FOR EMERGENCY DEBRIS DISPOSAL MANAGEMENT SERVICES, IN RESPONSE TO REQUEST FOR QUALIFICATIONS NO. 07-10-01, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED THREE THOUSAND SIX HUNDRED SIXTY DOLLARS ($103,660), ATTACHED HERE)'O AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUA TE THE TERMS OF THE AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach issued Request for Qualifications No, 07-10-01 for Emergency Debris Disposal Management Services to the City; and WHEREAS, the City received four (4) responses to said RFQ, which have been reviewed by staff; and WHEREAS, staff has determined that the firm of Solid Resources, Inc. is the most responsive responsible response; and WHEREAS, the City wishes to enter into an agreement with Solid Resources, Inc. for Emergency Debris Disposal Management Services, in an amount not to exceed One Hundred Three Thousand Six Hundred Sixty Dollars ($103,660.00), attached hereto as Exhibit "A". NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Agreement. The agreement with Solid Resources, Inc. for Emergency Debris Disposal Management Services, in an amount not to exceed One Hundred Three Thousand Six Hundred Sixty Dollars ($103,660.00), attached hereto as Exhibit "A", be, and the same, is hereby approved. Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said Agreement. Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate the terms of this Agreement. Section 4. Effective Date. This Resolution will become effective upon adoption. AGREEMENT CONTRACT NO. 0708-042 THIS SERVICE AGREEMENT ("Agreement") entered into this~~day of February 2008, by and between the CITY OF SUNNY ISLES BEACH (hereinafter referred as to "City"), a municipal corporation of the State of Florida, and, sQLiD RESOURCES INC. authorized to do business in the State of Florida (hereinafter referred to as "Consultant"), whose Federal 1.0. # is 6s-1 / c:J,J7Ibd- . RECIT ALS WHEREAS, the City wishes to employ Consultant to provide FEMA acceptable monitoring of disaster generated debris management and technical assistance, and manage the debris removal in the event of a natural disaster, as more particularly described in Attachment "A" which is attached hereto and made a part hereof; and WHEREAS, the Consultant is qualified, willing and able to provide the desired services on the terms and conditions set forth herein; and WHEREAS, the City desires to enter into an Agreement with Consultant to provide the Services in a total amount not to exceed One Hundred Three Thousand Six Hundred Sixty Dollars ($103,660.00); and NOW THEREFORE, in consideration of the premIses and the mutual covenants herein names, the parties agree as follows: TERMS 1. RECIT ALS: The recitals set forth above are hereby incorporated into this Agreement and made a part hereof. 2. SERVICES: Consultant agrees to furnish all labor and materials in a good workmanlike and professional manner and to perform the Services designated in Attachment "A" attached hereto, and incorporated herein by reference. The Services shall be performed by Consultant to the full satisfaction of the City. Consultant agrees to have a qualified representative to audit and inspect the Services provided on a regular basis to ensure all Services are being performed in accordance with the City's needs and pursuant to the terms of this Agreement, and shall report to the City accordingly. Consultant agrees to immediately inform the City via telephone and in writing of any problems that could cause damage to the City's property, improvements and persons. Consultant will require its employees to perform their work in a manner befitting the type and scope of work to be performed. In the event that the Consultant fails to complete the Services pursuant to the terms of this contract and City must undertake the completion of performance of Services, Consultant agrees to indemnify the City for all costs incurred with respect to the completion of those Services and any damages the City may suffer as a result of the Consultant's failure to perform the Services. Payment to Consultant for all charges and tasks under this Agreement shall be in accordance with this Agreement and the schedule of charges reflected in Attachment "A", which fee shall be disbursed on a monthly basis and under the following conditions: a. Oisbursements. There are no reimbursable expenses associated with this contract. b. Payment Schedule. Invoices received from, the Consultant pursuant to this Agreement will be reviewed by the initiating City Oepartment. If services have been rendered in conformity with the Agreement, the invoice will be sent to the Finance Department for payment. Invoices must reference the contract number assigned hereto. Invoices will be paid in accordance with the State of Florida Prompt Payment Act. c. Availability of Funds. The City's performance