A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING ADDITIONAL CODE ENFORCEMENT STAFF POSITIONS FOR THE COMMUNITY DEVELOPMENT DEPARTMENT AND EXTENDING THE AGREEMENT WITH CALVIN, GIORDANO, AND ASSOCIATES FOR A CONTRACT CODE ENFORCEMENT OFFICER; AUTHORIZING THE CITY MANAGER TO INCLUDE THESE POSITIONS IN THE CURRENT AND FUTURE BUDGETS, PROVIDED FUNDING IS A V AILABLE; FURTHER AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has publicly stated its desire for increased enforcement and beautification efforts throughout the city; and WHEREAS, On November 15,2007, the City Commission approved a pilot program for a contract Code Enforcement Officer to increase enforcement services throughout the City; and WHEREAS, additionally, an existing employee was temporarily transferred to the Community Development Department to serve as a Code Enforcement Clerk; and WHEREAS, as the temporary Code Enforcement Clerk was able to assume the bulk of the clerical duties for the Code Enforcement Division, the code enforcement officers were able to increase the time and energy expended in the field; and WHEREAS, statistics show that the additional staffing has yielded higher percentages of code enforcement activity throughout the City; and WHEREAS, the City Commission is pleased with these results and wishes to make said additional staff positions permanent in nature; and WHEREAS, specifically, the City Commission would like to authorize the City Manager to one (1) code enforcement officer position and one (1) code enforcement clerk position permanent positions to the City's Code Enforcement Division; and WHEREAS, as such, these positions will be added to the Community Development Department's Code Enforcement Division's Organizational Chart and these positions will be included in the current and future budgets, provided funding is available; and WHEREAS, the City Commission realizes there will be a transitional period before these staff members can be hired, but wishes the enforcement levels to remain the same; and WHEREAS, the City Commission is authorizing staff to extend the Agreement with Calvin, Giordano, and Associates for a contract Code Enforcement Officer, for a period of up to ninety (90) days, at a cost of Six Thousand Five Hundred Dollars per month, in the same terms and conditions as previously approved. Approval of Additional Code Enforcement Staff Positions. The City Commission hereby approves addition of one (1) Code Enforcement Officer and one (1) Code Enforcement Clerk for the Community Development Department's Code Enforcement Division. Section 2. Approval of Extension of Code Enforcement Agreement. The City Commission hereby approves an extension of the Agreement with Calvin, Giordano, and Associates, Inc. for a contract Code Enforcement Officer for a period of up to ninety (90) days, in the amount of Six Thousand Five Hundred Dollars per month. Section 3. Authority of City Manager. The City Manager is hereby authorized to include said staff positions in the current and future budgets, provided funding is available. Section 4. Further Authorization of City Manager. The City Manager is further authorized to do all things necessary to effectuate the terms of this Resolution. Section 5. Effective Date. Solera, Community Development Director Date: January 28, 2008 Re: Code Enforcement Officers and Code Enforcement Clerk Position Study (Rev.l) CC: Douglas Haag, Assistant City Manager (Finance) Helena Forbes, Assistant Code Enforcement and Licensing Director Following the City Manager's philosophy on positive reduction in expenditure for the 2007 - 2008 Departments' budget, the Community Development Department consolidated two positions. In response to the needs identified by the City Commission, and based on their approval, two temporary positions were created to achieve two specific tasks: 1) The up keep of East / West side of Collins Avenue, Sunny Isles Boulevard, the beach area and beach accesses, 2) Necessary administrative support for the Code Enforcement Officers. Task number one was accomplished with the hiring of a Certified Code Enforcement Officer, thru the outside consulting provided by Calvin Giordano, and task number two was accomplished by re- assigning an employee from the Cultural and Human Services Department to our Community Development Department on a full time basis. HISTORY (CODE ENFORCEMENT SECTION) Prior to this consolidation proposal: . As indicated above, the Department had a total of (3) Code Enforcement Officers. The three Code Enforcement Officers would cover the entire City, spending 40% of their time performing field inspections and 60% performing administrative office work, to support and follow up their open cases. CURRENT DEPARTMENT STATUS (CODE ENFORCEMENT SECTION) The partial implementation of the Department's 07/08 Budget proposal, due to the conditions that were outlined above, has provided the following benefits to the City of Sunny Isles Beach: . One Code Enforcement Officer (provided