A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE
PURCHASE OF TUFF CURB CURBING AND STANCHIONS
FROM GULF INDUSTRIES, INC., IN AN ANNUAL AMOUNT
NOT TO EXCEED TWENTY-FIVE THOUSAND DOLLARS
($25,000.00), ATTACHED HERETO AS EXHIBIT "A", BASED
ON A SOLE SOURCE PRODUCT FOR COMPLIANCE WITH
THE FLORIDA DEPARTMENT OF TRANSPORTATION
(FDOT); AUTHORIZING THE CITY MANAGER TO DO ALL
THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, staff has designed and received approval from the Florida Department of
Transportation (FDOT) to construct several projects on their right-of-way; and
WHEREAS, by the direction of FDOT the City used the Tuff Curb products for lane
delineation; and
WHEREAS, Gulf Industries, Inc. provided a quote for the purchase of Tuff Curb curbing
and stanchions on a guaranteed unit price, in an annual amount not to exceed Twenty-Five
Thousand Dollars ($25,000.00), attached hereto as Exhibit "A"; and
WHEREAS, Tuff Curb curbing and stanchions are based on a unique interlocking
system and Gulf Industries, Inc. is its sole source supplier, and as a sole source purchase the
City's Procurement Code provides in Section 62-13(F) that this purchase is exempt from the
competitive bidding procedures; and
WHEREAS, the City desires to purchase said materials from Gulf Industries, Inc., in an
annual amount not to exceed Twenty-Five Thousand Dollars ($25,000.00), as needed to cover
any major projects throughout the City that must be quickly addressed for the safety and welfare
of its citizens and visitors.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: '
Section 1. Approving the Purchase. The purchase of Tuff Curb curbing and stanchions from
Gulf Industries, Inc., in an annual amount not to exceed Twenty-Five Thousand Dollars
($25,000.00), based on a guaranteed unit price, attached hereto as Exhibit "A", be, and the same,
is hereby approved.
Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 3.
Effective Date. This Resolution will become effective upon adoption.

Approving the Purchase of Tuff Curb Curbing and Stanchions from Gulf
Industries, Inc.
RECOMMENDATION:
Approve the Resolution authorizing the City Manager to purchase Tuff Curb curbing and
stanchions from Gulf Industries in an annual amount not to exceed $25,000.
REASONS:
We have designed and received approval from the Florida Department of Transportation
(FDOT) to construct several projects on their right-of-way, and by their direction, used
the Tuff Curb products for lane delineation. This product is based on a unique
interlocking system and we have not been able to find any other supplier that makes even
a remotely similar product. To us, this is truly a sole source situation. Because we
already have a significant inventory of the bases and the stanchions, for maximum
flexibility it only makes sense to use the exact same system everywhere in the City. As
new jobs and locations develop through the year, we find ourselves exceeding the
$10,000 limit for a single vendor. We are therefore asking for authorization to purchase
up to $25,000 worth of materials per year to cover any major projects that must be
quickly addressed for public safety. We have a guaranteed unit price and will only
order and pay for exactly what is needed and no more. Examples of this system are
the 182nd Street area and the 183rd Street interesection with Collins.
FUNDING SOURCE:
These items will be funded through the individual capital projects of which they are a
part.
