A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE
SECOND ADDENDUM TO THE AGREEMENT WITH MARLIN
ENGINEERING, INC. FOR THE SUNNY ISLES BOULEV ARD/
SR826 PROJECT, IN AN AMOUNT NOT TO EXCEED FORTY-
SEVEN THOUSAND SEVEN HUNDRED TWENTY DOLLARS
($47,720.00), ATTACHED HERETO AS EXHIBIT "A";
AUTHORIZING THE MAYOR TO EXECUTE SECOND
ADDENDUM TO THE AGREEMENT; AUTHORIZING THE
CITY MANAGER TO DO ALL THINGS NECESSARY TO
EFFECTUA TE THE TERMS OF THE AGREEMENT;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on June 21, 2007, the City Commission adopted Resolution No. 2007-1110
approving an agreement with Marlin Engineering, Inc., in an amount of Eighty-Four Thousand
Two Hundred Seventy-Two Dollars and Thirty-Nine Cents ($84,272.39), to provide Post Design
Services during the construction of the Sunny Isles Boulevard/SR 826 Project; and
WHEREAS, on November 15,2007, the City Commission adopted Resolution No. 2007-
1180 approving a First Addendum to the Agreement with Marlin Engineering, Inc., in an amount
not to exceed Forty-Six Thousand Nine Hundred Seventy-Three Dollars and Eighty-Five Cents
($46,973.85), to provide additional services by performing a Subsurface Utility Exploration
(SUE) so that FP&L can include the undergrounding of power lines, and to replace the existing
water main along the south side of Sunny Isles Boulevard; and
WHEREAS, the City wishes for the Consultant to provide additional services by
providing Post Design Services during construction to include: 1) construction for the State Road
826 Sidewalk Enhancement Project, and 2) design of the reconstruction sidewalk and the
installation of supplemental drainage system in the form of slotted drain at the northern right-of-
way limit; and
WHEREAS, Marlin Engineering, Inc. has submitted a proposal, and the City wishes to
accept the proposal modifying the agreement to include this work, in an amount not to exceed
Seventeen Thousand Four Hundred Fifty Dollars ($47,720.00), for a total contract amount of
$178,966.24, attached hereto as Exhibit "A".
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The recitals contained III this resolution are
incorporated herein by reference.
Section 2. Approval of Second Addendum to the Agreement. The Second Addendum to the
Agreement with Marlin Engineering, Inc., attached hereto as Exhibit "A", be and the same, in an

amount not to exceed $47,720.00, for a total contract amount not to exceed $178,966.24, is
hereby approved.
Section 3. Authorization of Mayor. The Mayor is hereby authorized to execute Amendment
to Agreement.
Section 4. Authorization of City Manager. The City Manager is hereby authorized to all
things necessary to effectuate the terms of the agreement.
Section 5.
Effective Date. This Resolution will become effective upon adoption.

SECOND ADDENDUM TO CITY OF SUNNY ISLES BEACH
AND MARLIN ENGINEERING, INC. AGREEMENT
CONTRACT NO. C0708-031
THIS SECOND ADDENDUM TO THE MARLIN ENGINEERING, INC. AGREEMENT,
executed this r'1~day of January, 2008, is hereby attached to and is made a part of said Marlin
Engineering, Inc. Agreement Contract No. C0607-083 by and between the City of Sunny Isles Beach
("City") and Marlin Engineering, Inc. ("Contractor") a business corporation licensed in the State of
Florida, whose Federal Identification # is . The City and Contractor hereby agree as
follows:
1. ADDITIONAL SCOPE OF WORK: The City wishes to add to the original Marlin
Engineering, Inc. Agreement, to provide post design services for (1) construction for the State Road 826
Sidewalk Enhancement Project, and (2) design of the reconstruction sidewalk and the installation of
supplemental drainage system in the form of slotted drain at the northern right of way limit, as more fully
described in Attachments "A" and "B".
2. COST: The Contractor agrees to charge the City an amount not to exceed $47,720.00 (forty
seven thousand seven hundred and twenty dollars) for said services.
3. TERM: The term of this Second Addendum shall begin upon the execution date of this Second
Addendum and shall end One Hundred Twenty (120) days thereof.
4. CONFLICTING PROVISIONS: If there is any conflict between any provisions of this Second
Addendum or any other documents, the terms of this Second Addendum shall prevai I.

Dear Mr. Conner:
We are pleased to provide this proposal for providing post design services for the subject construction
project as requested by the City. Enclosed is the Scope of Services and Fee Estimate for Marlin
Engineering, Inc. for the design of the reconstruction sidewalk and the installation of supplemental drainage
system in the form of slotted drain at the northern right of way limit (north back of sidewalk)
Below is an outline of scope, contract duration, subconsultants, and total fee proposal for this contract.
1. PURPOSE
Marlin Engineering Inc. will provide Post Design Services during construction for the State Road 826
Eastbound/Sunny Isles Boulevard Improvement Sidewalk Enhancement Project, Project No. 03-4122.D in
the City of Sunny Isles Beach, Miami-Dade County, Florida as outlined below.
2. SCOPE OF SERVICES
· Perform the design and contract plans preparation for the sidewalk reconstruction with
adverse slope to collect storm runoff at back of sidewalk,
· Design of a drainage storm collection system (slotted drain system) and prepare contract
plans for construction.
For a detail of the staff hours for each task and activity, see the attached staff hour and fee estimate.

CONTRACT DURATION
The anticipated contract duration for these services and the basis for the attached fee estimate are 120 days.
4. FEE PROPOSAL
The total fee for the post design services is a unit hourly rate not to exceed the amount of Seventeen
Thousands Four Hundred Fifty dollars, $17,450.00. This fee will be invoiced on a monthly basis. Additional

REGARDING:
Proposed Agreement with Marlin Engineering for the design services on
the Newport Fishing Pier Demolition and Reconstruction
Per your request, I have reviewed the proposal Marlin Engineering has submitted for the
design of the replacement of the Newport Fishing Pier.
I feel that this proposal is very much compatible with the current market. In addition, it
will save us three to four months minimum by not having to go through the typical
qualification process (which in this case would be redundant anyway).

At its regular meeting of January 17, 2008, the City Commission adopted
Resolution No. 2008-1199, which approved a Second Addendum to the Sunny
Isles Boulevard Project. Enclosed are two (2) original Addendums for execution
and witnessing by Marlin Engineering, Inc.
Upon execution, please return both originals to my attention for final processing.
An original, executed agreement and a copy of the approving resolution will be
mailed to you upon completion.
