A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING A FIRST
AMENDMENT TO AGREEMENT WITH SOUTHEASTERN
ENGINEERING CONTRACTORS, INC. TO EXPAND THE SCOPE
OF WORK FOR THE CONSTRUCTION OF THE CENTRAL
ISLAND DRAINAGE AND STREET IMPROVEMENTS PROJECT,
TO INCLUDE CURB AND GUTTERED STREETS WITH
INCREASED PARKING, STREET LIGHTING, LANDSCAPING,
AND ADDITIONAL IMPROVEMENTS TO SENATOR GWEN
MARGOLIS PARK, IN AN AMOUNT NOT TO EXCEED FOUR
MILLION ONE HUNDRED TWO THOUSAND FIVE HUNDRED
FIFTY-FOUR DOLLARS AND NINETY-THREE CENTS
($4,102,554.93), ATTACHED HERETO AS EXHIBIT "A";
AUTHORIZING THE MA YOR TO EXECUTE SAID FIRST
AMENDMENT TO AGREEMENT; AUTHORIZING THE CITY
MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE
THE TERMS OF THE AGREEMENT; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City has continuously experienced problems with flooding in the Central
Island area, and was in need of engineering services for drainage improvements in the Central Island
area; and
WHEREAS, on December 18, 2003 the City Commission, via Resolution No. 2003-628,
approved an agreement with Beiswenger, Hoch & Associates for Stormwater System Design,
Technical Assistance and Bidding Process for Central Island Stormwater Drainage; and
WHEREAS, the City issued and advertised Bid No. 07-10-02, for a contractor to furnish all
materials, equipment and labor for the Central Island Drainage and Street Improvements Project, and
determined that the bid response from Southeastern Engineering Contractors, Inc. was the lowest
responsible responsive bid; and
WHEREAS, on February 21, 2008 the City Commission, via Resolution No. 2008-1221,
awarded Bid No. 07-10-02 to and entered into an agreement with Southeastern Engineering
Contractors, Inc. to provide services on a unit price basis for the Central Island Drainage and Street
Improvements Project, in an amount not to exceed Three Million Six Hundred Thirty-Five Thousand
Eight Hundred Fifty-Two Dollars Two Cents ($3,635,852.02); and
WHEREAS, the City now wishes to expand the scope of the original project to include curb
and guttered streets with increased parking, street lighting, landscaping, and additional improvements
to Senator Gwen Margolis Park; and

WHEREAS, Southeastern Engineering Contractors, Inc. has expressed its ability and desire
to provide these services; and
WHEREAS, the City wishes to approve a First Amendment to Agreement with Southeastern
Engineering Contractors, Inc. to provide these additional services for the Central Island Drainage and
Street Improvements Project, in an amount not to exceed Four Million One Hundred Two Thousand
Five Hundred Fifty-Four Dollars and Ninety-Three Cents ($4,102,554.93), attached hereto as Exhibit
"A", bringing the total contract amount to date to Seven Million Seven Hundred Thirty-Eight
Thousand Four Hundred Six Dollars and Ninety-Five Cents ($7,738,406.95).
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of First Amendment to Agreement. The City Commission hereby approves
the First Amendment to Agreement with Southeastern Engineering Contractors, Inc. to expand the
Scope of Services for the Central Island Drainage and Street Improvements Project, in an amount not
to exceed Four Million One Hundred Two Thousand Five Hundred Fifty-Four Dollars and Ninety-
Three Cents ($4,102,554.93), attached hereto as Exhibit "A".
Section 3. Authorization of Mavor. The Mayor is hereby authorized to execute said First
Amendment to Agreement.
Section 4. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate the terms of this Agreement.
Section 5.
Effective Date. This Resolution will become effective upon adoption.

FIRST AMENDMENT TO CITY OF SUNNY ISLES BEACH
AND SOUTHEASTERN ENGINEERING CONTRACTORS INC.
AGREEMENT CONTRACT NO. C0708-080
THIS FIRST AMENDMENT is made and entered into this _day of 2008, by
and between the CITY OF SUNNY ISLES BEACH, FLORIDA, a municipal corporation of the State of
Florida, (hereinafter referred to as "City") and SOUTHEASTERN ENGINEERING CONTRACTORS
INC., ("Contractor") a business corporation licensed in the State of Florida, whose Federal Identification

WHEREAS, the City continuously experienced problems with flooding in the Central Island area,

NOW THEREFORE, in consideration of the foregoing and for the mutual covenants,
representations and warranties and other good and valuable consideration, the receipt and adequacy of
which is hereby acknowledged, the parties agree as follows:
1. ADDITIONAL SCOPE OF WORK: Contractor shall provide additional services to include
curb and guttered streets with increased parking, street lighting, landscaping, and additional
improvements to Gwen Margolis Park, as more fully described in Attachment "A".
2. COST: The total cost for this First Amendment shall not exceed Four Million One Hundred Two
Thousand Five Hundred Fifty-Four Dollars and Ninety-Three Cents ($4,102,554.93) for said services.

3. TERM: The term to this First Amendment to Agreement shall begin upon execution and shall
end upon the completion of the Central Island Drainage Project, estimated to be summer of2009.
4. INCORPORATION OF TERMS AND CONDITIONS: Except as expressly amended or
modified by this First Amendment to Contract No. C0708-044, all of the terms and conditions of Contract
No C0708-044 shall remain in full force and effect.

not to exceed $4,102,554.93
RECOMMENDATION
It is recommended that the City Commission adopt the attach resolution approving the 15t Amendment to
Southeastern Engineering Construction Services Agreement for the Central Island Drainage Project, in
an amount not to exceed Four Million One Hundred Two Thousand Five Hundred Fifty-Four Dollars and
Ninety-Three Cents ($4,102,554.93). This is one of two amendments that will expand the scope of the
original project to include curb and guttered streets with increased parking, street lighting, landscaping,
and additional improvements to Gwen Margolis Park.
REASONS
The Central Island Drainage Project was designed several years ago and was a rather basic project. The
main focus was on drainage and not much if any concern was given to roadway cross sections, parking,
lighting, or landscaping. Since beginning the project, it has become very obvious that the City
Commission desires a product that defines, beautifies, and enhances the City.
This expanded scope of work will put curb and gutter on every street in the project. Under the original
design, less than twenty-five percent would have curb and gutter. It will double the available parking
while creating landscaped sections to enhance and beautify of the streetscape. It will add about two
hundred decorative street lights (like the ones on North Bay Road just south of 1 72nd). Also included are
improvements to Gwen Margolis Park, such as fencing to control the use of the soccer field, new
restroom facilities (like the ones in Town Center Park), a hiking and jogging path around the perimeter,
angle parking, and connecting sidewalks. Another critical part of this expanded scope is the modification
to the underground drainage system for the park. The original park drainage design (again, done several
years ago) is not up to the same standards we have set for the rest of the area. These changes will
significantly improve the removal of water from the park and surrounding area.

ADDITIONAL INFORMATION
We did a preliminary plan of which this is part.
We will not have to acquire any easements.
The total cost of the expanded scope of work is estimated to be less than $4,542,550.
The revised total cost of this project with the changes is $8,200,000
There will be an annual operation and maintenance costs, which is budgeted.
The expected time for completion of the design is summer of 2009 (to ensure smooth operation of the
school).
Funding is available in the Stormwater Fund Capital Account 40-538-5635 and will be re-appropriated in
FY 2008/09 as needed.
