A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE FIRST
ADDENDUM TO THE AGREEMENT WITH MARLIN
ENGINEERING, INC. FOR ADDITIONAL SERVICES TO
PERFORM SUBSURFACE UTILITY EXPLORATION (SUE), AND
REPLACE THE EXISTING WATER MAIN ALONG THE SOUTH
SIDE OF SUNNY ISLES BOULEVARD, IN THE AMOUNT NOT
TO EXCEED FORTY-SIX THOUSAND NINE HUNDRED
SEVENTY-THREE DOLLARS AND EIGHTY-FIVE CENTS
($46,973.85), ATTACHED HERETO AS EXHIBIT "A";
AUTHORIZING THE MAYOR TO EXECUTE ADDENDUM TO
AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO
ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF
THE AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on June 21, 2007, the City Commission adopted Resolution No. 2007-1110
approving an agreement with Marlin Engineering, Inc., in an amount of Eighty-Four Thousand
Two Hundred Seventy-Two Dollars and Thirty-Nine Cents ($84,272.39), to provide Post Design
Services during the construction of the Sunny Isles Beach BoulevardlSR 826 Project; and
WHEREAS, in relation to the project developing Sunny Isles Boulevard, the City has
requested that the Consultant provide additional services by performing a Subsurface Utility
Exploration (SUE) so that FP&L can include the undergrounding of power lines, and to replace
the existing water main along the south side of Sunny Isles Boulevard; and
WHEREAS, Marlin Engineering, Inc. has submitted a proposal, and the City wishes to
accept the proposal modifying the agreement to include this work, in an amount not to exceed
Forty-Six Thousand Nine Hundred Seventy-Three Dollars and Eighty-Five Cents ($46,973.85),
for a total contract amount of $131 ,246.24, attached hereto as Exhibit "A".
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The recitals contained In this resolution are
incorporated herein by reference.
Section 2. Approval of First Addendum to the Agreement. The First Addendum to the
Agreement with Marlin Engineering, Inc., attached hereto as Exhibit "A", be and the same, in an
amount not to exceed $46,973.85, for a total contract amount not to exceed $131,246.24, is
hereby approved.
Section 3. Authorization of Mayor. The Mayor is hereby authorized to execute Amendment
to Agreement.

Section 4. Authorization of City Manager. The City Manager is hereby authorized to all
things necessary to effectuate the terms of the agreement.
Section 5.
Effective Date. This Resolution will become effective upon adoption.

FIRST ADDENDUM TO CITY OF SUNNY ISLES BEACH
AND MARLIN ENGINEERING. INC. AGREEMENT
CONTRACT NO. C0708-019
THIS FIRST ADDENDUM TO THE MARLIN ENGINEERING, INC. AGREEMENT,
executed this ~day of November, 2007, is hereby attached to and is made a part of said Marlin
Engineering, Inc. Agreement Contract No. C0607-083 by and between the City of Sunny Isles Beach
("City") and Marlin Engineering, Inc. ("Contractor") a business corporation licensed in the State of
Florida, whose Federal Identification # is . The City and Contractor hereby agree as
follows:
1. ADDITIONAL SCOPE OF WORK: The City wishes to add to the original Marlin
Engineering, Inc. Agreement, to locate and plot all underground utilities on Sunny Isles Boulevard, and
replace the existing water main along the south side of the project, as more fully described in Attachment
'''A''.
2. COST: The Contractor agrees to charge Forty Six Thousand Nine Hundred Seventy Three
Dollars and Eighty Five Cents ($46,973.85) for said services.
3. TERM: The term of this Addendum shall begin upon the execution of this Addendum and shall
end six (6) months following the execution of this Addendum.
4. CONFLICTING PROVISIONS: If there is any conflict between any provision(s) of this First
Addendum and the original Contract No. C0607-083, the term(s) of this First Addendum shall prevail.
IN WITNESS WHEREOF, the parties hereto have executed this document as of the date
mentioned above.

Dear Mr. Conner:
We are pleased to provide this proposal for providing post design services for the subject construction
project as requested by the City. Enclosed are the Scope of Services and Fee Estimate for Marlin
Engineering, Inc. for Subsurface Utility Exploration and the Existing Water Main Replacement on the South
S ide of the Proj ect.
Below is an outline of scope, contract duration, subconsultants, and total fee proposal for this contract.
1. PURPOSE
Marlin Engineering Inc. will provide Post Design Services during construction for the State Road 826
Eastbound/Sunny Isles Boulevard Improvement Sidewalk Enhancement Project, Project No. 03-4122.D in
the City of Sunny Isles Beach, Miami-Dade County, Florida as outlined below.
2. SCOPE OF SERVICES
· Perform Subsurface Utility Exploration and Reports
· Replacement of the Existing Water Main along the South Side of the Project
For a detail of the staffhours for each task and activity, see the attached staff hour and fee estimate.
3. CONTRACT DURATION
The anticipated contract duration for these services and the basis for the attached fee estimate is 30 days.
4. FEE PROPOSAL
The total fee for the post design services is a unit hourly rate not to exceed the amount ofFortv Six
Thousand Nine Hundred Seventy Three dollars, and Eighty Five cents, $46,973.85. This fee will be invoiced
on a monthly basis. Additional services not included in the aforementioned scope of services and/or work
beyond the CONTRACT DURATION for required post design will require a separate Proposal.

