Home My WebLink AboutReso 2008-1275 RESOLUTION NO. 2008- I ~ '1 5 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE PURCHASE OF TWO (2) GLOBAL ELECTRIC MOTORCARS (GEM) MODEL EL ELECTRIC PICK-UP TRUCKS FOR THE PUBLIC WORKS DEPARTMENT, IN AN AMOUNT NOT TO EXCEED TWENTY-ONE THOUSAND DOLLARS ($21,000.00); AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach approved the hiring of several new employees for the Public Works Department, along with the purchase of vehicles for those employees; and WHEREAS, the City put forth an extensive search for alternatives and located an American manufacturer, Global Electric Motorcars (GEM), a subsidiary of Chrysler Motor Company, who manufactures street legal small electric pick-up trucks; and WHEREAS, these pick-up trucks are made of aluminum, use a standard twelve volt battery, can travel up to 40 MPH, will have a stake-bed platform to haul materials and trash, can be charged from a regular household outlet, and are small enough that they can travel on sidewalks; and WHEREAS, the City desires to purchase two electric pick-up trucks from GEM for the Public Works Department, in an amount not to exceed Twenty-One Thousand Dollars ($21,000.00). NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Authorization of Purchase. The City Commission hereby authorizes the purchase of two (2) Global Electric Motorcars (GEM) Model EL Electric Pick-Up Trucks for the Public Works Department, in an amount not to exceed Twenty-One Thousand Dollars ($21,000.00). Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Effective Date. Warranty Information: WARRANTY COVERAGE PERIOD Global Electric Motorcars, LLC (GEM) warrants from the date of delivery to the first consumer, that each GEM Neighborhood Electric Vehicle (NEV) sold as "NEW" and "UNUSED" and pre-delivered by an authorized GEM dealer, will be free from any defect in material and/or workmanship for a period of ONE (1) YEAR WARRANTY NINETY (90) DAYS, for rental use owners All-Inclusive Coverage (MANUFACTURER'S WARRANTY) - GEM will repair or replace, as its option, all genuine GEM Parts found faulty in material and/or workmanship, under normal use, maintenance and service, with genuine GEM parts without charge for parts and labor, at any authorized GEM dealer during warranty coverage period. WHAT IS NOT COVERED . Normal wear and tear items such as the charger plug and receptacle, seats, windshield wiper blades, trim pieces, fuses, decals (except safety decals), brake shoes, brushes, bushings, light bulbs, mats and pads, cosmetic deterioration, and items which deteriorate or fail due to exposure. Damage resulting from improper repairs, modifications or use of non-approved parts or repairs done by a non-authorized GEM dealer. . Damage resulting from continued use of the vehicle after a defect is or should have been discovered. . Damage resulting from accident, fire, explosion, theft, vandalism, riot, or any act of God. . Damage to batteries resulting from lack of maintenance, too deep of discharge, or from freezing conditions. . Misusing the GEM vehicle, such as driving over curbs, overloading or racing. . Tampering with the GEM vehicle . Altering or modifying the GEM vehicle, including the body, chassis, mechanical, or electrical. . Customer applied chemicals or accidental spills. . Using contaminated or improper fluids. . Non - GEM parts installed after the vehicle leaves the GEM factory or control. . Transportation expenses for warranty services (covered under the On-Site Program). . Damage related to plastic and finish on plastic, including but not limited to scratches, cracks, and discoloration. . Driving through water deep enough to cause electrical system damage. . Windshields installed by Auto Body Repairmen or auto glass installers other than GEM. . This warranty does not cover such tires that have failed as a result from normal wear, road hazards such as: (cuts, bruises, impacts, punctures, etc.); overloading, excessive speed, spinning on slippery surfaces, improper inflation, tire chains, wheel misalignment, or improper application. Damage caused by a puncture or tire repair also is not covered. . Parts and labor needed in order to maintain the GEM vehicle, and the replacement of parts due to normal wear and tear. . Surface rust and deterioration of paint, trim, upholstery, and other appearance items that result from use and/or exposure to the elements. . Using the GEM to tow other vehicles, trailers etc., may void warranty. 