A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, DECLARING LEWIS J. THALER
AS COMMISSIONER SEAT 1, AND GEORGE "BUD" SCHOLL AS
COMMISSIONER SEAT 3, WHO WERE AUTOMATICALLY
ELECTED, HAVING NO OPPONENTS, FOR THE GENERAL
ELECTION WHICH WAS SCHEDULED ON TUESDAY, NOVEMBER
6,2007; DISCHARGING THE CANVASSING BOARD FOR SAID
GENERAL ELECTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach scheduled a General Election on Tuesday,
November 6, 2007; and
WHEREAS, City Resolution No. 2007-1132, designated Emanuel Pine to be the registered
voter to serve on the Canvassing Board with the City Manager, and City Clerk as Chairperson, for
the General Election; and
WHEREAS, the qualifying period for said Election was designated for Monday, September 10,
2007 at 9:00 a.m. to Thursday, September 13,2007 at 4:00 p.m.; and
WHEREAS, Lewis J. Thaler and George "Bud" Scholl were the sole candidates to qualify for
Commissioner Seat 1 and Seat 3, respectively; and
WHEREAS, Section 26-6 of the Sunny Isles Beach Municipal Code states that "pursuant to
Municipal Charter Section C-5.1(g), if at the close of the qualifying period there is only one duly
qualified candidate for Mayor or for any City Commission seat, that single candidate shall be
considered elected automatically"; and
WHEREAS, the Sunny Isles Beach Municipal Charter provides that "the term of office of any
elected official will commence on the 30th day following the day of the general or run-off election in
which he/she is elected, unless that day falls on a Saturday or Sunday, in which case it shall be the
next Monday immediately following, at 12 o'clock noon ("commencement term"), and will end at
midnight ofthe day before the commencement term."; and
WHEREAS, Lewis J. Thaler and George "Bud" Scholl are elected automatically to the
respective seats for which they have qualified, and their term of office will commence December 6,
2007, at 12 o'clock noon.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Declaring Automatically Elected. The City Commission of the City of Sunny Isles
Beach hereby declares that Lewis J. Thaler and George "Bud" Scholl are elected automatically to the
respective seats for which they have qualified, and their term of office will commence December 6,
2007, at 12 o'clock noon.

Section 2. Discharge of the Canvassing Board. The City Commission ofthe City of Sunny Isles
Beach hereby discharges the Canvassing Board being Emanuel Pine, Member; City Manager A. John
Szerlag, Member; and City Clerk Jane A. Hines, CMC, Chairperson, as the City of Sunny Isles
Beach's Canvassing Board for the November 6, 2007 General Election.
Section 3. Installation of New Officers. The City Clerk will administer the oath to Lewis J.
Thaler and George "Bud" Scholl as City Commissioners, at the December 6, 2007 Special City
Commission Meeting at 11 :30 a.m., and the new officers will be installed and shall enter upon the
discharge of their duties, effective thirty (30) days after the November 6, 2007 General Election.
Section 4.
Effective Date. This resolution shall become effective upon adoption.
PASSED AND ADOPTED this 15th day of November 2007.

A Resolution Declaring Lewis J. Thaler as Commissioner Seat 1, and George
"Bud" Scholl as Commissioner Seat 3; and Discharging the Canvassing
Board for the November 6, 2007 General Election
RECOMMENDATION:
It is requested that the City Commission adopt the Resolution declaring Lewis 1. Thaler and
George "Bud" Scholl automatically elected, and discharging the Canvassing Board for the
November 6, 2007 General Election.
REASONS:
The City Commission scheduled a General Election on Tuesday, November 6, 2007, via
Resolution No. 2007-1132, which also designated Emanuel Pine to be the registered voter to
serve on the Canvassing Board with the City Manager and City Clerk. The qualifying period for
the General Election was from Monday, September 10, 2007 at 9:00 a.m. to Thursday,
September 13,2007 at 4:00 p.m.
Lewis J. Thaler and George "Bud" Scholl were the sole candidates to qualify for Commissioner
Seat 1 and Seat 3, respectively. Therefore, pursuant to the City's Charter and Code, they are
elected automatically to their respective seats and will be installed at the December 6, 2007
Special City Commission Meeting, with term of office commencing on December 6, 2007 at
12:00 noon. Further, the Canvassing Board for the General Election may now be discharged
with thanks to Emanuel Pine.