and obligation to pay under this Agreement is contingent upon an annual appropriation for its purpose by the City Commission. d. Final Invoice. In order for both parties herein to close their books and records, the Consultant will clearly state "final invoice" on the Consultant's final/last billing to the City. This certifies that all services have been properly performed and all charges and costs have been invoiced to the City. Since this account will thereupon be closed, any other additional charges, if not properly included on this final invoice, are waived by the Consultant. Consultant shall make no other charges to the City for supplies, labor, taxes, licenses, permits, overhead or any other expenses or costs unless any such expense or cost is incurred by Consultant with the prior written approval of the City. If the City disputes any charges on the invoices, it may make payment of the uncontested amounts and withhold payment on the contested amounts until they are resolved by agreement with Consultant. Consultant shall not pledge the City's credit or make it a guarantor of payment or surety for any contract, debt, obligation, judgment, lien, or any form of indebtedness. The Consultant further warrants and represents that it has no obligation or indebtedness that would impair its ability to fulfill the terms of this Agreement. 4. UNDISCLOSED CONDITIONS: In the event that undisclosed conditions are discovered during the performance of this Agreement, the City shall have the right to cancel this Agreement upon ten (10) days written notice to Consultant. Upon termination, the City may re-bid the project if the Consultant fails to perform under this Agreement due to the undisclosed conditions. 5. INSURANCE: Consultant shall, at its sole cost and expense, during the period of any work being performed under this Agreement, procure and maintain the following minimum insurance C0708-042 Solid Resources Inc. Agreement 2 ~ I City of Sunny Isles Beach 18070 Collins Avenue, Sunny Isles Beach, Florida 33160 (305) 947-0606 phone (305) 949-3] 13 Fax coverage to protect the City and Consultant against all loss, claims, damage and liabilities caused by Consultant, its agents, sub-Consultants or employees, as indicated below: o Comprehensive General liability insurance, including broad form contractual liability coverage for all operations, including, but not limited to, contractual, products, and completed operations, personal injury and property damage liability with minimum limits of One Million Dollars ($1,000,000) per occurrence and Two Million Dollars ($2,000,000) aggregate. o Worker's Compensation, as required by law, but with no less than $1,000,000 for Employer's Liability. o Business Automobile Liability which shall include coverage for all owned, non-owned and hired vehicles for minimum limits of not less than One Million Dollars ($1,000,000) per occurrence, One Million Dollars ($1,000,000) per accident for bodily injury and Five Hundred Thousand Dollars ($500,000) per accident for property damage. o Professional Liability (errors and omissions) insurance, with a combined single limit of not less than One Million Dollars ($1,000,000.00) per occurrence. o Umbrella/Excess Liability coverage in addition to the foregoing limits that when combined with the foregoing limits provide total coverage of at least Five Million Oollars ($5,000,000). Insurance required of the Consultant shall be primary to, and not contribute with, any insurance or self- insurance maintained by the City. Such insurance shall not diminish Consultant's indemnification and obligations hereunder. The insurance policy(ies) shall be issued by companies authorized to do business under the laws of the State of Florida and acceptable to the City with a minimum A.M. Best rating of A-Excellent. Before any work under this Agreement is performed, and at any time upon request, Consultant shall furnish to the City certificates of insurance evidencing the minimum required coverage and shall be appropriately endorsed for contractual liability, with the City named as additional insured. All policies shall contain a waiver of subrogation endorsement. All policies and certificates shall be in forms and issued by insurance companies acceptable to the City's Risk Management Department. All insurance policies and certificates of insurance shall provide that the policies may not be canceled or altered without thirty (30) days prior written notice to the City. The City reserves the right from time to time to change the insurance coverage and limits of liability required to be maintained by Consultant hereunder. C0708-042 Solid Resources Inc. ANY EXCEPTIONS TO THE INSURANCE REQUIREMENTS IN THIS SECTION MUST BE APPROVED IN WRITING BY THE CITY. 6. OWNERSHIP OF DOCUMENTS: The parties agree that all documentation and work product produced pursuant to this Agreement shall become the exclusive property of the City and shall be provided to the City upon request. 