HomeMy WebLinkAboutReso 2009-1370 RESOLUTION NO. 2009-1210 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, ESTABLISHING A FORMAL POLICY AND PROCEDURE ON NAMING OF PUBLIC FACILITIES; PROVIDING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach ("City") seeks to honor individuals with dedications and or naming of certain public facilities; and WHEREAS, there is need to establish a formal procedure and criteria for the selection of names for certain public faci I ities; and WHEREAS, in order to establish a fair and equitable process for designating place names, it is in the best interest of the City to establish an orlicial policy on designating place names and name changes; and WHEREAS, this resolution establishes an official policy and procedure to name or change names of public facilities. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section I Establishment of an Official Policy: The City Commission hereby adopts a formal policy, attached as Exhibit "A" regarding the placement of names on public facilities. Section 2 Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate the terms of this Declaration. Section 3. Effective Date. FACLITIES AND PROPERTIES Procedures for Naming or Renaming Facilities or Property: 1. Policy: · The City of Sunny Isles Beach ("City") shall designate names of public facilities in accordance with the tallowing procedures outlines here. 2. Definitions: · Public Facilities: all properties and facilities that are within City limits. and owned and controlled by the City. · Parks and Recreation Facilities: are public parks. beach access easements, recreation facilities and public spaces that are controlled and managed by the City. 3. Procedure: · The mayor. a member of the Commission. City's Advisory Committee or any citizen may submit a request naming or renaming a public facility. The requests must be submitted in writing to the Office of the City Clerk. The Clerk shall present the request to members of the City Commission and the City Manager. · The Mayor, in consultation with the City Commissioners will review all requests at a public meeting. · At the discretion of the City Commission, public comments may be allowed at the public meeting regarding the request naming or renaming of a public facility. · The Commission shall approve or disapprove the naming or renaming action by resolution. The resolution must pass by a super majority (majority plus one vote). Naming Rights Reso Page J or:i · The City Manager shall take all steps necessary to implement the naming or renaming of the public t~lcility. The City Manager or designee shall file the name designation with the City Clerk. at which time the name will become official. The City Manager or designees shall within a reasonable time schedule a naming or renaming ceremony. 4. Responsibility: · The City Commission is authorized to establish additional criteria and procedures to be followed in selecting names to be placed on public facilities. · The City Commission has the final authority to approve or disapprove of any name that may be submitted for tinal approval. 5. Criteria: · In order to provide an appropriate naming of public t~lcilities and prevent duplication, the City Commission shall make sure existing public facilities, building or any other structures or parks do not bear the same name, except for any facility that was designated prior to adoption of policy. · The City Commission shall consider factors such as the historical and cultural signi ficance, geographical location, distinctive natural or geological features, and wishes of the community in the facility which is located. · Public facilities may be named after a person that is alive or deceased. The name should be of an individual that has enhanced the quality of life within the city. · Public facilities may be named after researched shows that facility. place or public t~lcilities has been commonly. yet unofficially. named by the residents of the area. · A name, once bestowed. is permanent. except where there is good cause to remove a name. Good cause means a reasonable justification for the removable of the name. · No more that one name can occur on the City's properties. · No name will be considered that diminishes the historic integrity of a requested facility or property. 6. Naming of City Buildings, Parks, and Streets: Notwithstanding any other provisions in this policy statement. city buildings, parks and streets shall be named under the following criteria. No City building, parks. or streets shall be named 1'01' any person unless the person is: Naming Rights Reso Page 4 of) · A current or former member of the City Commission who has been elected to at least two (2) terms. · An outstanding civic or community leader of local. state, or national repute. 7. Naming Rights: Notwithstanding any provision in this policy statcment, the City Commission may name public facilities pursuant to a naming rights agreement, which provides compensation to the City for such rights. 8. Recognition of Public Service on the City Commission or Boards: Notwithstanding any provision in this policy statement the City Commission may recognize a member of the City Commission or original incorporators of the City, and initial Charter Committee by placing his or her name on a monument designatcd for placement in Heritage Park.
