RESOLUTION NO. 2008-~1?
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE
CITY MANAGER TO ADMINISTRATIVELY APPROVE
AGREEMENTS FOR BOAT SLIP LEASES AT BELLA VISTA
BAY PARK; AUTHORIZING THE CITY MANAGER TO DO
ALL THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on May 15, 2008, the City Commission considered a discussion item
regarding boat slip leases at Bella Vista Bay Park, located in the City; and
WHEREAS, the City Commission has carefully considered the costs and benefits of
allowing boat slip leases at Bella Vista Bay Park; and
WHEREAS, the City Commission desires to authorize the City Manager to
administratively lease boat slip spaces at Bella Vista Bay Park.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified
and confirmed as being true and the same are hereby made part of this Resolution.
Section 2. Authorization of City Manager. The City Manager is hereby authorized to
administratively approve agreements for boat slip leases at Bella Vista Bay Park, together with
such terms and conditions as may be acceptable to the City Manager and approved as to form
and legal sufficiency by the City Attorney.
Section 3. Effective Date. This Resolution will become effective upon adoption by the City
Commission.

RE: Authorization for City Manager to Enter Into Lease Agreements for Dock Space
at Bella Vista Bay Park
RECOMMENDATION:
It is recommended that the City Commission consider the attached resolution providing the City
Manager with the authority to enter into lease agreements for dock space at Bella Vista Bay
Park.
REASONS:
The City purchased park property known as Bella Vista Bay Park in November 2006 that is
located along the Intracoastal Waterway. Already existing at this park are seven (7) boat slips,
one of which is currently being leased by the Sir Winston luxury yacht. Other individuals have
since expressed an interest in leasing dock space from the City. To this end, the City has
installed individual meters for utilities.
ADDITIONAL INFORMATION:
Lease agreements for this dock space will be in accordance with the following guidelines:
· Rental Fees would be reviewed annually and set to insure a profit to the City and in
consideration of the market value of nearby marinas with similar amenities. Initially,
this fee will be a minimum of$600 per month for a vessel up to 35' in length plus an
additional $20 per month for each additional foot.

. Rental Fees would not include utilities. Utilities would be the sole responsibility of
the lessee.
. Rental agreements will exclude any overnight occupancy of any vessel.
. Priority will be given to charter boats that offer services to the residents and visitors
of the City.
. Agreements will include minimum insurance requirements as recommended by our
insurance consultant with the City being named as additional insured.
. No fueling or sanitation dumping will be permitted at the dock or within City limits.
. All agreements will be approved by the City Attorney for form and legal sufficiency.
. All agreements will include an indemnification section.
. All agreements will be for a one-year term with a renewal and cancelation clause.
. Agreements would not provide for any special parking considerations at Bella Vista
Bay Park. All meter parking fees would apply.
. All agreements will state that all park rules and regulations apply including the
Miami-Dade County Marina Rules and Regulations that will be attached to each
agreement.
. All agreements will comply with the City's designation by the US Coast Guard as a
Public Access Facility.
. Security of the vessel will be the sole responsibility of the lessee.