7. INDEPENDENT CONSULT ANT RELATIONSHIP: It is understood and agreed that nothing contained in this Agreement shall be deemed to create a partnership, joint venture, other association, or an employer/employee relationship between the Consultant and the City. Consultant shall be in the relation of an independent Consultant and is to have entire charge, control and supervision of the work to be performed hereunder. 8. COMPLIANCE WITH LAW: Consultant shall comply with all laws, regulations and ordinances of any federal, state, or local governmental authority having jurisdiction with respect to this Agreement ("Applicable Laws") and shall obtain and maintain any and all material permits, licenses, approvals and consents necessary for the lawful conduct of the activities contemplated under this Agreement. Specifically, Consultant shall comply with all applicable conflict of interest provisions as provided in state statutes, Miami-Oade County Code and the Code of the City of Sunny Isles Beach (Section 62-16 entitled "Ethics in Public Contracting"). As provided in Section 62-16, Code of the City of Sunny Isles Beach, the City Commission may terminate this Contract for violation of the above-referenced ethical standards. 9. INDEMNIFICATION AND WAIVER OF LIABILITY: The Consultant agrees, to the fullest extent permitted by law, to defend, indemnify and hold harmless the City, its agents, representatives, officers, directors, officials and employees from and against claims, damages, losses and expenses (including but not limited to attorney's fees, arbitration costs, and costs of appellate proceedings) relating to, arising out of or resulting from the Consultant's negligent acts, errors, mistakes or omissions relating to professional services in the performance of this Agreement. The Consultant's duty to defend, hold harmless and indemnify the City, its agents, representatives, officers, directors, officials and employees shall arise in connection with any claim, damage, loss or expense that is attributable to bodily injury; sickness; disease; death; or injury to impairment, or destruction of tangible property including loss of use resulting therefrom, caused by any negligent acts, errors, mistakes or omissions related to professional services in the performance of this Agreement C0708.042 Solid Resources Inc. The parties agree that ONE HUNORED OOLLARS ($100.00) represents specific consideration to the Consultant for the indemnification set forth in this Agreement. The Consultant hereby acknowledges receipt of ONE HUNORED OOLLARS ($100.00) and other good and valuable consideration from the City in exchange for giving the City the indemnification provided herein. 10. ASSIGNMENT: This Agreement shall be binding upon and shall inure to the benefit of the City and to any and all of its successors and assigns, whether by merger, consolidation, transfer of substantially all assets or any similar transaction. Notwithstanding the foregoing, this Agreement is personal to the Consultant and it may not, either directly or indirectly, assign its rights or delegate its obligations to City hereunder without first obtaining the City's consent in writing. Any such attempted assignment or delegation shall be deemed of no legal force and effect whatsoever. 11. TERM: The term of this Agreement shall begin upon the execution of this Agreement and is divided into three major services. Task 1 is the development of an emergency debris management plan and obtaining of FEMA approval. Task 2 is the development of an RFP to guarantee the services of a professional debris removal company. Task 3 is the management of debris removal in the event of a natural disaster. Task 1 and 2 shall end no later than August 31, 2008, and Task 3 shall be undertaken on an as need basis, as more particularly described in Attachment "A" which is attached hereto and made a part hereof. Payment will be made only for work completed to the satisfaction of the City. Consultant is to commence performance of work on the Commencement Oate and continue in a diligent manner until work is complete. Consultant acknowledges that compliance with the commencement and completion schedule is the essence of this Agreement. The terms of Sections 8 and 9 entitled "Compliance with Law" and "Indemnification and Waiver of Liability," respectively, shall survive termination of this Agreement. 