RESOLUTION NO. 2008-1355
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, ACCEPTING THE FINAL REPLAT
FOR OCEANIC DEVELOPMENT, LLC, RELATING TO THE
FOLLOWING ADDRESSES: 18915, 18925, 18955, 18965, 18985, 19001,
19025, 19035 ATLANTIC BOULEVARD; AUTHORIZING THE CITY
MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FORAN EFFECTIVE DATE.
WHEREAS, on July 17, 2008, Oceanic Development, LLC, applied for a Subdivision Plat
in order to divide eight parcels into twenty (20) fee simple single-family townhouse units and
other improvements upon the Property, and
WHEREAS, on November 15, 2007 the City Commission approved this project, Via
Resolution No. 07-Z-112; and
WHEREAS, Florida Power & Light (FPL) has by letter agreed to underground the
overhead facilities located on the rear of the property facing Collins Avenue at the owner's
expense to the front of the property located along Atlantic Boulevard, and FPL will need a ten-
foot easement in the front of the property where the underground facilities will be located, and
once the new easement is received, FPL will release the existing easement, and
WHEREAS, the Miami-Dade County Plat Committee has approved the plat submitted by
Oceanic Development, LLC; and
WHEREAS, Oceanic Development, LLC, now presents to this Commission, in accordance
with Chapter 28 of the Code of Miami-Dade County, a final replat of certain lands lying in the
City of Sunny Isles Beach, said Subdivision Plat entitled Subdivision Plat Oceanic Development,
LLC, with a legal description: Lots 2 & 3, Block 3, OCEAN BOULEV ARD ESTATES,
SECTION "A", according to the plat thereof as recorded in Plat Book 48, Page 39, together with
the West Yi of the vacated alley, lying East of and adjacent to said Lots 2 & 3, and Lots 4,5,6,7,
8, & 9, Block 3, GOLDEN SHORES, OCEAN BOULEVARD ESTATES, SECTION "B",
according to the plat thereof as recorded in Plat Book 51 at Page 15, together with the West Yi of
the vacated alley, lying East of and adjacent to said Lots 4, 5, 6, 7, 8 & 9 all of the Public
Records of Miami-Dade County, Florida; and
WHEREAS, it appears that all requirements of the law concerning said plat insofar as
the authority of this Commission is concerned, have been complied with.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Final Plat Approved. This final replat of Oceanic Development, LLC, is hereby
approved. A dedication of streets, alleys and other rights-of-way however designated or depicted

on said plat is hereby accepted; that said right-of-way to be relocated is hereby so relocated; that
plat restrictions as may be listed on the plat are approved and are to be enforced; that the
approval of the plat is not a waiver of any zoning regulations and that this approval is
conditioned upon proper execution of all documents required by the City Attorney's office.
Section 2. Effective Date. This Resolution shall become effective upon adoption.

Order. Based on currently available information, the following determinations have been made:

the CDMP. Furthermore, the proposed development order, if approved, will not result in a reduction in the LOS
standards subject to compliance with the conditions stipulated by DERivl for this proposed development order, if
any.
Please note that this conculTency determination does not constitute a final concurrency statement on the proposed
development order as provided for in the adopted methodology for concurrency review. One or more additional
concurrency determinations \vill be required.
Please note that the regional sewer system is operating under a capacity allocation program in accordance with the
First Partial Consent Decree between Miami-Dade County and the United States of America (Case NO. 93-1109
CIVMoreno). Under the tenus of this Consent Decree, this approval does not constitute an allocation or
certification of adequate treatment and transmission system capacity. which \vill be evaluated and determined at
the time of agency review of the building pem1it plans for the referenced project.

The Water Control Section has reviewed the subject Tentative Plat and recommends its approval with the
following conditions:
Sites located within unincorporated Miami-Dade County shall be filled in accordance \vith the requirements of
Chapter 11 C of the County Code.
Site shall be filled in a manner so as to prevent the flooding of adjacent properties. Interceptor swales shall be
constructed on-site with no encroachment over adjacent properties.

The subject properties do not contain jurisdictional wetlands as defined by Chapter 24-5 of the Code: therefore. a
Class IV Wetland Pem1it will not be required.
The applicanl is advised that permits from the Army Corps of Engineers (305-526-7181). the Florida Department
of Environmental Protection (561-681-6600) and the South Florida Water Management District (1-800-432-2045)
may be required for the proposed project. It is the applicant's responsibility to contact these agencies.

The Tree Program has no objection to this plat with the condition that specimen-sized trees are preserved on the
sites and that a Miami-Dade County Tree Removal Permit should be obtained prior to the removal or relocation of
any tree on the propenies.
The above referenced sites may contain specimen-sized (Trunk diameter 1 S inches or greater) trees. Section 24-
49.2(11) of Chapter 24. the Code of Miami-Dade County requires that specimen trees be preserved whenever
reasonably possible. A Miami-Dade County Tree Removal Permit is required prior to the removal or relocation of
any tree that is subject to the Tree Preservation and Protection provisions of Chapter 24. Said Tree Removal
Pennit shall meet the requirements of Sections 24-49.2 and 24-49.4 of the Codc.
The applicant is required to comply with the above tree permitting requirements. DERM's approval is contingent
upon inclusion of said tree permitting requirements in the approval of this plat.
The applicant is advised to contact DERL\;l staff 305-372-6574 for additional information regarding tree
penllitting procedures and requirements prior to site development.
Please be advised thai average time to obtain a Tree Removal Permit is approximately lO working days, however.
actual time to obtain a Tree Removal Permit may vary sibl'Jlificantly based on the completeness of the submittal.

Final Replat for Oceanic Development, LLC
RECOMMENDATION:
This resolution is presented for your consideration.
REASONS:
Oceanic Development, LLC previously received approval for the development of "Oceanika"
passed and adopted through Resolution No. 07-Z-112 in November 15, 2007 for a 20-unit
townhouse project consisting of four (4) buildings containing five (5) units each. Oceanic
Development, under approval condition (12) shall replat the eight (8) parcels located on the East
side of Atlantic Boulevard, to subdivide the property into twenty (20) fee simple single-family
townhouse-units. Florida Power & Light (FPL) has by letter agreed to underground the overhead
facilities located on the rear of the property facing Collins Avenue at Oceanic Development's
expense to the front of the property located along Atlantic Boulevard. FPL will need a 10-foot
easement in the front of the property where the underground facilities will be located. Once the
new easement is received, FPL will release the existing easement.
