Black Bear Systems, Inc. for Modification of PTWin32 Software Program and Training of Staff RECOMMENDATION: It is recommended that the City Commission adopt the attached resolution approving an agreement with Black Bear Systems, Inc. for modification of the PTWin32 Software Program and Training of Staff for the Building Department. REASONS: The City is in need of special modifications to the PTWin32 software. These modifications are required in order to meet some of the requirements of the Building Department in the operation of a permitting and licensing system. The cost for program modifications is in an amount not to exceed Six Thousand Dollars ($6,000.00). The City is also in need of training services for the Building Department Staff. Training will be provided on-site at a daily rate of $1400 plus expenses. We are estimating 3 days of on-site training plus expenses, in an amount not to exceed Six Thousand Dollars ($6,000.00). ADDITIONAL INFORMATION: The manufacturer of the PTWin32 software, Black Bear Systems, is the only vendor authorized to make modifications to the program code. They are also the only vendor with a formal training program on the software. As such, this work is being requested of them as a sole-source vendor. Funding for this contract, in a total amount not to exceed Twelve Thousand Dollars ($12,000.00), will be provided by the Building Department Technology Fee Fund.