12. TERMINATION: A. Termination for Cause. If, through any cause within its reasonable control, the Consultant should fail to fulfill in a timely manner or otherwise violate any of the covenants, agreements or stipulations material to this agreement, the City shall have the right to terminate the services then remaining to be performed. Prior to the exercise of its option to terminate for cause, the City shall notify the Consultant of its violation of the particular term(s) of the agreement and grant Consultant ten (10) days to cure such default. If the default remains uncured after ten (10) days the City may terminate this agreement and the City shall receive a refund from the Consultant in an amount equal to the actual cost of a third party to cure such failure. In the event of termination, all finished and unfinished documents, data and other work product prepared by Consultant (and sub consultant(s)) shall be delivered to the City and the City shall compensate the Consultant for all services satisfactorily performed prior to the date of termination, as provided in Paragraph 3 herein. (ii). Notwithstanding the foregoing, the Consultant shall not be relieved of liability to the City for damages sustained by it by virtue of a breach of the agreement by Consultant and the City may reasonably withhold payments to Consultant for the purposes of set- off until such time as the exact amount of damages due the City from the Consultant is determined. B. Termination for Convenience of City. The City may, for its convenience and without cause, terminate the services then remaining to be performed at any time by giving written notice which shall become effective seven (7) days following receipt by Consultant. The terms of Paragraphs 12 A (i) and (ii) shall be applicable hereunder. C. Termination for Insolvency. The City also reserves the right to terminate the remaining services to be performed in the event the Consultant is placed either in voluntary or involuntary bankruptcy or makes any assignment for the benefit of creditors. O. No Lost Profits/Consequential Damages. In no event shall the City be obligated to compensate consultant for lost profits or consequential damages. 13. NOTICES: All notices and other communications required or permitted to be given under this Agreement by either party to the other shall be in writing and shall be sent (except as otherwise provided herein) (i) by certified or registered mail, first class postage prepaid, return receipt requested, (ii) by guaranteed overnight delivery by a nationally recognized courier service, or (iii) by facsimile with confirmation receipt (with a copy simultaneously sent by certified or registered mail, first class postage prepaid, return receipt requested or by overnight delivery by traditionally recognized courier service), addressed to such party as follows: If to the City: A. GOVERNING LAW: The validity of this Agreement and the interpretation and performance of all of its terms shall be construed and enforced in accordance with the laws of the State of Florida, without regard to principles of conflict of laws thereof. The location of any legal action or proceeding commenced under or pursuant to this Agreement shall be in Miami-Dade County, Florida. 15. ARBITRATION: It is the intention of the parties that whenever possible, if a dispute or controversy arises hereunder then such dispute or controversy shall be settled by arbitration in accordance with the procedures, rules and regulations of the American Arbitration Association. The decision rendered by the Arbitrator shall be final and binding upon the parties and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. Arbitration shall be held in Miami-Dade County, Florida. All costs of arbitration and attorneys' fees incurred by the parties shall be paid by the non-prevailing party or, if neither party prevails on the whole, each party shall be responsible for a portion of the costs of arbitration and their respective attorneys' fees as may be determined by the court on confirmation. 16. INCORPORATION INTO AGREEMENT: The City's Request for Qualifications No. 07 -10-01, as well as the Consultant's Response thereto, are expressly incorporated into this Agreement by this reference. 17. MISCELLANEOUS: A. In the event any provision of this Agreement is found to be void and unenforceable by a court of competent jurisdiction, the remaining provisions of this Agreement shall nevertheless be binding upon the parties with the same effect as though the void or unenforceable provisions had been severed and deleted. B. This Agreement may be executed in multiple identical counterparts, each of which shall be deemed an original for all purposes. C. This Agreement shall constitute the entire agreement between the parties with respect to the subject matter hereof, and it shall supersede all previous and contemporaneous oral and written negotiations, commitments, agreements and understandings relating hereto. D. Any modification of this Agreement shall be effective only if in writing and signed by the parties to this Agreement. C0708-042 Solid Resources Inc. No waiver of any provision of this Agreement shall be valid or enforceable unless such waiver is in writing and signed by the party granting such waiver. 