A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF SUNNY ISLES BEACH, FLORIDA,
APPROVING THE GENERATOR INCENTIVE
PLAN FOR GAS STATIONS, SUPERMARKETS,
CONVENIENCE STORES, AND PHARMACIES IN
THE CITY OF SUNNY ISLES BEACH;
AUTHORIZING THE CITY MANAGER TO DO ALL
THINGS NECESSARY TO EFFECTUATE THE
TERMS OF THIS RESOLUTION; PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, in the past two years, due to hurricanes and other sever weather
patterns, the City was exposed to long lasting power outages which greatly impacted our
resident's wellbeing, and the City's economy; and
WHEREAS, it has been proven that for a small to mid-size business being
without power even for just a few hours can mean thousands of dollars in lost revenue, as
well as the health and safety of residents who can be potentially compromised if power
supply is not provided in the event of an emergency; and
WHEREAS, in recognizing the importance of having enough gas stations,
pharmacies, and stores prepared for an emergency, the Building and Finance
Departments have worked on an incentive plan that will encourage the installation of
generators in key retail establishments in the City; and
WHEREAS, it has been determined that the estimated cost of equipment and
installation per location is between $20,000.00 and $25,000.00, depending on the type of
installation and service requirements for the facility, with the total cost to the City
estimated between $100,000.00 and $150,000.00; and
WHEREAS, the incentive plan will consist of having an agreement with the
owners of businesses such as gas stations, grocery stores, pharmacies, and convenience
stores desiring to have the equipment installed, who will pay 50% of the installation
costs, with the remainder 50% being paid by the City through the use of Police Forfeiture
Funds; and
WHEREAS, the agreement will stipulate that those businesses desiring to take
advantage of the incentive plan will guaranty the usage of the equipment during
outages/emergencies, or the City will force re-payment of the investment, and business
owners will also agree to provide regular maintenance of the equipment, and keep the
generator on the property for at least ten (10) years; and
WHEREAS, the City Commission now desires to approve the Generator
Incentive Plan with the proposed implementation date of April 28, 2008.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of the Generator Incentive Plan. The City Commission hereby
approves the Generator Incentive Plan.
Section 2. Authorization of City Manager. The City Manager is hereby authorized to
do all things necessary to effectuate the terms of this resolution.
Section 3.
Effective Date. This Resolution will become effective upon adoption.

RE: Generator Incentive Plan for Gas Stations and Pharmacies
RECOMMENDATION:
It is recommended that the City Commission approves the Generator Incentive Plan for Gas Stations,
Supermarkets, Convenience Stores, and Pharmacies in the City of Sunny Isles Beach.
The City's incentive plan will consist of having an agreement with the store owners whereby
businesses such as gas stations, grocery stores, pharmacies, and convenience stores, desiring to have
the equipment installed, will pay for 50% of the installation cost. The other 50% will be paid by the
City thru the use of Police Forfeiture Funds. It is estimated that the cost of implementing this
incentive program will be between $100,000.00 and $150,000.00 to the City.
The proposed effective date for the Generator's Incentive Plan will be April 28, 2008.
BACKGROUND:
In the past two years, due to hurricanes and other severe weather patterns, our City was exposed to
long lasting power outages which greatly impacted our resident's wellbeing and the City's economy.
It has been proven that for a small to mid-size business, being without power even for just a few
hours can mean thousands of dollars in lost revenue. Equally important, the heath and safety of
residents can be potentially compromised if power supply is not provided in the event of an
emergency.
In trying to address this issue, the City Commission, for an approximate period of 9 months,
approved an incentive plan to wave permit fees to those gas stations, pharmacies, and grocery stores
owners who would apply to install emergency generators and transfer switches in their business.
Unfortunately, response to this incentive was not overwhelming due to the high cost business owners

Nevertheless, in recognizing the importance of having enough gas stations, pharmacies, and stores,
prepared for an emergency, both, the Building and Finance Departments have worked on an
incentive plan that will encourage the installation of as many as possible generators in key retail
establishments in our City.
In conducting some research, it has been determined that the estimated cost of equipment and
installation per location is between $20,000.00 and $25,000.00, depending on the type of installation
and service requirements for the facility.
Our incentive plan will consist on having an agreement with the store owners whereby businesses
such as gas stations, grocery stores, pharmacies, and convenience stores, desiring to have the
equipment installed, will pay for 50% of the installation cost. The other 50% will be paid by the City
thru the use of Police forfeiture funds.
Thru the agreement, the City will stipulate that those businesses desiring to take advantage of the
incentive plan, will guaranty the usage of the equipment during outages/emergencies or the City will
force re-payment of the investment. Business owners will also agree, at their own expense, to provide
for regular maintenance of the equipment as well as full replacement if the system is damaged by
actions other than force majeure. On an annual basis, and 60 days prior to the Hurricane Season, the
Building Department will perform inspections of the system to ensure compliance by the business
owners.
ADDITIONAL INFORMATION
The City Attorney's office in conjunction with the Building Department will prepare the Incentive
Plan Application; The City Attorney's office will also prepare the legal agreement between the City
and business owners; the Police Department will work on obtaining the required amounts from the
Police Forfeiture Funds.
