HomeMy WebLinkAboutReso 2009-1385 RESOLUTION NO. 2009- '3<65 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, RATIFYING THE APPROVAL OF THE AGREEMENT BETWEEN FORTIN, LEAVY, SKILES, INC. AND THE CITY OF SUNNY ISLES BEACH, TO PROVIDE PLATTING SERVICES FOR THE GOVERNMENT CENTER, IN THE AMOUNT NOT TO EXCEED TWENTY-FIVE THOUSAND DOLLARS ($25,000.00), ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER AND/OR DESIGNEE TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the property lines of the Government Center includes City Hall and the Tony Roma's property; and WHEREAS, the City is in need of a Surveyor to prepare a tentative plat to subdivide the Government Center parcel into two separate parcels; and WHEREAS, Fortin, Leavy, Skiles, Inc. has agreed to perform the desired platting services for the Government Center an amount not to exceed Twenty-Five Thousand Dollars ($25,000.00). NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Ratify the Agreement. Approval for the Agreement with Fortin, Leavy, Skiles, Inc. to provide platting services for the Government Center, in an amount not to exceed Twenty- Five Thousand Dollars ($25,000.00), attached hereto as Exhibit "A", be, and the same, is hereby ratified. Section 2. Authorization of City Manager and/or Designee. The City Manager and/or Designee are hereby authorized to do all things necessary to effectuate the terms of this Resolution. Section 3. Our scope of work is as follows and is subject to terms and conditions listed on Exhibit "A" and Exhibit "B" (attached): I. SCOPE OF WORK: 1. Preparation of the tentative plat in accordance with City of Sunny Isles Beach, Miami-Dade County and AL TAlACSM Standards, including prints to each department for the initial submittal. The tentative plat wiil be ready for submittal within 15 working days from receipt of authorization to proceed. $ 4,875.00 2. The preparation of the application, research of governmental agencies for processing of plat, utilities, traffic studies, title work, taxes, bonds, amendments to the plat from the City and County and additional copies will be performed at our hourly rates, per attached. Fortin, Leavy, Skiles, Inc. 2. Prepare final plat to meet Chapter 177, Florida Statutes, City of Sunny Isles Beach and Miami-Dade County codes. all owners and mortgage holders must execute the plat. Six copies are submitted along with proof of ownership and opinion of title to Miami-Dade County Public Works Department for approval. $ 6,375.00 4. Final plat monumentation along subject property to be set in accordance with Chapter 177, Florida Statutes: Permanent Control Points, Permanent Reference Monuments and State Plane Coordinates. $ 2.975.00 This agreement expressly excludes any work to ~xpedite the Plat approval through the City and County, All memorandums written and/or meeting(s) attended will only be done at the request of the client at the time they are needed and are to be billed at our hourly rates, per the attached. The surveyor does not guarantee approval of the Plat and/or client's plans for development. This agreement replaces any verbal and or previous estimate, which may have been offered, All payments are to be made upon submission of invoice or partial invoice on a monthly basis. It is also made with the condition that printing and courier charges are for the account of the owner/client. Title research work required to plot all easements are to be billed at our hourly rates. Our invoices will be submitted monthly, based on the percentage of completed work, and payments shall be made by the owner/client within thirty (30) days of the statement date. All accounts 30 days past due are subject to a 1.5% per month service charge plus all legal and collection fees. If the owner/client fails to make payments when due or otherwise is in breach of this Agreement, Fortin, Leavy, Skiles, Inc. (FLS, Inc.) may suspend perfonnance of services upon 30 calendar days notice to the owner/client. Fortin, Leavy, Skiles, Inc. shall have no liability whatsoever to the owner/client for any costs or damages as a result of such suspension caused by any breach of this Agreement by the owner/client. Upon payment in full by the owner/client, FLS, Inc. shall resume services under this Agreement, and the time schedule and compensation shall be equitably adjusted to compensate for the period of suspension plus any other reasonable time and expense necessary for Fortin, Leavy, Skiles, Inc. to resume perfonnance 2. This proposal is valid for sixty (60) days from date submitted. 3. The fees quoted herein are valid for one year after the date the proposal is submitted. 4. If the scope of the project or site plan configuration changes significantly after this proposal IS submitted, we reserve the right to submit a revised proposal based on the then current plans. 5. All governmental fees shall be paid by the owner/client. 6. The costs of blueprinting, reproductions, and special messenger services will be billed at our cost, and are not included in the fees quoted herein. 7. The services to be perfonned by Fortin, Leavy, Skiles, Inc. under this Agreement are intended solely for the benefit of the Owner. Nothing contained herein shall confer any rights upon or create any duties on the part of Fortin, Leavy, Skiles, Inc. toward any person or persons not a party to this Agreement including, but not limited to any contractor, subcontractor, supplier, or the agents, officers, employees, insurers, or sureties of any of them. 8. The Owner and Fortin, Leavy, Skiles, Inc. waive all rights for damages, each against the other and against the contractors, consultants, agents, and employees of the other, but only to the extent covered by property insurance during or after construction, except such rights as they may have to the proceeds of such insurance. The Owner and Fortin, Leavy, Skiles, Inc. each shall require similar waivers from their contractors, consultants, and agents. 9. Drawings, calculations, sketches, field books, field notes, electronic field data, computer files, and other similar documents are instruments of service, and as such are to remain the property of Fortin, Leavy, Skiles, Inc. Vera, Assistant City Manager/ Service Division February 19,2009 Government Center Platting RECOMMENDATION It is recommended that the City Commission approve the attached Resolution to approve the services of Fortin, Leavy, Skiles, Inc. for the platting of the Government Center parcel, in the amount of $25,000.00. REASONS The City is in the process of platting certain City properties for taxing purposes. Currently the Government Center and Tony Roma's are located within the same tax folio number thereby taxes are being imposed by Miami Dade County Property Appraisal Office. The re-platting of the Government Center parcel would provide Tony Roma's with their own tax folio number and taxes would be imposed just on that parcel of land. The remaining area, which will be the Government Center and parking lot, would have its separate tax folio and would be exempt from property taxes. Funds are budgeted in 10-540-5313.