Dear Mr. Conner:
As per our conversation please find our estimate for SUE required for the FPL underground. Our
estimate is based on the location of any new utility with the project limits and the verification of any
proposed crossing. Based on our understanding knew utilities have been introduced within the project
limits which may conflict with FPL proposed utilities. Our utility verification for this project will consist of
three levels which are:
Level One - Visual surface identification of any utilities not on our current design file.
Level Two - Sunshine state one call ticket and a cross reference with existing utilities identified by our
SUE records obtained in 2003 for the Sunny Isles Blvd rehabilitation.
Level Three - None destructive SUE for any utility identified by Sunshine State One Call and
not included in our 2003 records.
Anticipated number of locates are as follows based on current plans and FPL proposal:

EXISTING WATER MAIN REPLACEMENT
Dear Mr. Conner:
Marlin Engineering, Inc. is please to respond to your request for proposal for the referenced project.
1. PROJECT
Provide Consulting Civil Engineering Services for the plans design of an existing 12" water
main extension relocation along Sunny Isles Boulevard from approximately Sta. 121 + 10.00 to
Sta. 128+48 connecting to a newly constructed water main by others.
2. SCOPE OF WORK
1. Data Gathering and conferences with the City of Sunny Isles, and City of North
Miami Beach, as well as the regulatory agencies having jurisdiction on the project,
including Miami-Dade County DERM and WASD.
2. Obtain from others:
· Land Surveying necessary to determine the finish ground elevations and
other features (e.g. driveways, trees, electric poles and lights, catch basins,
etc.) along the alignment of the facilities being designed in general,
· Subsurface Utility Engineering (SUE).
3. Preparing water main replacement plan and profile drawings in accordance with the
City of North Miami Beach construction standards and specifications.
4. Dry-run and final plans submittal to City of North Miami Beach, Miami-Dade County
DERM and Department of Health (DOH) for processing and approval.
5. Preparing pertinent permit application forms and the required technical support
information for approvals before the City of North Miami Beach Engineering
Department, Miami-Dade County DERM. and DOH.
6. Preparing an Engineer's Estimate of probable Cost.
7. All permit and application fees and expenses required by reviewing agencies will be
paid directly by City of Sunny Isles Beach.
8. MEI will provide Twenty (20) sets of plans for dry-run and final process.

For the services performed under paragraph 2 Scope of Work, the Client will pay the Engineer
the unit hourly rate not to exceed the sum of Eighteen Thousand Nine Hundred Seventy Three
dollars, and Eighty Five cents ($18,973.85), as described below and payable monthly in
proportion to the services performed.

4. NOT INCLUDED
A- Bid Phase Services - Optional Services
· Document Review and meetings or discussions with the parties involved in this
process.
B- Construction Phase Services- Optional Services
· Pre-construction Conference.
· Shop Drawings and Technical Submittals. Requests for information (RFI) and Plan
Clarification. MEI will provide the necessary technical interpretations and
clarifications of the construction plans when requested by the Client.
· Site Visits, during the construction phase of this project.
Should the Client wish us to provide and/or negotiate with third parties, any of the
aforementioned services or any other additional work not included in this proposal under the
Scope of Work, MEI will provide it on a Time Charge plus Expenses basis, computed as the
sum of the following:
· Salary Costs times a multiplier of 3.00.
· Non-Salary expenses times a multiplier of 1.05
5. CLIENT RESPONSIBILITIES:
Provide access to and make all provisions for the Engineer to enter upon public and private
lands as required for the Engineer to perform his work under this proposal.

Place at the disposal of the Engineer all available information pertinent to the project upon
which the Engineer can rely, including previous reports, boundary and topographical survey,
and any other data related to the design and construction of the project.
Designate a person to act as the Client's representative with respect to the work to be
performed, such person to have complete authority to transmit instructions, receive
information, interpret and define the Client's policies and decisions with respect to the work
covered by this proposal.
6. ACCEPTANCE
The return of an executed copy of this proposal and completion of the fee negotiation
agreement would constitute our authorization to proceed.

Approval of an addendum to the contract with Marlin Engineering for
Subsurface Utility Exploration (SUE) on Sunny Isles Boulevard
RECOMMENDATION
We recommend that the City Commission approve an addendum to the contract with Marlin
Engineering for the design of improvements to Sunny Isles Boulevard, in an amount not to exceed
$46,973.85 for subsurface utility exploration to allow FP&L to move overhead electric lines to
underground locations.
REASONS
We have been working with Florida Power & Light for some time now to move their overhead
services to underground locations on Sunny Isles Boulevard. They have recently committed to the
project, and the timing is perfect considering we will soon be completely overlaying this segment of
the street. As part of this process, an SUE (the location of all other underground utilities) is needed.
We can wait for them to do it (one to two years) or we can do it for them and move this project to
completion. We are asking your approval to do so.
ADDmONAL INFORMATION
We did complete a plan of which this is part.
We already have the right to use the property.
The total cost of the project is estimated to be less than $50,000.
There will be no annual operation and maintenance costs.
The expected time for completion of the project is the Winter of 2007-2008.
Funding is available in Account Number 20-600-5622.

At its regular meeting of November 15, 2007, the City Commission adopted
Resolution No. 2007-1180, which approved the above-referenced agreement
with Marlin Engineering for additional services for Sunny Isles Boulevard.
Enclosed are three (3) original agreements for execution by you and two
witnesses. Upon completion, please return all three (3) originals to my attention
for further processing.
Upon execution by all parties, we will forward an original, executed agreement
and a copy of the approving resolution to you.