by Calvin Giordano), has been assigned to the Collins Avenue, Sunny Isles Boulevard corridor as well as the beach area exclusively; the officer performs daily walks and early morning drives on the Beach Area. The constant interaction with business owners and close work with the Public Works Department, has translated into a cleaner great looking main Avenue, as he has constantly notified the Public Works Department of the focal points where debris, graffiti, and damaged streetscape equipments were found. Prompt response from the Public Works Department, resulted into correction of all the issues. The patrol of the beach has provided a stronger enforcement presence along the coastal area, and objects such as chairs and equipments have been removed from the area located east of the erosion control line on a daily basis, This in turn has created a cleaner beach for the enjoyment of residents and visitors. The monitoring of all the locations registered with the City of Sunny Isles Beach, as required by the Beach Chairs and Equipment Ordinance, has resulted on none or few chairs being pre-set prior to the allowed time of 8:00 a.m., and none or few items being left overnight. . The three remaining Code Enforcement Officers (two at this time, hiring of a third one upcoming), have been able to perform inspections via walking and driving on their respective zones, (8) hours of the work day versus (4) hours of the work day; . The transfer of a Clerk from the Human and Cultural Services Department has provided total administrative support to the Code Enforcement Officers. Attached is a list of cases that Yasrninia Essabba has entered and organized for the officers since December 7, 2007 when she officially started the task, as prior training was required. Total of (112) cases were process during 34 working days, for an average of 4 cases per day. Yasminia Essabba has handled the bulk of the citizens complaints that come into the Department for a total of (86) complaints in December and (84) complaints so far in January, translating into (170) possible new cases or (5) complaints per day. All complaints create a new case to be investigated by the officer, some are valid some are bogus. BENCHMARK The Community Development Department performed a study of the various adjacent Cities to determine if the Officer's salaries are within the acceptable range. The reason for this study is to demonstrate the fact that our base salary is not competitive and attractive to potential applicants. Code Enforcement Officer II (1), ( outsourced) $43,000.00 City of Miami $35,320.00 Level I Gardens City of Dacia Beach $32,364.00 Level I As the table above indicates, our officers' compensation can be ranked 3,d in comparison to five other cities. PROPOSAL Code Enforcement Officer. The time frame for the outsource Code Enforcement Officer is ending on February 15, 2008, as the contract was ratified by City Commission for a period of (3) months. At this time the Department is proposing to either extend the time frame tryout for a period of (3) more months or request the creation of an additional Code Enforcement position that will continue the process that has been successfully established in the area of Collins Avenue, beach accesses, the beach area, and Sunny Isles Boulevard, where the City Commission indicated the bulk of the problem existed. This would be a full time position and will carry all the benefits associated with it. The extension of the test period will have to be ratified again by City Commission as $19,575.00 of expenditure for a (3) month period requires Commission approval. Please be aware that the Department would spend $36,219,00 on a regular salary for a Code Enforcement Officer for the entire fiscal year. The City of Sunny Isles Beach will have substantial savings as the amount that is being paid to the outsource employee is triple the amount the City would have to pay for a regular employee. Code Enforcement Clerk: In reference to the Code Enforcement Clerk, the tryout time will expire on March 1, 2008, The Department is proposing to create, as originally requested during our 07/08 Budget meetings, a Code Enforcement Clerk position with a salary of $15.00 and hour, and all the benefits associated with it. Even though Yasminia Essabba has indicated interest in the position thru the attached letter provided to me, it would be necessary to advertise the position internally. She will be our lead candidate as she has been performing the task on a daily basis and, I must say, we are extremely pleased by her performance and professionalism. As we are in the process of hiring a Code Enforcement Officer, your prompt positive response on these issues would be appreciated. Tens of thousands of vehicles pass through daily, and thousands of pedestrians traverse it. The corridor houses thousands of condominium units, and it's our major employment and retail area. All of our hotels are on this strip and three of our parks (two completed, one in