Home My WebLink AboutReso 2007-1122 RESOLUTION NO. 2007---J...l22 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, ACCEPTING DEED FROM MIAMI-DADE COUNTY FOR THE PROPERTY LOCATED AT 350 SUNNY ISLES BLVD ALSO KNOWN AS PUMP STATION 301 FOR USE AS PUBLIC RIGHT-OF WAY; PROVIDING THE CITY MANAGER AND THE CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami-Dade Water and Sewer Department (MOW AS D) owns and operates a sewer pump station at 350 Sunny Isles Beach Boulevard; and WHEREAS, it is the wish of this Commission to acquire this land for the purpose of , providing a public right of way to enhance development within the City; and WHEREAS, the County Commissioners has agreed to convey all rights, title, and interest it has in a portion of the property known as 350 Sunny Isles Beach Boulevard, also known as Pump Station 301. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section I. Acceptance of Right-of-Wav Deed. The City Commission hereby accepts the deed from Miami-Dade County for the property located at 350 Sunny Isles Beach Boulevard, also known as Pump Station 301 for use as a public right-of-way. Section 2. Authoritv of the Citv Manager and Citv Attornev. The City Manager and the City Attorney are hereby authorized to accept the deed to county owned property and to do all things necessary to effectuate this Resolution. Section 3. Effective Date. RECOMMENDATION It is recommended that the Board of County Commissioners approve the conveyance of a portion of County owned land to the City of Sunny Isles Beach for use as public right of way. SCOPE OF AGENDA ITEM The impact of this agenda item is limited to the City of Sunny Isles. FISCAL IMPACT/FUNDING SOURCE There is no fiscal impact to the County. The County will benefit in that the City of Sunny Isles has agreed to fund and construct landscape improvements within the portion of property that is not being conveyed as part of a neighborhood beautification initiative instigated by the City of Sunny Isles. TRACK RECORD/MONITOR MDW ASD's Intergovernmental Affair's Manager will keep record of this property conveyance, BACKGROUND The Miami-Dade Water and Sewer Department (MDWASD) owns and operates a sewer pump station at 350 Sunny Isles Beach Boulevard. The City of Sunny Isles Beach has requested that a portion of this property be conveyed to the City of Sunny Isles for use as public right of way. Use of a portion of this property as public right of way will allow for enhanced development opportunities within the City of Sunny Isles. MDWASD has no need for the portion of the property sought by the City of Sunny Isles and is able 10 maintain full operations of the pump slalion without use of the property sought. REASONS: At a City Commission meeting held on April 19, 2007, the City Commission agreed to accept a right-of-way deed with certain conditions to facilitate the development of the Sunny Isles Marina development project located at 350 Sunny Isles Blvd. The County Commission has approved the right-of-way deed.