18. CONFLICTING PROVISIONS: The terms and conditions in this Agreement supersede any other conflicting provisions that are contained in any other document. This included supervision of up to 182 employees providing administrative/data management, field supervision, and field monitoring services. She oversaw the preparation of daily status re- ports, interim status reports, and the after action report. She provided technical expertise to county personnel on debris cleanup strategies and FEMA guidelines through daily coordination meetings. Her role involved en- suring accurate recordkeeping for debris collection and monitoring services to maximize FEMA reimburse- ment, conducting daily meetings with the debris contractor to ensure collection operations met contractual ob- ligations as well as county deadlines and coordinating with the county's Code Enforcement department to re- solve ineligible debris clean-up. Ms. Storz has 15 years of experience working for local government in the field of solid waste management. As the Solid Waste Management Coordinator for Washington County, Oregon, she managed the Cooperative Recycling Program, a consensus coalition of 11 cities and the unincorporated county areas. Her areas of ex- pertise include disaster management, public policy development, program development, program implementa- tion and franchise negotiation. He is an experienced trainer and has been involved, at ground zero, in numerous post-disaster debris management situations. The following subtasks are envisioned to de elop the final Debris Management Plan: Needs Assessment: A Needs Assessment will be conducted that will include the following services: . Perform a three day on-site visit with City of Sunny Isles Beach staff to conduct interviews with key emer- gency management, public works, and solid waste management staff. . Review of the City's existing emergency management plans. . Review of the existing debris removal and disposal contracts. . Review of the existing Standard Operating Procedures. . Develop a written report describing the results of the Needs Assessment. . Conduct an on-site briefing to make recommendations based on the assessment findings. Debris Management Plan Development and Approval Process SRl will prepare a comprehensive Debris Management Plan based on the information gathered during the Needs Assessment. The plan will address the City's ability to respond to a disaster event based on personnel and equipment; and be consistent with the City's Comprehensive Emergency Management Plan. The plan will address the management and operational structures needed to prepare for, respond to and recover from either a natural or man-made (terrorist) debris-generating disaster event. The draft plan will be submitted to City staff for review and revised as required. Mr. Swan will assist the City in submitting the finalized Debris Manage- ment Plan to FEMA Region IV for their review and approval. Task 2. Develop a Request for Proposals for Debris Removal and Disposal Mr. Swan has developed detailed Requests for Proposals (RFP) for Debris Removal and Disposal for clients that have been used successfully in obtaining the services of qualified debris removal and disposal contractors. Mr. Swan will work closely with the City's contracting and legal staff to ensure that the RFP meets local and state procurement and legal requirements. The detailed Scope of Services required will conform to FEMA re- quirements, as outlined in the Debris Management Plan. Mr. Swan will assist the City to review the RFP re- sponses and assist in the identification and selection of pre-qualified contractors based on the current FEMA Pilot Program guidance. Task 3. Provide Debris Removal Management Services SRl follows the Incident Command System (ICS) protocol commonly used by other responders and agencies during recovery efforts. This structure, refmed as a result of SRl' s experience during the past 15 years in Flor- ida, ensures clear reporting relationships and eliminates confusion. SRl will mobilize a debris management project team sufficient to match the size and scale of the City's debris recovery effort. The fIrst step to any new project is to review the services the client expects and to make recommendations on what is needed pre-disaster, as well as after the storm. In order to ensure the City's debris management team is fully prepared to initiate a successful debris removal project, SRI will advise and train the City's selected staff in essential debris management and monitoring functions. SRI personnel will review load ticket protocol, collection vehi- cle standards and compliance factors, debris zone maps and procedures, reporting and documentation require- ments, obtain a list of Federal-Aid roads eligible for reimbursement