A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AMENDING
RESOLUTION NO. 14-Z-145 TO EXTEND THE TIME PERIOD
TO OBTAIN A BUILDING PERMIT BY MIAMI BEACH
MARIAN TOWERS, INC. (THE "APPLICANT") FOR THE
RENOVATION PROJECT ENTITLED "MARIAN TOWERS"
LOCATED AT 17505 NORTH BAY ROAD, IN ACCORDANCE
WITH SECTION 265-11 (L) OF THE CITY CODE;
AUTHORIZING THE CITY MANAGER AND THE CITY
ATTORNEY TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Applicant has requested an extension of time to pull a building permit in
accordance with Resolution No. 14-Z-145, adopted on October 16, 2014; and
WHEREAS,the Applicant's zoning approval is set to expire on October 16, 2016 and the
Applicant has stated good grounds for the extension request; and
WHEREAS, the City Commission wishes to approve the request for extension and
extends the zoning approval issued under Resolution No. 14-Z-145 to October 16, 2017.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Extension Request. Pursuant to Section 265-11(L) of the City Code,
the City Commission hereby approves the request for extension submitted by the Applicant,
Marian Towers, Inc., and extends the zoning approval issued under Resolution No. 14-Z-145 to
October 17, 2017.
Section 2. Authority of the City Manager and City Attorney. The City Commission provides
the City Manager and City Attorney with the authority to do all things necessary to effectuate this
Resolution.
Section 3. Effective Date. This Resolution shall become effective upon adoption.

Re:Marian Towers—Site Plan Approval 14-Z-145—Request for Extension
Dear Ms.Hasbun,
Our construction drawings are currently in the building permit process(PS2016-9).,we have received and
responded to the permit review comments and are expected to be approved shortly; however to error on
the side of caution please accept this letter as our formal request to extend our site plan approval as
referenced above in accordance with Code Section 265-3(b)(6). This extension request is based upon
delays that were outside the control of the property owner/developer. These delays were a result of the
project not being selected by during the initial tax credit funding cycle and therefore needing to rely on
and apply for additional funding sources. This delayed the project by about 18 months while an alternate
funding source was identified and secured. In addition a longer than anticipated review and approval
time frame was expected.in the DERM and Miami Dade Fire process.

RECOMMENDATION:
This Resolution is presented for your consideration.
REASONS:
The Marian Towers (Applicant) is requesting an extension of time to pull a building permit
in accordance with Resolution No. No. 14-Z-145, adopted on October 16, 2014. The
Applicant's zoning approval is set to expire on October 16, 2016 and the Applicant has
stated good grounds for the extension request. The request is for one additional year from
the original zoning approval expiration date.