planning). The Collins A venue medians are landscaped in such a fashion as to set the example for other property owners to follow, And by the way, it's also a construction zone. Now, having said this. we can't expect the corridor to be maintained like a Japanese Garden. However. it can look better than it does. And this will take enforcement on a more frequent basis than we currently perform, as well as a more rigorous maintenance schedule in the right-of-way by Public Works. Please know that I'm going to expand the standard operational definition of right-of-way to include the public beach area. Further, I realize that an increased level of service in these areas will result in increased staffing, Our task is to develop a cost benefit analysis to determine if the increases in personnel costs justify the increased level of service, Of course, the City Commission will make the final determination, I'm just going to run the experiment. Given the above, the following changes to the table of organization will be made on a temporary basis for the next three months; 1. Code Enforcement - add an additional Code Enforcement Officer bringing our total from three to four. The extra Enforcement Officer will be obtained though one of our engineering consulting firms and will be considered an independent D. The estimated cost over a 90 day timeframe is $19.575 and this will thus need to be an agenda item. Funding for the additional Code Enforcement Officer will come from our consultant account. Transfer of a Cultural and Human Affairs Office Assistant from Pelican Park Community Center to Code Enforcement so as to provide clerical support to the Enforcement Officers. 3. Creation of new division within Public Works called it Right-of-Way. This division will be staffed by transferring two part-time maintenance workers in Public Works to Right-of-Way and giving them more hours. The extra cost will be roughly $5,000. Once we have our complement of four Code Enforcement Officers on board, the City will be divided into four enforcements zones as shown on the attached map, and described below: Zone One - This area includes the Collins A venue Corridor. beach area and beach accesses. This area has the most visibility. It also has the most Right-of-Way. which necessitates a need for a team of Zoning Code Enforcement and Public Works to physically inspect this area and take appropriate enforcement/cleanup action. In terms of enforcement, this area will be canvassed five times per week. The two individuals who will be assigned to this corridor in Public Works will canvas the area five times per week as well. Zone Two - This area includes all properties on the west side of Collins A venue and properties on the east side of Collins Avenue from 183rd street to north city limits. Zone Three - This area includes all properties on the west side of Collins A venue and properties on east side of Collins Avenue from 171 SI street to 183rd street. Zone Four - This area includes all properties on the west side of Collins A venue and properties on the east side of Collins A venue from south city limits to 171 sl street. About two and half months into our experiment we'll make an assessment to determine if we should continue the high level of service or abandon it. And by way of this communication. I"m asking the City Commission to be active participants not only in the final decision. but in the assessment process as well. Vera, Assistant City Manager/ Service DivisionA- Robert Solera, Community Development Director U February 21, 2008 Code Enforcement and Code Enforcement Clerk Recruitment RECOMMENDATION This resolution is brought forth for your consideration REASONS On November 2007 the City Commission approved a pilot program to contract a Code Enforcement Officer to increase enforcement service throughout the City and in addition a existing City employee was temporarily transferred to the Community Development Department to serve as a Code Enforcement clerk. The clerk assumed the bulk of the clerical work that was being done by the enforcement offices, thereby allowing them to increase the time in the field. The City is pleased with results that have come from additional personnel. Statistics show that the additional staffing has yielded a higher percentage of code enforcement activity, with the help of the additional officer and clerk. I I I I I I I I City management is requesting that the City Commission approve an additional Code Enforcement Officer and a Code Enforcement Clerk to be added to the department personnel. The department wishes to maintain the levels of service that they have been provided during the past months. Therefore, during the time that the new staff members are hired we would like to extend the agreement with Calvin Giordano and Associates for a contract Code Enforcement Officer for a period of up to 90 days. Once the department hires a new code enforcement officer the agreement with Calvin Giordano and Associates will be terminated.
