A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A
PAY PLAN FOR SWORN POLICE OFFICERS;
ESTABLISHING EFFECTIVE DATE OF PAY PLAN;
PROVIDING FOR PERIODIC REVIEW OF PAY PLAN,
ATTACHED HERETO AS EXHIBIT "A'; PROVIDING THE
CITY MANAGER WITH THE AUTHORITY TO DO ALL
THINGS NECESSARY TO EFFECTUATE THE TERMS OF
THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, since inception the City Commission has expressed its desire to have and
maintain a first-rate police department; and
WHEREAS, the City wishes to remain competitive with neighboring municipalities in order
to attract, keep, and retain qualified officers; and
WHEREAS, the City's current Police Pay Plan has been found to be below average as
compared to surrounding communities; and
WHEREAS, the City Commission is desirous of revising it Police Pay Plan in an effort to
bring the Police Department first to parity with other communities and then to the 75th percentile of
the Police Pay Plan; and
WHEREAS, the City Commission wishes to approve a new Pay Plan for sworn police
officers, attached hereto as Exhibit "A".
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of the Sunny Isles Beach Police Department Pay Plan. The City
Commission hereby approves the Pay Plan to maintain a first class Police Department in the City of
Sunny Isles Beach, attached hereto as Exhibit "A".
Section 2. Effective Date of Pay Plan. The City Commission hereby authorizes the City
Manager to implement this Pay Plan no later than the first pay period in March, 2008.
Section 3. Periodic Review of Pay Plan. The City Commission hereby instructs the City
Manager to review the Pay Plan discussed herein every two (2) years from the effective date. The
City Manager shall provide the City with a report no later than thirty (30) days from the date of
review to confirm whether the pay plan is in need of recalibration.

Section 4. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate the terms of this Resolution.
Section 5.
Effective Date. This Resolution shall become effective upon passage.

* After 1 year of initially being maxed out, an employee will receive a lump'sum payment equivalent to the same
percentage increase that the City Manager secures for general employees as authorized by the budgetary
process, This lump sum payment will not be included to base salary, Subsequently after 1 year should the
employee receive a calibrated step adjustment and remain maxed out, if the adjustment is less than the merit
pay authorized for general employees, the employee will receive an additional lump sum payment in the amount
of the difference,
Note: The Pay Plan will be calibrated every 2 yrs using the same benchmark cities.
Also, please know that the pay levels shown above are calibrated on a net pay basis which factors in
base salary, shift differential, longevity, and COLA, Also factored in were deductions for insurance
and retirement,

Pay Increases to Maintain First Class Police Department
I have been advised that an overwhelming majority of Police Officers and Sergeants have agreed
to a pay plan as outlined in my January 30, 2008 memoranda which is attached. As such, this
will be an agenda item for the February Commission meeting.
On a personal note, I wish to thank you for your support which allowed an expedient resolution
to this most important matter.

Pay Increases to Maintain First Class Police Department
Executive Summary
Compared to surrounding communities, the pay rate for Police Officer and Sergeant is below
average. This situation is discordant with our philosophy of offering competitive pay and
benefits so as to maintain a First Class Police Department. The matrix below indicates the annual
pay increase required to bring the Police Department first to parity with other communities, and
then to the 75th percentile, which I define as a competitive rate.

Please know that the pay levels shown above are calibrated on a net pay basis which factors in
base salary, shift differential, longevity, and COLA. Further, we also took into consideration
employee deduction for insurance, and retirement. The result of what we wanted to achieve
would be an indication of someone's take-home pay in comparison to other communities. As a
point of information, Sunny Isles Beach does not have shift differential, we do not have
longevity, and we do not have COLA. However, we also don't have a deduction for retirement
benefits which compares favorably to other cities. So, by taking all of this into account, we're
still low based on the comparable cities of Aventura, Surfside, Bal Harbour, and Hallandale
Beach. You should also know that in Sunny Isles Beach it currently takes 7 years to achieve the
maXImum pay.
As you may recall, we eliminated 6 sworn personnel from the fiscal year 2007/08 budget. In
addition to that, we are currently down another 6 sworn officer positions which we are now
attempting to fill. And in terms of retaining and attracting high-quality personnel, I think it's
important not only to achieve parity with surrounding communities, but to be compared
favorably. As such, I propose that we pay Police Officers and Sergeants to the 75th percentile. I
also believe we should re-examine our pay policy every two years so as to maintain a
competitive edge. Given this, the annual aggregate increase in payroll for our budgeted 35 Police
Officers and 9 Sergeants comes to approximately $483,000.
It's going to take a budget amendment from the general fund balance to affect this
recommendation. However, the amount of the amendment for Fiscal Year 2007/08 is $282,000
because retroactivity is not applicable.
Recommendation for salary increase of Captains
Sergeants supervise Patrol Officers; and Captains supervise Sergeants. Police Officers and
Sergeants get over-time; Captains don't, although they work a lot of it. In addition, Captains in
Sunny Isles Beach are one rank below Chief, and thus also function in the capacity of Assistant
Chief. And using the same communities to draw a pay comparison, our Captains are also
underpaid. Refer to the matrix below:

The mechanics of this recommendation
Pay increases for Patrol Officer, Sergeant, and Captain will take effect the first pay period in
March, with no retroactivity involved. The pay plan will be calibrated to reflect 8 steps for Patrol
Officer which means it takes 7 years to reach the maximum pay. However, I'm proposing that
we reduce the number of steps for Sergeant from 8 to 6 so that instead of taking 7 years to reach
maximum pay, it takes 5 years. Once Police Officers and Sergeants are maxed out on the pay
scale, they will receive a lump sum payment equivalent to the same percentage increase that the
City Manager secures for general employees as authorized by the budgetary process. This lump
sum payment will not be included to base salary. (See attached).
There is no step plan for Captains as they are exempt management personnel, and their pay is
dependent upon the Chiefs evaluation of their performance as well as budgetary considerations.
Fact finding methodology
Using an "interest based" approach to address this issue, I developed a joint committee
consisting of management and sworn personnel to develop a unified list of comparable cities and
a singular interpretation of pay/benefit data. This process saved a great deal of time and
aggravation, and I'm deeply indebted to this committee which consisted of the following

Dear Mr. Szerlag:
Please let this letter serve as your written confinnation that the Police Officers,
Detectives and Sergeants overwhelmingly accepted the salary increases as outlined in the
step pay plan developed by you and your staff. The step pay plan you proposed used the
data complied by the "interest based" joint compensation committee and placed the
salaries for the police officers and sergeants at the seventy fifth percentile for take home
salary.
Approximately twenty-five members of the department attended the meeting held
in the City commission chambers earlier this morning.
I intend on attending the City commission meeting on February 21, 2008 were it
is our understanding that the pay package will be presented for Commission approval. I
look forward to seeing you there.
On behalf of the members of the police department I would like to thank you,
ChiefMaas and your entire staff for their assistance and support in this matter.

At its regular meeting of February 21, 2008, the City Commission adopted Resolution No.
