(BH&A), TO PROVIDE ADDITIONAL PRE-CONSTRUCTION AND CONSTRUCTION ENGINEERING AND INSPECTION (CEI) SERVICES FOR THE CONSTRUCTION OF THE CENTRAL ISLAND DRAINAGE PROJECT, IN AN AMOUNT NOT TO EXCEED FOUR HUNDRED THIRTY-NINE THOUSAND NINE HUNDRED NINETY-FIVE DOLLARS ($439,995.00), A TT ACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID FOURTH AMENDMENT TO AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THE AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City has continuously experienced problems with flooding in the Central Island area, and was in need of engineering services for drainage improvements in the Central Island area; and WHEREAS, on December 18, 2003 the City Commission, via Resolution No. 2003-628, approved an agreement with Beiswenger, Hoch & Associates for Storm water System Design, Technical Assistance and Bidding Process for Central Island Stormwater Drainage for a total fee of One Hundred Sixty-Seven Thousand Forty Dollars ($167,040.00); and WHEREAS, pursuant to Resolution No. 2006-1025, adopted on December 14, 2006, the City Commission approved the First Amendment to the Agreement to provide necessary updates to the existing plans and technical assistance required to incorporate the undergrounding utilities information for the Central Island Drainage Project, for a total fee of Twenty-Four Thousand Ten Dollars ($24,010.00); and WHEREAS, pursuant to Resolution No. 2008-1202, adopted on January 17, 2008, the City Commission approved the Second Amendment to the Agreement to provide additional design services to incorporate curbs and gutters to all of the streets for the Central Island Drainage Project, for a total fee of One Hundred Sixteen Thousand Eight Hundred Forty Dollars ($116,840.00); and WHEREAS, pursuant to Resolution No. 2008-1220, adopted on February 2 I, 2008, the City Commission approved the Third Amendment to the Agreement to provide project management, engineering testing, and quality control services for the construction of this project, for a total fee of Two Hundred Seventy-Eight Thousand Three Hundred Fifty-Five Dollars ($278,355.00); and R2008- BHA - 4th Amend to Central Island Drainage Agrmt Page I 01'3 r WHEREAS, the City is now in need of additional pre-construction and construction engineering and inspection (CEI) services for this project to include curb and guttered streets with increased parking, street lighting, landscaping, and additional improvements to Gwen Margolis Park; and WHEREAS, Beiswenger, Hoch and Associates has submitted a proposal to provide these services for the Central Island Drainage Project, for a total fee of Four Hundred Thirty-Nine Thousand Nine Hundred Ninety-Five Dollars ($439,995.00); and WHEREAS, the City wishes to enter into an agreement with Beiswenger, Hoch and Associates to provide these services for the Central Island Drainage and Street Improvements Project, in an amount not to exceed Four Hundred Thirty-Nine Thousand Nine Hundred Ninety- Five Dollars ($439,995.00), attached hereto as Exhibit "A", bringing the total contract amount not to exceed One Million Twenty-Six Thousand Two Hundred Forty Dollars ($ I ,026,240.00), unless amended by prior approval of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Fourth Amendment to Consultant Agreement. The Fourth Amendment to Consultant Agreement with Beiswenger, Hoch and Associates, Inc., to provide additional pre-construction and construction engineering and inspection (CEI) services for the construction of the Central Island Drainage Project, in an amount not to exceed Four Hundred Thirty-Nine Thousand Nine Hundred Ninety-Five Dollars ($439,995.00), attached hereto as Exhibit "A", be and the same, is hereby approved. Section 2. Authorization of Mavor. The Mayor is hereby authorized to execute said Fourth Amendment to Agreement. Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate the terms of the Agreement. Section 4. Effective Date. This Resolution will become effective upon adoption. NOW THEREFORE, in consideration of the premises and the mutual covenants herein stated, the pal1ies hereto agree as set forth below: 1. ADDITIONAL SCOPE OF SERVICES: The Consultant shall provide additional services to include curb and guttered streets with increased parking, street lighting, landscaping, and additional improvements to Gwen Margolis Park, as more fully described in Attachment "A". TERM: The term to this Fourth Amendment to Consultant Agreement shall begin upon the execution of this Fourth Amendment and shall end upon the completion of the Central Island Drainage Project, with an estimated construction end date of July 3 1,2009. 4. INCORPORATION OF TERMS AND CONDITIONS: Except as expressly amended or modified by this Fourth Amendment to Consultant Agreement, all of the terms and conditions of the original Consultant Agreement between the parties dated December 18, 2004, and all amendments subsequent thereto, shall remain in full force and effect. Due to the increase in the Scope of Work and additional construction items, the CEI will now require two positions (to be staffed by Pat Hayes and George Sokola). The additional construction items involve construction of curb and gutter, park drainage, landscaping, street lighting and NE 183rd Street. Because of the initial construction delays, we are showing an additional 3 months to the construction time making the overall construction schedule to be an estimated 16 months. (NTP to the contractor was issued April 1, 2008; estimated construction end date is July 31, 2009.) The contractor has not yet made a time extension request. A contingency of 15% is being shown in the additional fee for Item NO.4. Design Services Agreement for the Central Island Drainage Project, in an amount not to exceed $439,995.00 RECOMMENDATION It is recommended that the City Commission adopt the attached resolution approving the 4th Amendment to the Beiswenger Hoch and Associates, Inc. Design Services Agreement for the Central Island Drainage Project, in an amount not to exceed Four Hundred Thirty-Nine Thousand Nine Hundred Ninety-Five Dollars ($439,995). This is one of two amendments that will expand the scope of the original project to include curb and guttered streets with increased parking, street lighting, landscaping, and additional improvements to Gwen Margolis Park. REASONS The Central Island Drainage Project was designed several years ago and was a rather basic project. The main focus was on drainage and not much if any concern was given to roadway cross sections, parking, lighting, or landscaping. Since beginning the project, it has become very obvious that the City Commission desires a product that defines, beautifies, and enhances the City. This expanded scope of work will put curb and gutter on every street in the project. Under the original design, less than twenty-five percent would have curb and gutter. It will double the available parking while creating landscaped sections to enhance and beautify of the streetscape. It will add about two hundred decorative street lights (like the ones on North Bay Road just south of 172nd). We will not have to acquire any easements. The total cost of the expanded scope of work is estimated to be less than $4,542,550. That design was a rather basic project. The main focus was on drainage and not much if any concern was given to roadway cross sections, parking, lighting, or landscaping. Since beginning the project, it has become very obvious that the City Commission desires a product that defines, beautifies, and enhances the City. This expanded scope of work will put curb and gutter on every street in the project. Under the original design, less than twenty-five percent would have curb and gutter. It will double the available parking while creating landscaped sections to enhance and beautify of the streetscape. It will add about two hundred decorative street lights (like the ones on North Bay Road just south of 172nd). BHA (our consulting engineer on the project) submitted a request to charge us additional fees for the design of this expanded scope and the City Commission approved that request. BHA is now asking for additional funds to monitor this additional work, test materials and quality of the products, make field design changes as necessary, and most importantly, work with the residents in the area on a one-on-one basis to answer questions and proVide information on upcoming work. They will, under this proposal, put two people on the project full time. I have reviewed their proposal. In my opinion, as a profeSSional engineer, find the costs to be reasonable and appropriate. In fact, most of the hourly rates are less than we are paying other consultants on other City projects. Their estimate of the hours might be on the high side of reasonable, but because this will be an hourly billing with a not to exceed amount, I feel we will be able to obtain a good product at a reasonable rate.