1. VOIDING OF WARRANTY - THIS AND ANY OTHER WARRANTY SHALL BE VOID IF VEHICLE IS ABUSED OR USED IN AN UNINTENDED MANNER OR SHOWS INDICATIONS THAT IT HAS BEEN ALTERED IN ANY WAY, INCLUDING, BUT NOT LIMITED TO, USE OF NON-GENUINE GEM PARTS, MODIFICATION OF THE SPEED GOVERNOR, BRAKING STYSTEM, STEERING, TRANSAXLE, OR OTHER OPERATING SYSTEMS OF THE VEHICLE TO CAUSE IT TO PERFORM OUTSIDE GEM SPECIFICATIONS. THE WARRANTY IS LIKEWISE VOID IF THE VEHICLE SHOWS INDICATIONS THAT REASONABLE OR NECESSARY MAINTENANCE, AS OUTLINED IN THE OPERATION AND MAINTENANCE SECTION OF THE OWNER'S MANUAL, WAS NOT PERFORMED AT THE TIME AND IN THE MANNER SPECIFIED IN SUCH MANUAL. 2. INTERNATIONAL SALES All inclusions and exclusions of the GEM Warranty apply, except for the reimbursement for shipping of parts outside the United States. 3. HOW TO MAKE A WARRANTY CLAIM Customer must give GEM or authorized GEM NEV dealer notice of any claim within a reasonable period of time, not to exceed thirty days. GEM will not repair any condition or replace any part if a claim is not made in a timely manner. Customer must present the vehicle or defective part to an authorized GEM dealer. The Administrator must be contacted and prior repair approval given before any covered repairs can be facilitated. Once Authorization is obtained and prior repairs beginning, you must sign a repair order, and at this time the GEM NEW Warranty registration card and/or proof of purchase must be presented to the Dealer. GEM MAKES NO OTHER WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE WHICH EXCEED THE OBLIGATIONS OR TIME LIMITS STATED IN THIS WARRANTY ARE HEREBY DISCLAIMED BY GEM AND EXCLUDED FROM THIS WARRANTY. THE PURCHASER AND GEM EXPRESSLY AGREE THAT THE REMEDY OF REPAIR OR RELACEMENT OF THE DEFECTIVE VEHICLE OR COMPONENT THEREOF IS THE EXCLUSIVE AND SOLE REMEDY OF THE PURCHASER. GEM MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND, AND NO REPRESENTATIVE, EMPLOYEE, OR DEALER OF GEM HAS THE AUTHORITY TO MAKE OR IMPLY ANY REPRESENTATION, PROMISE, OR AGREEMENT WHICH IN ANY WAY VARIES THE TERMS OF THIS WARRANTY. GEM RESERVES THE RIGHT TO MODIFY THE TERMS OF THIS WARRANTY AT ANY TIME, IT BEING UNDERSTOOD THAT SUCH MODIFICATION WILL NOT ALTER WARANTY CONDITIONS APPLICABLE TO THE GEM NEV SOLD WHILE THIS WARRANTY IS IN EFFECT. THIS WARRANTY IS TRANSFERRABLE FOR A FEE. 5. SOLE REMEDY GEM'S ONLY LIABILITY UNDER THIS WARRANTY, OR IN ANY ACTION WHETHER BASED UPON WARRANTY, CONTRACT, NEGLIGENCE, STRICT PRODUCT LIABILITY OR OTHERWISE, IS LIMITED TO THE REPAIR OR REPLACEMENT, AT GEM'S OPTION, OF A VEHICLE OR COMPONENT THEREOF THAT GEM DEEMS TO BE DEFECTIVE. REPLACEMENT SHALL MEAN FURNISHING, DURING THE APPLICABLE WARRANTY PERIOD, A NEW VEHICLE OR FACTORY RECONDITIONED VEHICLE OR COMPONENT THEREOF WHICH IS IDENTICAL OR REASONABLY EQUIVALENT TO THE WARRANTED PRODUCT OR COMPONENT AT NO COST TO THE PURCHASER. Export Packing Charges: Export packing of products is available at additional cost. 17. Government Commercial Credit Cards - Government Commercial Credit Cards will be acceptable for payment. The order must contain the credit card number, the cardholder name and phone number and the expiration date. 18. Terms and conditions for Other Services. The GEM Warranty Complimentary Assistance Program allows for Vehicle Transportation For Emergency Road Service when GEM Vehicle transportation service is needed for an emergency in the field, due to mechanical or electrical failure. Transportation service will be provided back to the residence or dealership, which ever is closest. (This does not include vehicles that are not properly maintained or adequately charged). You many contact AM or other roadside assistance, if you are a member or Contact your dealer or the dealer nearest you. GEM provides up to $100 for these transportation services. 