HomeMy WebLinkAboutReso 2007-1117 RESOLUTION NO. 2007- /111 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, ENDORSING THE RECOMMENDATIONS CONTAINED IN TilE FINAL REVIEW REPORT OF THE EDUCATIONAL FACILITIES IMPACT FEE ORDINANCE AND REQUESTING TIIAT MIAMI-DADE COUNTY IMPLEMENT THE REVISIONS AS SOON AS POSSIBLE; AUTHORIZING THE CITY MANAGER AND CITY ATTORNEY TO DO ALL TIIINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the current Miami-Dade County Educational Facilities Impact Fee Ordinance (Impact Fees) adopted by Miami-Dade County in 1995, requires that fees be collected at time of building permit for the construction of new residential development (or additions to existing homes) to help mitigate the cost of the additional student stations generated from the impact of such new residential development; and WHEREAS, Impact Fees are an essential component of the School District's capital funding for the construction of student seats to accommodate residential growth; and WHEREAS, the City of Sunny Isles Beach recognizes that the current fees are inadequate, as they reflect construction market rates JI'om the 1990's, and need to be updated to reflect current conditions; and WHEREAS, the Impact Fee Ordinance requires that the Ordinance, its formula, and the Impact Fee methodology and Technical Report be reviewed regularly, and that, if appropriate, recommendations for revisions be submitted to the Board of County Commissioners; and WHEREAS, the Interlocal Agreement for Public School Facility Planning in Miami- Dade County (Interlocal Agreement), which was executed on March 3, 2003, also mandates a comprehensive annual review; and WHEREAS, the School Board in October 2004 initiated its review of the Impact Fee Ordinance, under the auspices of the Interlocal Agreement, in collaboration with community stakeholders, including representatives from Miami-Dade County, municipal governments and the residential development industry, most notably through participation Ii-om the Builders Association of South Florida and Latin Builders Association; and WHEREAS, in January 2006, the School District completed its review and produced a final report that incorporated the input of the stakeholders who participated in the Staff Working Group meetings, and in March of 2006, the School Board received the report and forwarded it to Miami-Dade County (County) for implementation; and Page 1 of 4 WHEREAS, the proposed reVISions to the current Impact Fee Ordinance have been incorporated into an Ordinance and must now be consideled by the Miami-Dade County Board of County Commissioners; and WHEREAS, the City of Sunny Isles Beach supports the recommcndations contained in the Final Report of the Impact Fee revicw and believes that those recommendations are fair and appropriatc. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section J. Support of the Proposed Amendments to the Impact Fee Ordinance. The City Commission of the City of Sunny Isles Beach supports the proposed amendments to the Impact Fee Ordinance, pursuant to the recommendations of the Final Impact Fee report dated January 11, 2006, and including substantially the following elements, and requests it be forwarded to all relevant parties: . Base impact fees on the type of housing unit (e,g. single-family detached, single-family attached and multi-family) and number of bedrooms, as opposed to square footage (see Exhibit "A"-Impact Fee Schedule); . Utilize different student generation multipliers for each of the four proposed Benefit Districts to more accurately ref1ect development trends within each particular District; . Increase the number of Benefit Districts fi'om three to four to allow for more representative projects, as it relates to the specific area of impact; . Retain the two percent administrative fee (I % each to County and School Board), currently assessed within the impact fee structure; . Adjust Impact fees annually using a three-year rolling average based on the increase in construction costs as established by the Florida Dcpartment of Education for the allowable cost for student stations; and . Re-evaluate the impact fee structure, including the student generation multipliers, in three years. . Inclusion of affordable housing waivers, as authorized by the School Board on March 14, 2007, under the lollowing: o Eligibility Criteria (waivers as function of AMI, to be updated annually): Extreme low income (30% of AMI, or $16,750) - provide a 100% Waiver; Page 2 of 4 Very low incomc (50% of AMI, or $27,950) - provide a 75% waiver; Low income (80% of AMI, or $44,700) - provide a 50% waiver. Edelcup, Mayor Ir~ June 21, 2007 RE: Educational Facilities Impact Fees Please give favorable consideration to the attached Resolution supporting the School district in its quest to have the County Commission adopt several pending revisions to the Educational Facility Impact Fee Ordinance. The Impact Fee Ordinance hasn't been updated since 1995, and adopting the revisions included in the proposed Ordinance is important to the districts continued ability to provide student seats needed as result of new development. The main changes to the School Impact Fee Ordinance compared to the existing Ordinance follow: .:. Assessment to be based on type of unit, # of bedrooms and geographic area, rather than pure square footage, so as to more accurately reflect actual student generation patterns .:. Note: The County's Planning/Research Department has consistently acknowledged and published data and reports indicating that type of unit and geographic location produce different student generation multipliers, i.e. MSA data .:. Fees to be deposited into 4 as opposed to 3 benefit districts to ensure proceeds stay closer to area of impact. .:. Annual adjustments for construction cost changes based on state published indicators .:. Review of methodology, including cost and credits every three years to retain relevance. .:. The Ordinance was passed on first reading by the County Commission but was deferred by the County's Governmental Operations and Environment Committee to the July 11, 2007 meeting. Adoption of the revisions is extremely important to the District's continued ability to provide the student seats needed as a result of new development; you (Hans) along with staff from the county and numerous other cities, participated in the development of the report upon which the Ordinance revisions are based. As you may recall, the impact fee ordinance hasn't been updated since 1995, not even for inflation. I can forward to you a summary of the impact fee revisions for distribution to your Commission and/or discussion with both of you and/or individual members of the City Commission at separate briefings, as well as be available to make a presentation to the City Commission at the time the support resolution is considered. School Board Vice-Chair Dr. Martin Karp has also been very supportive of this initiative and has met individually with several members of the County Commission. Thank you in advance for all your help and support; please let me know if this request can be implemented and if so, when the item would appear on the City Commission's agenda so that we can make plans to attend.
