HomeMy WebLinkAboutReso 2007-1050 RESOLUTION NO. 2007- ID5D A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A CITY-WIDE GRIEVANCE PROCEDURE AND GIUEV ANCE FORM IN COMPLIANCE WITH THE AMERICANS WITI-I DISABILITIES ACT (ADA); AUTHORIZING THE CITY MANAGER TO CREATE A VISIBLE LINK ON - - - --- THE CITY'S WEBSITE LABELED "ADA PUBLIC NOTICE" AND PROVIDE ALL OTHER NECESSARY ACCOMMODATIONS TO MAKE THE ADA GRIEVANCE PROCEDURE AND FORM A V AILABLE TO THE PUBLIC IN PRINTABLE FORMAT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City is required to comply with Title II of the Americans with Disabilities Act (ADA) rules and regulations which prohibits a public entity from discriminating against, excluding from participation or denying public sponsored benefits, programs or services, to an otherwise qualified disabled individual, solely by reason of such disability; and WHEREAS, in order to comply with the ADA, the City must provide a method for the public to address its concerns and conduct a self evaluation plan to evaluate its currcnt services, policies and practices; and WHEREAS, the City Commission desires to approve and adopt a City-wide ADA Grievance Procedure and Grievance Form to afford the public a process to address its accessibility concerns. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Gricvance Procedure and Grievance Form. The City Commission hereby approves the Grievance Procedure and Grievance as set forth in Exhibit "A" attached hereto. Section 2. Authorization to City Manager to Create Web Link. The City Manager is hereby authorized to create a visible link on the City's website labeled "ADA Public Notice" and provide all other necessary accommodations to make thc ADA Grievance Procedure and Form available to the public in printable format. "'- :.:~-~) '~. \~/ -.. .- ----- -~-------/ / i<\ i'-\ .J :",\.1,' Americans with Disabilities Act Grievance Procedure POLICY The City of Sunny Isles Beach ("City") has adopted an internal grievance procedure for prompt and equitable resolution of complaints alleging any actions prohibited by Title II of the Americans with Disabilities Act ("ADA"). Any qualified individual who feels they haye been discriminated against on the basis of disability in any program or service provided by the City, pursuant to the ADA proyisions, may file a complaint with the City's ADA Coordinator. PROCEDURE 1. Filing a Complaint a. The complaint should be filed on the ADA Grievance Form, which is prepared by the City and available on the City's website or upon request at the City Clerk's Office. If the complaint is not filed on the grievance form, it should nonetheless be in writing and contain the name, address and telephone nllmber of the pcrson(s) filing the complaint with a description of the alleged discrimination such as the location of the City program or scrvice involved, the date of occurrence, why the indiyidual believes he/she is being discriminated against on the basis of a disability, and action requested from the City to con'ect the problem. Upon request, alternatiye mcans of filing complaints, such as personal interviews or a tape recording of the complaint, may be made available for persons with disabilities. c. An oral grieyance can be filed by contacting the ADA Coordinator. The oral grievance will be reduced to writing by the ADA Coordinator utilizing the ADA Grievance Form. d. The complaint should be submitted by the Grievant and/or hislher designee as soon as possible but no later than 60 business days after the alleged yiolation. 2. COlllplain! Resolution a. Within 5 business days after receipt of the complaint, thc ADA Coordinator will contact the Grievant in writing acknowledging receipt of the complaint. If possible, informal resolutions can be suggested at that time and a written confirmation will be provided by the ADA Coordinator. The written confirmation shall bc signed by the ADA Coordinator and the Grieyant, as final resolution of the complaint. b. If further research of the issues is required, the ADA Coordinator shall have 30 days from the date of acknowledging receipt of the complaint to conduct an investigation necessary to determine the yalidity of the alleged discrimination and provide a written responsc to the Grieyant. Where appropriate, thc City shall provide the Grievant with a format accessible response, such as large print, Braille, or audio tape. The response will explain the position of the City of Sunny Isles Beach and offer options for substantive resolution of the complaint. 3. Filing an Appeal a. If the Grievant is dissatisfied with the recommended resolution by the ADA Coordinator, the Grievant and/or hislher designee may appeal the decision of the ADA Coordinator to the City Manager, or designee, within 15 business days from the date of the written recommendation by the ADA Coordinator. b. Within 15 business days after receipt of the appeal, the City Manager, or designee, will meet with the complainant to discuss the complaint and possible solutions. Within 15 business days after the meeting, the City Manager, or designee, will respond in writing, and, where appropriate, in a format accessible to the complainant, with a final resolution of the complaint. -2- U:\ATrORNEY\ADA DocslSIB ADA Grievance Procedure.doc 4. Record Keeping The ADA Coordinator shall maintain the records relating to complaints filed with the City of Sunny Isles Beach for a period of at least three (3) years. REASONS: The City is in possession of a significant amount of surplus computers and computer monitors, These are older systems that have been decommissioned over the last two to three years, and are no longer viable for business use in the City. The Education Fund (The Ed Fund) began in 1985 as a non-profit organization that designs, shapes and implements initiatives that involve the private sector in improving schools and bringing excellence to public education. These initiatives have directly affected 10,000 teachers in the Miami-Dade County Public Schools system, and more than 380,000 students. The Citibank FamilyTech program, run by The Education Fund, accepts donations of computer equipment, which is then refurbished, made Internet-ready, and then loaned on a long-term basis to low-income families with children at selected Miami-Dade County Public Schools. More information on The Education Fund is available on their web site, www.educationfund.org. REASONS: The City is required to comply with Title II of the Americans with Disabilities Act (ADA) rules and regulations which prohibit a public entity from discriminating against, excluding from participation or denying public sponsored benefits, programs or services, to an otherwise qualified disabled individual, solely by reason of such disability. The ADA is a strict liability regulation and includes an attorney's fees provision, thus exposing the City to liability. Additionally, it should be noted that the City, as an employer and landlord, is also directly and indirectly affected by the provisions of Titles I (Employment) and III (Public Accommodations and Commercial Facilities) of the ADA. In order to achieve preliminary compliance with the ADA, the City must provide a method for the public to address its concerns and conduct a self evaluation plan to evaluate its current services, policies and practices. Thus, I recommend the City approve the proposed resolution to implement a City-wide ADA grievance procedure to initiate the compliance process and authorize the City manager to create a visible link on the City's website to post the procedure and the companion form.