19. List of Participating Dealers and Service Points - for a list of the dealers nearest you, access our web site www.qemcar.com and click on dealer locator or call GEM customer service at 866-764-0616. 20. Preventive Maintenance - The best way to transport your vehicle is in an enclosed trailer. If it is necessary to haul your vehicle on an open trailer, follow these guidelines: · Never haul your vehicle while the vehicle is facing rearward on the trailer. · With the vehicle facing forward, pull the trailer at speeds of 55 MPH or less. . Secure all items that could be affected by the wind. · Do not secure across the tub of the vehicle. There are steel handles located on the front and at the rear of the vehicle. Use these with tie downs in each corner of the trailer. · Towing the vehicle is not recommended. This vehicle is not designed for towing, even using a dolly. Any vehicle failures resulting from improper transporting may not be covered by warranty. GEM's vehicle transportation is not a substitute for proper maintenance of your new vehicle. GEM reserves the right to limit service or reimbursement to an owner or driver when, in GEM's sole judgment, the owner's or driver's requests under the program becomes unreasonable or too frequent. This authorization should cite the contract number, the period of authorization, and state that title to any equipment purchased by the Contractor will vest in the U. S. Government, and: b. The order placed by the authorized Federal Government Contractor states: "This order is placed under written authorization from dated . BACKGROUND The Commission recently authorized the hiring of several new employees for the Public Works Department, and included in that approval was the purchase of vehicles for those employees. We have spent a good deal of time studying alternatives, and with the help of staff members Shaun Gelvez and Ray Sellers, we have located an American manufacturer (this company is a subsidiary of Chrysler Motor Company and the plant is located in Fargo, North Dakota) of a street legal small electric pickup truck that will be ideal for our work. RECOMMENDATION We recommend that the Commission authorize the purchase of two Global Electric Motorcars (GEM) Model EL utilizing the Federal Government's GSA Catalog for local governmental agencies. The base cost of each vehicle is $9,017.74 and we will need to add several essential accessories such as bed rails and safety lights. The combined total cost for two vehicles will not exceed $21,000. This represents a savings of approximately $10,000 when compared to the purchase of gasoline vehicles, and the elimination of expenses for gasoline and oil. REASONS These vehicles are made almost entirely of aluminum, they use standard twelve volt batteries and can travel up to forty miles per charge. The have a stake-bed platform which is ideal for the work we do (hauling materials and trash), and are small enough to travel on sidewalks. They cost less than a standard pickup and can be charged from a regular household outlet. If they work as well as we expect, we will look to ultimately replace other City vehicles with these units. ADDmONAL INFORMATION We did a preliminary plan of which this is part. There will be a small annual operation and maintenance cost, which is budgeted. The expected time for delivery is two months after the order is placed. Funding is currently available.
