A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AMENDING
RESOLUTION NO. 15-Z-151 TO EXTEND THE TIME PERIOD
TO OBTAIN A BUILDING PERMIT BY ST. TROPEZ BEACH
DEVELOPERS, LLC. (THE "APPLICANT") FOR THE PROJECT
ENTITLED "ST. TROPEZ OFFICE BLDG" LOCATED AT 16690
COLLINS AVENUE, IN ACCORDANCE WITH SECTION 265-11
(L) OF THE CITY CODE; AUTHORIZING THE CITY
MANAGER AND THE CITY ATTORNEY TO DO ALL THINGS
NECESSARY TO EFFECTUATE THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Applicant has requested an extension of time to pull a building permit in
accordance with Resolution No. 15-Z-151, adopted on April 16, 2015; and
WHEREAS, the Applicant's zoning approval is set to expire on October 17, 2016 and the
Applicant has stated good grounds for the extension request; and
WHEREAS, the City Commission wishes to approve the request for extension and
extends the zoning approval issued under Resolution No. 15-Z-151 to October 17, 2017.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Extension Request. Pursuant to Section 265-11(L) of the City Code,
the City Commission hereby approves the request for extension submitted by the Applicant, St.
Tropez Beach Developers, LLC. and extends the zoning approval issued under Resolution No.
15-Z-151 to October 17, 2017.
Section 2. Authority of the City Manager and City Attorney. The City Commission provides
the City Manager and City Attorney with the authority to do all things necessary to effectuate this
Resolution.
Section 3. Effective Date. This Resolution shall become effective upon adoption.

Re: Request for Extension of Time
Dear Ms. Hasbun:
On behalf of St. Tropez Beach Developers. LLC and pursuant to the provisions of
Section 265-11(L) of the City's Land Development Regulations ("LDRs"), we would
respectfully request an extension of time to pull a building permit for the office tower component
of the approved site plan. As you are aware, pursuant to Resolution No. 15-Z-15 a modified site
plan was approved by the Commission which allowed the construction of two (2) additional
residential towers (Parque Towers at St. Tropez) and an office tower to be located at the comer
of Sunny Isles Boulevard and Collins Avenue. That Resolution also granted an extension of time
to pull the required building permits from October 17, 2015 to October 17, 2016. While my
client has timely pulled their building permits for both of the residential towers, which are
presently under construction, this request is made for the office tower component noted above.
We believe there is "good cause" to extend the deadline for receiving the building permit
for the office tower. Construction of the residential towers has required the partial closure of
Sunny Isles Boulevard adjacent to those towers until substantial completion of those towers.
Pulling a building permit and initiating construction on the office component during that
construction would further require the closure of another lane of traffic at the very busy
intersection of Collins and Sunny Isles Boulevard. We believe that it is in the best interest of the
developer and the City that the construction of the office tower is delayed until the substantial
completion of the residential component in order to minimize traffic congestion at, near and
around Sunny Isles Boulevard and Collins Avenue. We would respectfully request an extension
of time for 24 additional months, which should be a sufficient time for the completion of the
construction of Parque Towers at St. Tropez.

In addition, certain design changes are being considered to deal with:
1. Roof enhancements requirements;
2. New renderings;
3. Landscape coordination with the boardwalk entrance feature at Collins Ave.; and
4. Pending discussions with the Miami Dade Fire Department and FDOT related to
the curb-cut at the fire staging area along Collins Ave.

RECOMMENDATION:
This Resolution is presented for your consideration.
REASONS:
The St. Tropez Office Building (Applicant) is requesting an extension of time to pull a
building permit in accordance with Resolution No. No. 15-Z-151, adopted on April 16,
2015. The Applicant's zoning approval is set to expire on October 17, 2016 and the
Applicant has stated good grounds for the extension request. The request is for one
additional year from the original zoning approval expiration date.
