FOR LANDSCAPING SERVICES FOR THE 174TH STREET MEDIAN, IN AN AMOUNT NOT TO EXCEED NINETY-FOUR THOUSAND ONE HUNDRED SIXTY-SEVEN DOLLARS AND FOUR CENTS ($94,167.04), A TT ACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID AMENDMENT TO AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THE AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City is in need of a contractor to furnish all materials, equipment and labor for landscape maintenance services in the City of Sunny Isles Beach; and WHEREAS, the City issued and advertised Bid No. 07-10-04, for Landscape Maintenance Services, for which four (4) responses were received; and WHEREAS, on February 21, 2008 via Resolution No. 2008-1224 the City Commission awarded Bid No. 07-10-04 to and entered into an agreement with Lukes-Sawgrass Landscaping, Inc. to provide services on a unit price basis for Landscape Maintenance Services, in an amount not to exceed Five Hundred Thousand Dollars ($500,000.00); and WHEREAS, the City Commission now wishes to landscape the 174th Street median that had been damaged by Hurricane Wilma; and WHEREAS, Lukes-Sawgrass Landscaping, Inc. has expressed its ability and desire to provide these services, and has provided a proposal in the amount of Ninety-Four Thousand One Hundred Sixty-Seven Dollars and Four Cents ($94,167.04); and WHEREAS, the City wishes to amend its Landscape Maintenance Agreement with Lukes- Sawgrass Landscaping, Inc. to add landscape maintenance services for the 1741h Street median, based on a unit price basis and in an amount not to exceed Ninety-Four Thousand One Hundred Sixty- Seven Dollars and Four Cents ($94,167.04, attached hereto as Exhibit "A". NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Addendum to Agreement. The City Commission hereby approves Addendum No. 1 to the Landscape Maintenance Services Agreement with Lukes-Sawgrass Landscaping, Inc. to include landscaping of the 174th Street median, in an amount not to exceed Ninety-Four Thousand One Hundred Sixty-Seven Dollars and Four Cents ($94,167.04), attached R2008- Lukcs-Sawgrass Landscape Amcndmcnt to Agmt rc 174th St Mcdian Pagc I 01'2 hereto as Exhibit "A". Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said Amendment to Agreement. Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate the terms of this Agreement. Section 4. Effective Date. This Resolution will become effective upon adoption. John Szerlag, City Manager FROM: Jorge Vera, Assistant City Manager Rick Conner, Director of Public Works DATE: March 20, 2008 REGARDING: Approval of Award of 174th Street Tree Restoration Project to Lukes-Sawgrass Landscaping, in an amount not to exceed $94,167.04. RECOMMENDATION We recommend that the City Commission authorize the staff to enter in to a contract with Lukes- Sawgrass Landscaping to place trees in the 174th Street Median in an amount not to exceed $94,167.04. REASONS The City Commission, during the most recent budget sessions, directed the staff to replace the median trees that were damaged or destroyed during hurricane Wilma on 174th Street. To that end, the Commission placed $250,000 in the capital budget for this purpose. We have received a quote from Lukes-Sawgrass Landscaping and much of it follows the bid items on the contract awarded to them at the February Commission Meeting. However, because this project is not part of the work that was anticipated in that contract, we felt it best to ask the Commission for specific approval. ADDITIONAL INFORMATION We did a preliminary plan of which this is part. We will not have to acquire any easements. The total cost of the project is estimated to be less than $100,000. There will be an annual operation and maintenance costs, which is not budgeted. The expected time for completion of the project is Summer of 2008. Funding is currently available in the 174th Street Median Capital Account 20-600-5660.
