A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING A REQUEST TO
WITHDRAW WITHOUT PRE.JUDICE THE ZONING
APPLICATION FILED BY 488 SUNNY ISLES INC.
("APPLICANT"); REQUIRING THE APPLICANT TO PAY ALL
FEES INCURRED IN REVIEWING SAID APPLICATION;
PROVIDING THE CITY MANAGER WITH THE AUTHORITY
TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the attorney for 488 Sunny Isles Inc.. has filed a request to withdraw the
zoning application filed by the Applicant; and
WHEREAS, the City Commission wishes to grant the withdrawal of the zonmg
application without prejudice.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section I. Approval of Withdrawal Request. The City Commission hereby approves the
withdrawal of the zoning application filed by Applicant 488 Sunny Isles Inc. without prejudice.
Section 2. Payment of Fees. The Applicant is hereby required to pay all fees incurred in
reviewing said application.
Section 3. Authority of the City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 4.
Effective Date. This Resolution shall become effective upon adoption.

488 Sunny Isles, Inc. Z2007-02 (Withdrawal of application)
RECOMMENDATION:
This resolution is presented for your consideration.
REASONS:
488 Sunny Isles, Inc., (the "Applicant") has encountered a number of issues that they have not
been able to resolve, as such this resolution is proposed to allow the applicant to withdraw the
application previously provided to the City.
Under Section 265-11 (F), the City Commission may elect to grant a withdrawal of the zoning
application with or without prejudice. If the application is withdrawn without prejudice the
application may be re-filed at any time. If the application is withdrawn with prejudice then the
application shall not be resubmitted for a period of one year from the date of granting. In any
case the applicant shall bear the costs associated with either the withdrawal or re-filing. Since
this is the Applicant's first withdrawal request, staff does not object to the withdrawal of this
application without prejudice.
