A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE
FIRST AMENDMENT TO AGREEMENT WITH B & G
FENCES, CORP., TO PROVIDE FURNISHING AND THE
INST ALLA TION OF FENCING FOR COLLINS A VENUE
MEDIANS, IN AN AMOUNT NOT TO EXCEED TWO
HUNDRED FORTY THOUSAND DOLLARS ($240,000.00),
ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING
THE MAYOR TO EXECUTE SAID AGREEMENT;
AUTHORIZING THE CITY MANAGER TO DO ALL THINGS
NECESSARY TO EFFECTUATE THE TERMS OF THIS
RESOLUTION; PROVIDING FORAN EFFECTIVE DATE.
WHEREAS, on June 19, 2008, via Resolution No. 2008-1283, the City Commission
approved an agreement with B & G Fences, Corp. to provide and install 1,200 linear feet of
fencing in the medians on Collins A venue, in the amount of Ninety Thousand Four Hundred
Dollars ($90,400.00); and
WHEREAS, after approval of the agreement, it was discovered that the linear feet was
incorrect since it only covered a portion of Collins A venue median, and the City now wishes to
install an additional 4,800 linear feet of median fencing; and
WHEREAS, after negotiations, B & G Fences, Corp. submitted a proposal to include
the additional scope of work, with a lower price per linear foot, competitive and lower than the
original proposals; and
WHEREAS, in order to continue the fabrication and installation of the fence and
complete the work in a timely manner, the City wishes to amend the agreement to include the
additional scope of work, in the amount of Two Hundred Forty Thousand Dollars ($240,000.00)
to provide furnishing and the installation of a fence in the medians on Collins Avenue, attached
hereto as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of First Amendment to Agreement. The First Amendment to Agreement
with B & G Fencing, Corp., in the amount of Two Hundred Forty Thousand Dollars
($240,000.00) to provide and install fencing in the medians on Collins A venue, attached hereto as
Exhibit "A," be, and the same, is hereby approved.
Section 2. Authorization of Mayor. The Mayor IS hereby authorized to execute said
Agreement.
Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate the terms of this Resolution.

Section 4.
Effective Date. This Resolution will become effective upon adoption.

FIRST AMENDMENT TO THE AGREEMENT BETWEEN

B & G FENCES, CORP .CONTRACT NO. C0708-091
THIS FIRST AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF
S~ ISLES BEACH AND B & G FENCES, CORP. executed this Jg#1day of

FEN S, CORP. Contract No. 0708-071 by and bctween the CIty of Sunny Isles Beach
("City") and B & G FENCES, INC., ("Contractor") a business corporation licensed in the State
of Florida, whose Federal Identification # is 07B500448. The City and Contractor hereby agree
as follows:
1. ADDITIONAL SCOPE OF WORK: The City desires to enter into this First
Amendment to the City's Agreement with Contractor to construct additional median fencing
along Collins Avenue in the City. as more fully described in Attachment "A", attached hereto
and incorporated herein by reference.
2. COST: The Contractor agrees to charge the City a total amount not to exceed Two
Hundred Forty Thousand Dollars ($240,000.00) for the additional scope of work.
3. TERM: The services to be rendercd by the Contractor shall commence upon execution
of this First Amendment and shall be completed within the time specified in the original
Agreement between the parties.
4. INCORPORATION OF TERMS AND CONDITIONS: Except as expressly amended
or modified herein, all of the terms and conditions of the original Agreement between the Parties,
Contract No. 0708 - 071, approved by the City Commission on June 19, 2008, shall remain in
full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this document as of the
date mentioned above.

Median Fencing
RECOMMENDATION
This resolution is brought forth for your consideration
BACKGROUND
Under Resolution #2008-1283 the City approved a contract with B & G Fences, Corp for the
installation of fencing along the Collins Avenue median. After awarding the contract, the City
realized that the amount of linear feet (1,200) that was contracted for was incorrect, since it only
covered a portion of Collins Avenue median. The overall correct amount of linear fence along
the entire Collins A venue median is 6,000 linear feet. The contract was awarded to the lowest
qualified bidder for the amount of $90,400 dollars which include general conditions, material
and installation. This again was for only 1,200 linear feet of fencing out of the 6,000 linear feet
needed.
In order to allow the project to remain on schedule for installing the fence and new landscaping,
the work commenced in July of 2008. The City went back to the contractor regarding the cost
per linear feet from the original proposal. The contractor lowered the price from $55 to $50
dollars a linear feet of fence for a total reduction of $24,000. If under the original contract the
City had placed the correct amount of linear feet of fence (6,000 LF) the contract amount would
have been for $354,400. Now after the reduction in cost the overall contract to the City is
$330,400. The proposal for the fabrication and installation of the remaining fence is $240,000.

In order to assure that the quote from B & G Fences, Corp was competitive the City obtained
other quotes from separate contractors. The one of the quotes was much lower than the other
quotes that I previously received. Staff questioned the amount of the quote of $39 dollars a
linear foot which was out off the range of the other quotes. To assure that the lower quote was
not out of the range, I received another quote for the amount of$49.50 a linear foot which was in
the range of the other quotes.
In reviewing our records the contractor with the lowest quote had previously done work for the
City, but the workmanship and timely manner of the work was not performed to the standards of
the City. The quote for $49.50 a linear foot comes from a contractor that has not done business
with the City. The quote from B&G Fences, Corp. is competitive and lower than the original
proposals submitted from other companies when the original contract was awarded. B&G
Fences, Corp has done several projects for the City and has completed them on time and under
budget. In order to continue the fabrication and installation of the fence and complete the work
on schedule, staff recommends that the City amends the prior contract with B&G Fences, Corp
to include the additional scope of work, The project which includes fencing and landscaping is
on schedule and the time line of seven months to complete the project still remains the same. As
a point interest the Code Enforcement Department and Public Works Department have noticed a
reduction on the jaywalking in the area where the median fencing has already been located.
Funding for this project will be from account #20-600-5667.