by the Federal Highways Administration, review data reporting templates, discuss TDSR site preparations, and review current FEMA debris eligibility criteria and policy matters, among other vital tasks. Solid Resources, Inc. will work closely with City and state and federal emergency management agencies to monitor and expedite the cleanup of the disaster debris and to maximize reimbursements and fInancial assis- tance from granting agencies, such as FEMA and FHW A. In every contract, establishing procedures for com- munication, planning, performance monitoring, quality and cost control have proven key to a project's success. SRI will provide superior services by assessing and evaluating the City's unique pre- and post-disaster situa- tion including details into debris collection, communications, contracts, regulations and operational proce- dures. SRI will provide core management personnel responsible for all facets of debris management and will provide a Project Manager to be in consistent contact with City's Debris Manager, Emergency Operation Center, col- lection contractors, fIeld monitors and work crews. All disposal sites will be reviewed and the measurement, certifIcation and placarding of the debris removal contractor's trucks will begin as soon as trucks have arrived. SRI will also assist the City as needed with obtaining any necessary permits, licenses or certifIcates. SRI will initiate the truck certifIcation program in coordination with the debris removal contractors to accu- rately measure the volumetric capacity of each truck. SRI can supply certification forms which include the lat- est FEMA guidelines for measuring trucks. We will photograph each truck, attach a certifIcation placard to it, note any unique sideboards or tailgates which TDSR site managers should be alert to, and inspect the trucks to make sure they comply with minimum local, State and Federal standards. SRI also will periodically spot check and recertify trucks in order to prevent alteration of the volumetric capacity post-certification. SRI will manage the inspection of the disposal or unloading sites by providing monitors qualifIed to verify load capacity in order to provide accurate documentation and record keeping. At least two disposal site moni- tors will be assigned to each temporary or fmal disposal site the City designates. SRI will perform on-site, street-level loading area inspection and documentation of debris cleanup and collection. SRI will provide an adequate number of fIeld monitors to inspect and control debris collection (quantity dependent on the severity of the event and # of crews) utilizing manifest load tickets, field logs and other documentation as required. SRI will assist the City in the establishment of a contractor Damage Reporting and Remediation Program. Our monitors are trained to document and immediately report any damages to private resident property which oc- cur during the collection of debris, such as to mailboxes, cars, yards or other items. Each incident is docu- mented with photographs, logged on field reports and called into SRI management personnel, who in turn alert the debris removal contactor(s) and the City to the issue. SRI will facilitate daily meetings between the City, SRI and the debris removal contractor management staff each afternoon to report progress, review collection strategies, coordinate efforts, resolve problematic issues and make any necessary adjustments and improvements to operational procedures. SRI monitors and managers can greatly facilitate the debris removal program by mapping out where debris remains, locating 'hot spots' for immediate collection, marking ineligible debris piles and tracking progress for pass completions and zone clo- sures. This information can be used by contractors to plan collection strategies, and by City managers to track progress and report to the media. All data are then entered into the SRI database, which will later provide supporting invoice detail to ensure successful reimbursement from funding agencies. SRI will implement and maintain a disaster debris data management tracking software system that: . Ensures proper storage and organization of debris collection debris data; . IDENTIFICATION OF A SIGNIFICANT PROJECT ISSUE As was discovered during the 2004 and 2005 hurricane seasons, one of the main issues that can develop during the course of a disaster debris removal operation is the accurate monitoring and tracking of debris removed from Federal-Aid (FA) eligible roads. PRACTICALITY OF APPROACH Working from the Keys to the Panhandle, the practicality of the Solid Resources' technical approach has been demonstrated following the impacts of eight hurricanes in Florida during 2004 and 2005. Other debris manage- ment firms have mimicked SRI's use of the Incident Command System structure to mobilize, adjust and