A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AMENDING RESOLUTION
NO. 05-Z-92, EXTENDING THE TIME REQUIRED TO OBTAIN A
BUILDING PERMIT PURSUANT TO ZONING APPLICATION
SUBMITTED BY MULL Y SB L.L.C., (THE "APPLICANT"), (Z2007-
07), ON THE PROPERTY LOCATED AT 17141 COLLINS
AVENUE, IN ACCORDANCE WITH SECTION 265-11(L) OF THE
LAND DEVELOPMENT REGULATIONS; PROVIDING THE CITY
MANAGER WITH THE AUTHORITY TO DO ALL THINGS
NECESSARY TO EFFECTUATE THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Applicant received a development approval on December 8, 2005
(Resolution No. 05-Z-99 attached hereto as Exhibit "A"); and
WHEREAS, the Applicant's development approval expIres within twenty-four (24)
months from the date of approval; and
WHEREAS, Section 265-11 (L) requires an Applicant to secure a building permit within
24 months from date that the City Commission approved a development project; and
WHEREAS, the Applicant is requesting additional time to act upon its development
approval due to delays with the Department of Environmental Protection.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section I. Incorporation of Recitals. The recitals stated above are hereby incorporated herein.
Section 2. Extension of the Approval Period. The development approval issued to the Applicant
shall be extended for a time period not to go beyond March 15,2008.
Section 3. Authority of City Manager. The City Manager is hereby authorized to do all things
necessary to effectuate this Resolution.
Section 4. Effective Date. This Resolution is effective upon adoption.

Dear Mr. Solera:
On behalf of Mully SB, L.L.c., (the "Applicant"), the develop~r of the proposed Da
Vinci re.;idcntial project located at the above referenced address (the "PwjecC), Wt:: respectfully
submit this letter pursuant to your request for additional information regarding the reason for our
recent application for an extension of time to obtain a building permit for the Project. pursuant to
Resolution No. 05-Z-99.
As stated in our original letter of intent requesting an extension of time, we have
experienced delays in the processing of our Coastal Construction Control Line ("CCCL") permit
with the Florida Department of Environmental Protection ("FDEP"). In response to your request
for additional information in this regard, please find attached. as Exhibit "A", a copy of a

permitting process to date with FDEP. Please note that simultaneous to our proce~;sing of the
CCCL permit withFDEP, we have been processing our building permit plans with the City of
Sunny Isles Beach. As is indicated on the timeline prepared by the project architect, attached as
Exhibit "B", the initial submittals to Miami-Dade Fire Rescue. DERJvL and for dry run review at
the City were made in August of 2006 and application for a full building permit was submitted in
April of 2007. As of this date, we have received the approval L'f :..dl the various disciplines except
for the structural approval which we expect soon.
While City review of the building plans should be c;)inplete prior to the December 8,
2007 deadline, the City will not issue a building permit unle~;s FDEP has issued the CCCL
permit. TIle application file for the CCCL pelmit was detem'lined to be complete as of October
12, 2007 by Celora D. Jackson of the Bureau of Beaches and Coastal System of FDEP. The
CCeL permit is required to be issued within 90 days of October 12, 2007. As such, we expect

FDEP to issue the CCCL pelmit by mid-January of 2008. Accordingly, we expect the building
pern1it to be issued immediately following the issuance of the CCCL permit in mid-January,
2008.

Per our conversation I am providing a timeline of the permit submittals of the Da Vinci project
Submittal to Fire on August 8th 2006.
First round of comments for Fire and Derm submitted on October 19th 2006 (fire staging of building had to be modified to
adjust to Dade Fire rescue requirements for Fire staging).
Second round of comments for Fire and Derm submitted on December 26th 2006. (fire staging at the west elevation had to
be adjusted to comply with Fire and Dade Fire and Rescue department.)
The project was approved by the Fire Department on January 8th 2006
Submittal to Derm on August 8th 2006.
First Round of Derm comments submitted on October 25th 2006.
Second round of Derm comments submitted on December 8th 2006.
Third round of Derm comments submitted on April 11th 2007.
Derm was approved on April 4th 2007.
Submittal to Dry Run on August 2006.
First round of comments received on October 26th 2006 and addressed but not submitted
Second round of comments received on November 2nd 2006 and addressed but not submitted.
Third round of comments received on November 2nd 2006 and addressed but not submitted.
Fourth round of comments received on December 4th 2006 and addressed but not submitted

By Resolution No. 05-Z-99, adopted on December 8, 2005, Mully SB L.L.C., the
Applicant received site plan approval from the City Commission for the zoning
application Z2005-02. The approval required the Applicant to obtain a Building permit
within 24 months.
The Applicant in his Letter of Intent, indicated that the Florida Department of
Environmental Protection Coastal Construction Line Permit has been delayed. An
Extension Time Limit by the City Commission would allow the developer with time to
obtain a building permit. In the event the Commission does not approve the extension of
time, the developer will lose the development rights approved with the project.
Additionally, the developer will lose the requested bonuses approved by the City
Commission for the project.
Pursuant to Section 265-11 (L) the Applicant is requesting an extension of time to pull a
building permit.

At its regular meeting of November 15,2007, the City Commission adopted Resolution
2007-1170, which amended Resolution No. 05-Z-92 by extending the time required to
obtain a building permit for the proposed Da Vinci residential project, located at 17141
Collins Avenue.
