Home My WebLink AboutReso 2009-1408 RESOLUTION NO. 2009 - ~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A FIRST ADDENDUM TO AGREEMENT WITH OTIS ELEVATOR COMPANY BY ADDING MAINTENANCE OF THE ELEVATOR AT PELICAN COMMUNITY CENTER, IN AN AMOUNT NOT TO EXCEED TWO HUNDRED THIRTY DOLLARS ($230.00) PER MONTH, A TT ACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID FIRST ADDENDUM TO AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the elevator located at Pelican Community Center is covered under a one (1) year new product service warranty which expires on April 29, 2009; and WHEREAS, Otis Elevator Company has been providing elevator maintenance services for the City since February 1,2006 based upon a proposal executed with the City dated January 9, 2006, and ratified on September 21, 2006 by the City Commission, via Resolution No. 2006-980, to maintain the three (3) City hydraulic elevators located at the Sunny Isles Beach Government Center, in an amount of$829.20 per month, for a period offive (5) years; and WHEREAS, the City now wishes to amend that agreement in order to add the elevator located at Pelican Community Park; and WHEREAS, Otis Elevator Company has expressed its ability and desire to provide these services; and WHEREAS, the City wishes to approve a First Addendum to Agreement with Otis Elevator Company to provide these additional services for the elevator located at Pelican Community Center, in an amount not to exceed Two Hundred Thirty Dollars ($230.00) per month, attached hereto as Exhibit "A", bringing the total monthly payment amount to One Thousand Fifty-Nine Dollars and Twenty Cents ($1,059.20). NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of First Amendment to Agreement. The City Commission hereby approves the First Addendum to Agreement with Otis Elevator Company to provide maintenance services for the elevator located at Pelican Community Center, in an amount not to exceed Two Hundred Thirty Dollars ($230.00) per month, attached hereto as Exhibit "A". Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Agreement. Section 4. Effective Date. C0708-045 THIS FIRST ADDENDUM TO THE OTIS ELEVATOR COMPANY AGREEMENT, executed this 24 day of Mil , 2009, is tliere§y attached to and is made a part of said Otis Elevator Company Agreement Contract No. COO y and between the City of Sunny Isles Beach ("City") and Otis Elevator Company (A/K/A "Otis") ("Contractor") a business corporation licensed in the State of Florida, whose Federal Identification # is 13• SS$ C s1 . The City and Contractor hereby agree as follows: 1. ADDITIONAL SCOPE OF WORK: The City wishes to add to the Original Agreement between the parties by adding a Schindler Hydraulic FO1302 unit at Pelican Community Park, as more fully described in Attachment"A". 2. COST: The Contractor agrees to charge $230,00 (Two Hundred Thirty Dollars) a month commencing May 1, 2009, and continuing throughout the termination date of the Original Agreement, in an amount not to exceed $4,830.00(Four Thousand Eight Hundred Thirty Dollars). 3. TERM: The term of this First Addendum shall begin on May 1, 2009 and shall continue until the termination date of the Original Agreement, i.e. February 1, 2011. 4. CONFIRMATION OF AGREEMENT TERMS: Except as expressly set forth herein, the terms and conditions of the Original Agreement shall remain in full force and effect. In the event of any conflict between the terms and conditions of this First Addendum and the Original Agreement, the terms and conditions set forth in this First Addendum shall control with respect to the subject matter hereof. BACKGROUND On September 21, 2006, the City Commission approved Resolution No. 2006-9810 ratifying a service agreement with Otis Elevator Company for the maintenance of three hydraulic elevators located in the Sunny Isles Beach Government Center. Since that time, the City opened Pelican Community Park Community Center (PCP) housing one elevator that is covered under a one year new product service warranty with Schindler Elevator Corporation. The elevator warranty expired April 29, 2009. As such, staff contacted Schindler Elevator and Gator Elevator for a quote for maintenance service, and their quotes were higher than Otis Elevator Company. Therefore, we are desirous of adding the PCP elevator to the Government Center's elevator agreement with Otis Elevator Company for an additional $230.00 per month. ADDITIONAL INFORMATION The original five-year service agreement expires on February 1st, 2011. The City currently pays $829.20 per month for Otis Elevator Company to service the three elevators at Government Center, and with the additional $230.00 for PCP, the total would be $1,059.20 per month.