demo- bilize debris monitoring resources. The use of similar techniques by competing firms provides positive confir- mation that the SRI approach is practical in a real emergency situation and that its comprehensive but flexible structure provides a superior degree of quality control, minimizes monitoring costs and provides for rapid and complete reimbursement of all eligible debris removal costs. Daily processing and data entry of all load tickets, combined with daily mapping of the status of the debris re- moval activities is the most practical methodology to ensure successful reconciliation of load tickets and in- voices, while providing debris removal status updates to the City and its citizens. ABILITY TO HAVE STAFF READILY AVAILABLE SRI has a proven track record of responding immediately to our clients' emergency needs. In most instances we have had key management personnel positioned at disaster sites within 12-24 hours of a storm event, ready to assist with coordinating and monitoring the critical first push of debris from high priority roadways. If a storm event threatens southeastern Florida, SRI will plan to assign a Project Manager to the City of Sunny Isles Beach's Emergency Operations Center or Debris Management Center 24 - 48 hours before a storm sys- tem makes landfall. Within 24 hours of the Notice to Proceed, all key management personnel and first push roadway monitors will be mobilized to the City. Within 72 hours of the event, all trained roadway, disposal site and supervisory monitors, in numbers appropriate to the disaster event and as directed by the City, will be in position and ready to work. SRI will assign a Project Manager as the Department's Debris Manager's primary point-of-contact for the du- ration of the project. The Project Manager will be responsible for all SRI personnel and services provided, will also prepare reports on debris collection activities and will oversee all project activities. The staff listed in Standard Form 330 will be committed to, and available to the City of Sunny Isles Beach throughout the course of each hurricane season during the contract period. While other firms utilize inexperienced employees from temporary staffing agencies during emergency situa- tions, SRI maintains a cadre of over 800 experienced and trained disaster debris management and monitoring professionals who are on-call and available for immediate deployment. Employees and new hires residing in Miami-Dade County and its surrounding areas will be given fust hiring preference during the course of this project. Rick Conner, City Engineer/Public Works Director, introduced himself and proceeded to explain the RFQ. Rick Conner stated that the City of Sunny Isles Beach ("City") is looking for a firm that can guide us through the bureaucracy, that can take us through the steps needed to get all the money due to us from FEMA in case of a disaster, and that can clean up the city in a safe and timely maimer. It was eXplained that the City wants the firm to be able to do three things: (1) develop an approved Debris Management Plan; (2) help the City prepare a Request for Proposals for Debris Removal; and (3) manage and execute the process in the event that we have to take those steps. Rick Conner proceeded to explain the scoring sheet and suggested that the firms strictly follow the criteria set forth in the scoring sheet. The firms should consider using the numbering system as it is shown on the scoring sheet. QUESTIONS. 1. The packet asks for the proposal to be submitted in a "soft cover stack." All projects related to this request for Proposal. 4. Does the City have a Solid Waste Department or is the disposal contracted out? It is contracted out. Regarding item 5a in the scoring sheet under the Scoring Narratives, should we give a description of the reimburse- ments? @ Yes. Just something describing the firm's effectiveness of requesting and receiving reimbursements. Will there be a Cone of Silence and will questions asked be addressed and forwarded to the interested parties? The Cone of Silence ordinance was repealed by this city approximately five years ago. By going through the steps in this proposed contract, not only will we maximize the return from FEMA for the cleanup, but FEMA will pay for their services as well. We reviewed the submittals of several qualified companies, and the five raters (City staff) clearly chose Solid Resources. We are therefore asking you to approve an hourly contract with an not-to-exceed limit of $103,660. REASONS If approved, this contract will require Solid Resources to provide the following three major services: 1) Develop an Emergency Debris Management Plan and obtain FEMA approval. 2) Develop an RFP to guarantee the services of a professional debris removal company. 3) Manage the debris removal in the event of a natural disaster.
